Minutes of the Meeting of the City Council of San Juan Capistrano
JANUARY 30, 1967
The regular meeting of the City Council was called to order at 6:03 by Mayor
Don Durnford.
The pledge of allegiance was recited. Invocation was given by City Attorney,
John H. Dawson.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford.
The minutes of the meeting of January 23, 1967 were approved as submitted.
TREASURY DEMANDS
The accounts payable February 1, 1967 were presented by Director of Finance,
Harold L. Albert. Councilman Buchheim, seconded by Councilman Bathgate, moved
that Warrant Nos. 2282 through 2344, inclusive, for a total amount of $52,119.65
be paid. Motion carried unanimously.
PUBLIC HEARING — Amendment No. 1 to City Land Use Element
Mayor Durnford opened public hearing. Robert K. Johns, Associate Planner,
made a presentation of the land use element reflecting land use changes in Darmi
Tract area, stating Planning Commission had adopted plan at first public hearing.
As there were no comments from the audience, Mayor Durnford declared public hearing
closed.
Councilman Buchheim, seconded by Councilman Bathgate, moved that the matter
be deferred until the next regular meeting for a decision, pending further study
by Council. Motion carried unanimously and was so ordered.
NEW BUSINESS
(a) Staff discussed the merits of holding a special census of the City due to
the increase of approximately 300 new people in the area since the last
census of May, 1966. Councilman Bathgate moved that a new special census
be made and that Director of Finance, Harold L. Albert, be given authority
to sign formal agreement with the Department of Commerce and to handle the
matter through his offices. The motion was seconded by Councilman Buchheim
and carried by a unanimous vote.
(b) City Administrator stated City Employees at a special meeting had voted
unanimously to adopt a City Retirement Plan, 7 voting for Plan A, and 1 vote
for Plan B, as presented by National Associates, Inc. Director of Finance
made a presentation of both plans. Councilman Chermak, having studies
retirement plan as presented last year, suggested that Plan A be adopted.
Mayor Durnford, seconded by Councilman Chermak, moved that an appropriate
ordinance be drafted reflecting Plan A. Motion carried by a unanimous vote.

RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
Stated meeting is to be held in Los Angeles regarding employer-employee
relations prior to City Managers' Meeting in Palo Alto.
(b) City Attorney, John H. Dawson
Re: Local Agency Formation Commission Litigation - Has prepared Request for
Admissions from LAFCO.
(c) City Engineer, Jack Y. Kubota
(1) Report on proposed railroad crossing for access road to airport. He _
has met with engineer of the Atchison, Topeka and Santa Fe railroad.
Now working out details for design of 48 foot crossing, allowing
for four lanes of traffic.
(2) Has been in contact with State Division of Highways personnel regard-
ing excess land. They are now getting clearances and will advise as
to status before entering into negotiations with the City.
(d) Director of Public Works, T. J. Meadows
(1) Some plans on proposed Assessment District No. 66-1 are due City
this week.
(2) Few maintenance problems due to recent storm, but not too serious.

There being no further business, the meeting adjourned at 7:15 PM.
