Minutes of the Meeting of the City Council of San Juan Capistrano
NOVEMBER 28, 1966
The regular meeting of the City Council was called to order at 6:00 PM
by Mayor Don Durnford.
The pledge of allegiance was recited. The invocation was given by City
Attorney, John H. Dawson.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Antonio M. (Tony) Olivares and Don Durnford. Absent: Councilman
Marco F. (Tom) Forster.
The minutes of the regular meeting of November 21, 1966, were approved as
presented.
WRITTEN COMMUNICATIONS
(a) Letter from Orange County Mosquito Abatement District regarding appointment
of representative of the City to their district. Council commended Mr. Howard
Lattimer on past performance. Councilman Buchheim, seconded by Councilman
Bathgate and unanimously carried, reappointed Mr. Lattimer as representative
of the City to the Orange County Mosquito Abatement District.
(b) Letter from Mr. Ulrich, owner of Capistrano Terrace Mobile Home Park, request-
ing Council to take action in having hazard of flood waters from area of the
County Dump corrected. Councilman Buchheim stated that effort should be made
by Council to improve the situation and so moved that the City Administrator
be instructed to write to the Board of Supervisors and the Orange County
Disposal Department asking their cooperation in removing silt in the area
mentioned, with copies to Capistrano Terrace and Volkswagen agency. Motion
was seconded by Councilman Bathgate and unanimously carried. So ordered.
COMMITTEE REPORT
Councilmen Bathgate and Buchheim reported on question of reimbursement for
trees removed from rights of ways granted by easement deed. Councilman Bathgate
gave a recommendation as to what they felt would be just compensation for destruction
of trees, with stipulation that funds to reimburse property owners come from assess-
ment district and not the City. He then made the motion that payment be made as
follows: 8 trees at $16.00 each - $128.00. 15 trees at $35.00 each - $525.00.
Total disbursement of $653.00. Motion was seconded by Mayor Durnford and carried
unanimously.
TREASURY DEMANDS
The accounts payable December 1, 1966 were presented by Director of Finance,
Harold L. Albert. Councilman Bathgate, seconded by Councilman Buchheim and carried
unanimously, moved that Warrant Nos. 2171 through 2224, inclusive, for a total amount
of $21,935.86 be paid.
City Attorney read in full proposed Ordinance No. 126, amending Precise Zoning
Map. Councilman Bathgate offered Ordinance No. 126 for adoption. The ordinance was
passed, approved and adopted by unanimous vote.

The City Clerk read letter from record owners of Mission Hills Ranch (P. A.
Palmer, Inc., Newport Balboa Savings & Loan Assn., and Royal Street Development Co.,
Inc) requesting consideration for annexation to City of San Juan Capistrano. Council-
man Buchheim offered a resolution of intention for annexation and setting date of
public hearing on proposed annexation for December 12, 1966. The resolution was
passed, approved and adopted by unanimous vote.
Councilman Buchheim made a motion that Engineering -Science, Inc. be instructed
to include this 198 acres in their survey for 1911 Act and to further process in an
expeditious manner. Mayor Durnford seconded the motion and it carried unanimously.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
Reported on Memorandum received from Orange County Planning Department regard-
ing revised population estimate for the City and stating their revised estimate
as of July 1, 1966 is 2,298 rather than 2,541 as reported previously. He is
awaiting certification of Board action to supplement contract to this degree
and is withholding payment until verified.
(b) City Engineer, Jack Y. Kubota
(1) Received notice from Public Utilities Commission regarding their decisions
on four railroad crossings in City. Their recommendations are as follows:
Oso Road Two #8 flashing signals be
installed before June 30, 1970
Verdugo Road and _
Del Obispo Street Automatic gates
Mission Street Closure before February 15, 1967
Discussion followed, but no action taken at this time. Mr. Kubota to
confer with Santa Fe engineers to establish cost of signals and gates.
(2) Regarding cost of traffic signals, job in Carlsbad purchased signals
from $4,500 and $6,500. City Attorney will also obtain estimates on
signals.
(c) Councilman Bathgate
Stated paving great improvement on street by Casas Capistrano, in specifics,
El Camino Real and La Zanja.

Commented on mud on Camino del Avion and Alipaz Street.
