Minutes of the Meeting of the City Council of San Juan Capistrano
JUNE 26, 1967
The regular meeting of the City Council was called to order at 6:05 PM by
Mayor Edward S. Chermak.
The pledge of allegiance was recited. Invocation was given by Ernest A.
Thompson, City Administrator.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Don Durnford, Antonio M. (Tony) Olivares and Edward S. Chermak.
The minutes of the regular meeting of June 19, 1967 were approved as presented.
",6 WRITTEN COMMUNICATIONS
A letter was received from H. G. Osborne, Chief Engineer of the Orange County
Flood Control District, regarding Flood Plain Regulations in San Juan and Trabuco
Creeks. Mayor Chermak requested staff to pursue the item with Mr. Osborne and
report back to Council at a later date. Councilman Durnford then offered Resolution
No. 67-6-26-1 endorsing the recommendations offered by Mr. Osborne, and that staff
will investigate the matter. Resolution passed, approved and adopted by unanimous
vote.
TREASURY DEMANDS
The list of accounts payable June 30, 1967 were presented by Director of
Finance. Mr. Albert requested that Warrant No. 2631 in the amount of $500.96, pay-
able to Capistrano Beach Sanitary District for the sixth apportionment of their
share of secured tax charge, be added to the list of demands. Director of Public
Works also requested that Gino Leoni be reimbursed for services rendered in the
Weed Abatement Program. Councilman Buchheim moved that Warrant Nos. 2570 through
2631, inclusive, be paid in the amount of $13,433.15. Motion seconded by Council-
man Bathgate and carried unanimously.
Councilman Bathgate then moved to pay the Weed Abatement bill in the amount
of $1,365.00, subject to verification of parcel numbers, and that the warrant be
dated after July 1, 1967. Seconded by Councilman Buchheim and so carried.
PLANNING COMMISSION MATTERS
Memorandum submitted from Secretary of the Planning Commission denoting
actions taken at their regular meeting of June 20, 1967.
UNFINISHED BUSINESS
(a) City Attorney rendered second reading, in full, of proposed Ordinance No. 128,
Amendment #4 to the Precise Zoning Map. Councilman Bathgate offered Ordinance
No. 128 for adoption. Passed, approved and adopted by unanimous vote.
(b) City Attorney reported on formation of a Mounted Posse. His suggestion was

that the proposed organization be called "Honorary Mounted Posse of the City
of San Juan Capistrano for the Fiscal Year 1967-6811, to preclude the possi-
bility of liability. After discussion, Mayor Chermak directed City Attorney
to consult with the Sheriff's Office and report back to Council before a
decision is rendered.
RECOMMENDATIONS AND REPORTS
(a) City Engineer, Jack Y. Kubota
(1) Reported on status of construction program. Del Obispo School site
being cleared and they are making street embankment on Del Obispo.
(2) Darmi Tract 6244 moving rapidly. Storm drain system well on way.
(3) Tract $947 nearing completion. Now making arrangements with staff to
move ahead with sidewalk on Camino Capistrano.
(4) In the process of making final improvement plan review for access
road into industrial tract. He called out changes in preliminary
plan. Also processing design of railroad crossing.
(5) Questions arising as to various interpretations of approval on the
Stroschein Division of Land at the Ortega Highway and extension of
Del Obispo Street.
(b) Councilman Durnford
Reported on meeting with State Division of Highway Engineer regarding a
proposed interchange at San Juan Creek Road, as recommended in a study made
by Mr. Misbin and his engineer. Highway Department is to submit plan to
their design engineers.
(c) Mayor Chermak
(1) Has been asked to declare a "United Nations' Day" on October 24th.
Councilman Durnford, seconded by Councilman Olivares, moved that the
item be tabled for an indefinite period. Carried by a unanimous vote.
(2) Request received from Christiansen & Associates in regard to City's
underground utility ordinance. Mr. Keith Hutchens, representing San
Diego Gas & Electric Co., and Mr. Bob Gannon of Pacific Telephone, who
were in the audience, entered into the discussion with Council. At the
suggestion of City Administrator, Councilman Durnford moved that staff
review ordinance with the aid of representatives of the various utility
companies, also including Southern Counties Gas Co. Councilman Buchheim
seconded the motion and it carried unanimously.
