Minutes of the Meeting of the City Council of San Juan Capistrano
OCTOBER 31, 1966
The regular meeting of the City Council of the City of San Juan Capistrano
was called to order at 6:02 PM by Mayor Don Durnford.
The pledge of allegiance was recited. Invocation was given by City
Administrator, Ernest A. Thompson.
The City Clerk called the roll. Councilmen present: William A. Bathgate,
Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford.
The minutes of the regular meeting of October 24, 1966, were accepted as
corrected.
CONTINUATION OF PROTEST HEARING
Assessment Attorney, F. Mackenzie Brown, stated summerization would be made
by Engineer of Work, Mr. Joe Feeney of Engineering -Science, Inc. Mr. Feeney then
gave the following recommendations:
(a) Parcel 7-39 assessed against Glen Carter, now Massen property. Acreage
totaling 1.78, not 1.95 as submitted by the Orange County Assessor's Offic®.
The assessment was reduced from $1,666.32 to $1,606.82. This lowered the
total by the amount of $59-50-
(b) Parcel 3-10 assessed against Mrs. Alice Ross in the amount of $21.00.
Recommended figure stand as is.
(c) Parcel 4-9. Total acreage 0.9, not 1.78. Recommended assessment be lowered
from $1,178.19 to $870.19.
(d) Parcels 2-7, 2-10, 2-11 and 3-12. Recommended firm commitment and that
assessment be accepted as presented.
(e) Parcel 6-3 assessed against Carl Hankey. Recommended denial on protest.
(f) Parcels 2-4 and 2-13 assessed against Mrs. Lillian K. Zaenglein. Recom-
mended assessment stand as presented.
Discussion followed with regard to the assessment charges of the Zaenglein
property (Parcels 2-4 and 2-13). Councilman Forster moved that Mrs. Zaenglein be
not assessed for the "Colony Kitchen line". Motion was seconded by Councilman
Olivares. Attorney Brown stated it would be incorrect to make a motion at this
time. Councilman Forster then withdrew his motion and Councilman Olivares with-
drew his second to the aforesaid motion.
Mayor Durnford excused Assessment Attorney, Engineer of Work and Director
of Public Works to work out alternative ways of assessing the sewer line assessment
charges to be presented later in the meeting. The agenda continued.
ORAL COMMUNICATIONS
Mr. Bruce Winton made a presentation with regard to the access road to the

Capistrano Airport and industrial park and asked the City's helO)in obtaining this
access road. Discussion with property owners, Council, legal counsel and Finance
Director followed. Mayor Durnford stated that it would be to the advantage of
the City for an East-West arterial highway across the mid -Capistrano Valley from
Camino Capistrano to Del Obispo Street to be developed. He then made a motion,
seconded by Councilman Buchheim, that the Planning Commission be directed to
consider plans for an amendment to the Master Plan of Streets and Highways for
inclusion of this secondary arterial highway along Boca de la Playa Ranch line.
The motion carried by a majority vote, Councilman Forster voting "No".
CONTINUATION OF PROTEST HEARING
Mr. Joe Feeney offered three alternate methods for spreading of the assess-
ment on Parcel No. 2-4. Councilman Bathgate, seconded by Mayor Durnford, made a
motion to accept the following method: "Council ordered the Engineer of Work to
change the Assessment Roll so that Assessment Parcel No. 2-4 would only be charged
for 173 feet of sewer line across their property instead of the 1800 feet originally
charged for said line running from the access road to the Southerly corner of
Assessment Parcel No. 2_14. Said order was based on a finding that the assessment
as spread on Parcel No. 2-4 was not spread in proportion to the benefits that
parcel received and that parcels 2-14 and 2-15 actually receive the majority of
the benefit of said line". The motion carried by a majority vote, Councilman
Buchheim voting "No".
Mayor Durnford announced that the Protest Hearing will be contined for two
weeks (Meeting of November 14, 1966).
TREASURY DEMANDS
The accounts payable November 1, 1966 were presented by Director of Finance,
Harold L. Albert. Councilman Bathgate, seconded by Councilman Forster, moved that
Warrant Nos. 2116 through 2170, inclusive, for a total amount of $24,924.27 be
paid. Motion carried unanimously and was so ordered.
ORAL COMMUNICATION
Mr. Tom Davis, E1 Presidente, Fiesta de las Golondrinas Parade, requested
Council waive requirement No. (3) of the Minutes of October 24, 1966, pertaining
to the sale of intoxicating liquors on the premises, and requested they be allowed
to serve alcohol based punch or beer.
Councilman Buchheim left the meeting at 9:04 PM.
Mayor Durnford, seconded by Councilman Bathgate, moved that the request be
granted. The request was denied on a 2 to 2 vote.
ADJOURNMENT
The meeting adjourned at 9:13 PM.
