66-1114_CC_Minutes_Regular MeetingMinutes of the Meeting of the City Council of San Juan Capistrano NOVEMBER 14, 1966 The regular meeting of the City Council was called to order at 6:02 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Administrator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Don Durnford. Councilman Antonio M. (Tony) Olivares arrived at 6:06 PM. Councilman Marco F. (Tom) Forster was absent. The minutes of the regular meeting of November 7, 1966, were approved as presented. CONTINUATION OF PROTEST HEARING - Spreading of Assessments, Assessment District 64-1 Mayor Durnford read a letter received from Mr. Clarence Brown protesting to Modified Assessments on parcels numbered 2-14 and 2-15, Assessment District No. 64-1. Mr. John Solomon, attorney for Mr. Brown, appeared on his behalf. After considerable discussion, Councilman Buchheim moved that until such time as five members of the Council were present, no action on subject hearing be taken. Motion was seconded by Mayor Durnford and carried by a 3 to 1 vote, Councilman Olivares voting "No". Mr. Joe Feeney, from the firm of Engineering -Science, Inc., read a letter from Richard C. Massen, reviewing the facts of his original appeal on Assessment Parcel No. 7-39. At this time, John H. Dawson, City Attorney, suggested that the hearing be closed and that an adjourned meeting be set for the matter of decision making, whereby property owners would not necessarily have to be in attendance. Councilman Buchheim, seconded by Councilman Bathgate, moved to adjourn the meeting until 10:00 AM, Wednesday, November 16, 1966. The motion carried unanim- ously. City Clerk is to notify absent member of the adjourned meeting. WRITTEN COMMUNICATIONS Letter from Orange County Medical Association, Re: Emergency Medical Plan and organization for Orange County. Councilman Buchheim offered a resolution approving the Plan and the designation of Ralph Sturdevant, D.D.S., as medical coordinator. The resolution was passed, approved and adopted by a unanimous vote. (a) John H. Dawson, City Attorney, rendered staff report on the request for reduction in sidewalk width for the Stroschein property and recommended that the Council proceed with the intent to Quit Claim that surplus land lying Southerly of the Ortega Highway from a point 40 feet from center- line, but obligate the developer to a reconveyance by easement deed an 11-141-d, to additional 2 feet for the purpose of public utilities and streets and high- ways, thereby providing for standard 10 foot wide sidewalk. Councilman Buchheim, seconded by Councilman Bathgate, moved to accept the recommendation of the City Attorney and authorization to proceed with the matter. Motion carried unanimously. (b) Compromise of Eminent Domain Litigation on on Assessment District No. 64-1. (City of San Juan Capistrano vs. Society Builders, et al). City Attorney reported on subject and recommended a resolution be passed authorizing and directing the compromise of certain eminent domain litigation and the payment _ of $3,120.55 to Carmen Ohyarzabal, Eugenie Oyharzabal and Therese Rodriguez for settlement to acquire easement for ocean outfall sewer line under General Obligation Bond issue. Councilman Buchheim offered resolution for adoption. Passed, approved and adopted by unanimous vote. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) Striping on Camino Capistrano and San Juan Creek Road completed. (2) Related letter from Bill Yates, Volkswagen Agency, requesting Council aid and support in recognizing adversity of surface water overflow from neighboring properties during storm season, and correction of same. No action taken at this time. (b) City Attorney, John H. Dawson Reported conversation with Mr. Heim, County Auditor, regarding "Municipal Sewer District" appearing on City tax rolls. Mr. Heim advised to have this removed from tax forms. (c) Director of Public Works, T. J. Meadows (1) Johns -Manville Corp. extended invitation to Council and staff to attend tour of their plant with dinner following, Wednesday, Nov. 16. (2) Progress being made regarding problem of sewer odor near Post Office. _ (d) City Engineer, Jack Y. Kubota (1) Report on Ganado Bridge and walkway. Offered three suggestions to eliminate problem. After considerable discussion, Councilman Buchheim moved that bridge be posted with signs stating "Vehicular traffic prohibited when pedestrians are on bridge", and "Speed Limit 5 MPH". Motion seconded by Councilman Bathgate and carried unanimously. So ordered. (2) Report on La Zanja Street - Mr. Dunham, of Transamerica Development Co., stated that if City crew could do the clean up work, his company would reimburse expenses incurred. /I—Iy-a10 191 (e) Councilman Bathgate Asked if City could help repair Ramos Street or Mission Street. City Attorney stated that City is liable for all city streets. Councilman Bathgate then moved that Ramos Street be examined from the point of safety and improvement.
