66-1121_CC_Minutes_Regular MeetingMinutes of the Meeting of the City Council of San Juan Capistrano NOVEMBER 21, 1966 The regular meeting of the City Council was called to order at 6:03 PM by Ivayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City ,Attorney, John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. Absent: Cauncilman Carl E. Buchheim. The minutes of the regular meeting of November 14, 1966 and the adjourned 1agular meeting of November 16, 1966, were approved as corrected. WRITTEN COMMUNICATIONS Resolution from Board of Supervisors of Orange County, Re: "Waste Water Disposal and Reclamation for County of Orange, 1966 - 2000" - Informational PLANNING COMMISSION MATTERS The City Clerk read Memorandum from Secretary of the Planning Commission denoting actions taken during their meeting of November 15, 1966. TIEW BUSINESS (a) Letter.from San Juan Capistrano Chamber of Commerce recommending purchase of a portable traffic light by the City for the downtown area. After consider- able disucssion and a presentation of proposed street alighment for inter- section of Camino Capistrano and Ortega Highway by City Engineer, Councilman Forster, seconded by Councilman Bathgate, moved to table the item for further study. Motion carried unanimously. (b) Mr. E. L. Christiansen appeared before Council requesting exoneration of Street Improvement Bonds on Tracts 4.678 and 5125 (Darmi). Upon recommend- ations of City Attorney and City Engineer, Councilman Bathgate moved that the Street Improvement Bonds for Tracts 4678 and 5125 be exonerated, with the condition that a substitute bond be posted in the amount of the cost for drainage facilities in Tract 4678. Motion was seconded by Mayor Durnford and carried unanimously. So ordered. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) Read correspondence and resolution from City of Santa Ana regarding study being made by the Assembly Committee on Governmental Organi- zation of present California laws relating to alcoholic beverages. City Attorney to study and report on item. (2) James (Tito) Olivares to be employed by City in postion of Laborer //-1/-66 195 rendered to the City rather than precise count. Has written to Orange County Planning Commission to revise population figure based upon Federal Census count. He inquired as to whether payment should be made under protest, or to delay payment until revised figures are received from County. (b) City Attorney, John H. Dawson Re: Capistrano Shores Annexation. Filed this date "Opposition to Application for Leave to Sue in Quo Warranto". Left informational copy. (c) Director of Public Works, T. J. Meadows Question arose as to whether the City would reimburse property owner for trees removed from rights of ways granted by easement deed. Mayor Durnford appointed Councilmen Bathgate and Buchheim to study the problem and report to Council at the next regular meeting. (d) City Engineer, Jack Y. Kubota (1) Gave presentation of proposed Ramos Street project and stated estimated cost of pavement and CMPA pipe at swale section would run between $2,500 to $3,000. Councilman Bathgate moved that the project be pursued. Mayor Durnford seconded the motion and it carried unanimously. So ordered. (2) Reported on request to Orange County Road Department to modify Alipaz Street Agreement. Now in receipt of a document from County amending the project agreement. He recommended that the appropriate officers execute this amendment. Councilman Bathgate, seconded by Councilman Forster, moved that the Mayor and City Clerk be authorized to execute this agreement with the County. Motion carried unanimously. PUBLIC HEARING - 8:12 PM Mayor Durnford declared public hearing on rezoning of properties now classi- fied as U-1 "Unclassified", to M-1 "Light Industrial" (Airport property). No one appeared to oppose the rezoning. Dr. Watkins, adjacent property owner, spoke in favor of the rezone. Mayor Durnford declared public hearing closed. Mayor Durnford, seconded by Councilman Bathgate and carried unanimously, moved that first reading of proposed ordinance changing zoning from U-1 to M-1 be read by title only. City Attorney rendered first reading of proposed Ordinance No. 126, entitled "An Ofdinance of the City Council of the City of San Juan Capistrano amending the 'Precise Zoning Map' as adopted by Ordinance No. 115, Section 3.01.3, to be designated 'Amendment No. 3'", by title only. as of December 19 1966. (3) Sheriff's Office using an estimated population figure for services rendered to the City rather than precise count.
