66-1116_CC_Minutes_Adjourned Regular Meeting192 Minutes of the Adjourned Regular Meeting of the City Council of San Juan Capistrano NOVEMBER 16, 1966 Mayor Don Durnford called the meeting to order at 10:00 AM. Councilman present were: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. Special legal counsel, F. Mackenzie Brown, related the format for further discussion on the Zaenglein and Clarence Brown parcels with regard to any further adjustments that might be considered. After some discussion the Council found that the recap of the modification of assessments was conclusive, and thereby Councilman Forster moved to go on record to uphold the previous directive regarding the modi- fied assessments for Parcels 2-14 and 2-15. Motion was seconded by Councilman Bathgate and duly passed by a 4 to 1 vote, Councilman Buchheim voting "No". F. Mackenzie Brown then projected three resolutions to be considered by the Council in order to comply with the provisions of the 1911 Improvement Act, and reiterated the basis for consideration for the first one thusly: 1. Parcel 6-16 - to be deleted from the assessment roll entirely. This parcel is outside the assessment district; outside of the City; and in the unincor- porated area of the County. 2. Parcel 7-38 - A correction as to legal description should be noted as Lot B instead of Lot A. 3. Parcel 2-6 - In its legal description, to include portions of Parcels 6, 7 & 8. 4. Parcel 3-14 - Should be changed to 3-10 in its listing. 5. Back sheet of the roll should relate 10 year bonds instead of 11 year bonds. 6. Parcel 7-39 - To be modified by reducing the original $1,666.32 to $1,606.82. 7. Parcel 4-9 - To be modified in reduction from $1,078.18 to $870.19. 8. Parcel 2-4 - Stands as modified by the City Council in their directive. 9. Parcels 2-14 and 2-15. To be increased accordingly by the same directive. 10. Front sheet to reflect the decreased assessments. Mayor Don Durnford offered Resolution No. 66-11-16-1, entitled "Resolution ordering changes and modifications in assessment in the matter of the construction of certain improvements in Assessment District No. 64-1 in the City of San Juan Capistrano, California", duly accepted and passed by unanimous vote. Councilman Bathgate made a motion, duly seconded by Councilman Forster, to overrule and deny all protests. Motion passed by a majority vote, 3 to 2, Council- man Buchheim and Olivares voting "No". Councilman Bathgate offered Resolution No. 66-11-16-2 entitled "Resolution making final determination as to spread of assessment in the matter of the con- struction of certain improvements in Assessment District No. 64-1 in the City of ji-Ifo-6b San Juan Capistrano, California". The resolution was passed by a unanimous vote. Councilman Bathgate offered Resolution No. 66_11-16-3 entitled "Resolution confirming assessment as modified in the matter of the construction of certain improvements in Assessment District No. 614-1 in the City of San Juan Capistrano, California". The resolution was accepted, approved and adopted by a 14 to 1 vote, Councilman Buchheim voting "No". Councilman Bathgate moved that the hearing be closed, duly seconded by Don Durnford, and so ordered. The meeting adjourned at 10:55 AM. E est A.
