Minutes of the Meeting of the City Council of San Juan Capistrano
JANUARY 16, 1967
The regular meeting of the City Council was called to order at 6:o0 PM by
Mayor Don Durnford.
The pledge of allegiance was recited. Invocation was given by City Attorney,
John H. Dawson.
Councilman Chermak, having been sworn into office at a pre -meeting ceremony,
was commended by Mayor Durnford for again serving on the City Council.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford.
The minutes of the meeting of January 9, 1967 were accepted as presented.
WRITTEN COMMUNICATIONS
(a) Request from Boy Scouts of America, Orange Empire Area Council, for permission
to sell tickets to annual Scout -O -Rama. Mayor Durnford, seconded by Council-
man Bathgate, moved that permission be granted. Motion carried unanimously.
(b) Resolution received from City of San Clemente indicating its intention to
cooperate with appropriate agencies in connection with the joint problem of
the ultimate disposition of sewerage.
(a) Request for waiver of conditions imposed on DL 64-109, Ralph C. Sutro Co.
City Administrator requested a one week extension of the matter. So granted.
(b) City Administrator reported on recommendation for changes in Section 143 of
California Streets and Highways Code as presented in resolution from City
of Stanton. Councilman Bathgate moved that the resolution be received and
filed.. Motion seconded by Councilman Buchheim and carried unanimously.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
(1) - a Mr. Thompson reported on the matter of the precise alignment of Alipaz
Street from Del Obispo Street northerly and stated that City Engineer
had completed the survey and therefore would be submitting the plan
shortly.
- b Regarding that portion of Alipaz Street being provessed for improve-
ment and reconstruction under AHFP Project No. 307, a status report
from Land Acquisition Service revealed outstanding adversities and
obligations of property owners reluctant to participate by conveying
appropriate rights of way for this improvement project. After con-
siderable discussion, Councilman Buchheim, seconded by Councilman

Bathgate, moved to instruct staff to prepare a Certified Letter €,iving
chronological sequence of events leading up to present status of
Arterial Financing Program, and possible consequences of failure if
not properly carried through. This letter to be presented to Council
for approval before being sent to principle property owners. Copies
of letter from City Engineer's office stating qualifications is also
to be sent. Motion carried unanimously and was so ordered.
(2) Reported on LAFCO meeting regarding amendment of boundary description
on proposed Dana Point/Capistrano Beach incorporation.
(b) Director of Finance, Harold L. Albert
Assessment District No. 64-1 bonds in the amount of $362,585.77 received this
date to be delivered to Colich Construction Company January 17th.
(c) Director of Public Works, T. J. Meadows
(1) Due to recent heavy rains, some sewer pipeline has been lost.
(2) Ramos Street project started by Morgan Paving Company.
(3) Recommended purchase of 25 reconditioned flasher barricades at special
price of $12.50 each. Mayor Durnford moved that Director of Public
Works and Director of Finance be authorized to purchase 25 hand-picked
barricades. Motion seconded by Councilman Buchheim and carried by
unanimous vote.
(d) City Engineer, Jack Y. Kubota
(1) Tract 5947 (Transamerica) all paved and ready to proceed with side-
walks and street lighting.
(2) Street sections of Forster Street will be finished this week.
(3) 63 inch storm drain on Val Verde completed., Head wall on golf course
side near completion.
(4) Has started review and preparation of documents for railroad crossing
at Capistrano Airport and Industrial Park. He is withholding design,
as he prefers the application be based on permanent crossing according
to master plan requirements. To be presented at Planning Commission
meeting January 17th.
(5) Received response from State Division of Highways regarding excess
parcels. They stated City will hear from them in due course.
(e) Councilman Bathgate
Received several complaints from property owners pertaining to acquisition
of easements for sewer lines in Assessment District No. 64-1. Council agreed
that to avoid future misunderstandings, it would be helpful to have design

engineer accompany Land Aquisition Service representative when contacting
property owners.
(.P) Mayor Durnford
(1) Mr. Misbin and associates have invited him to attend hearing in
Sacramento on freeway widening through the City.
(2) Attended League of California Cities meeting and heard discussion
regarding tax reduction on land to be used for agricultural pursuits.
Council discussion followed.
