66-1017_CC_Minutes_Regular Meeting171 Minutes of the Meeting of the City Council of San Juan Capistrano OCTOBER 17, 1966 The regular meeting of the City Council of San Juan Capistrano was called to order at 6:00 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Administrator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. The minutes of the regular meeting of October 3, 1966 were accepted as presented. AGENDA OF OCTOBER 10, 1966 WRITTEN COMMUNICATIONS (a) Notice, Orange County League of Cities - Executive Meeting for October - Informational (b) Special Notice, Orange County League of Cities - Annual League Conference Breakfast - Informational (c) Letter, Orange Coast Junior College District regarding proposal to conduct series of Orange County Regional Planning Conferences - Informational (d) Letter, Orange County Department of Building & Safety regarding Amendment to County Ordinance No. 2110, setting forth electrical fees. Mayor Durnford suggested dissertation from Building Department. ORAL COMMUNICATIONS Mr. Karl Wray, President of the Chamber of Commerce, made presentation regard- ing directional signs and maps to be posted in various locations in City, stating they would pay cost of signs and installation. He then asked Council permission to place three signs within public rights of ways, subject to approval of the Director of Public Works. Councilman Forster, seconded by Councilman Buchheim, moved that permission be granted, subject to review by Director of Public Works and City Engineer. Motion carried unanimously. TREASURER'S REPORT The statement of cash receipts and disbursements for the month ending Sept- ember 30, 1966, was presented by City Treasurer, Alice M. Ross. Councilman Bathgate moved that the financial statement for the month of September be filed for audit. Councilman Buchheim seconded the motion and it carried by a unanimous vote. PLANNING COMMISSION MATTERS A memorandum was submitted from Robert K. Johns, Secretary of the Planning Commission, denoting actions taken at their meeting of October 4, 1966. /o -/>-6 4 UNFINISHED BUSINESS (a) Consideration of sewer trunk system for properties lying Easterly of San Juan Creek. Director of Public Works stated that progress is being made for completion of plans for this district. (b) Proposed Uniform City Food Sanitation Ordinance. City Attorney, John H. Dawson, stated subject still under review and that it would be wise to table for a later meeting. (c) Purchase of City automobiles and erection of storage shed for housing of City vehicles and heavy equipment. (1) City Engineer, Jack Y. Kubota, is making revised floor plans for revised estimate of building. He is to present proposal at next regular meet- ing. He stated building area would require fill approximately even with berm of the flood control channel. Councilman Buchheim, seconded by Councilman Bathgate, moved that suitable fill be placed on the area. Motion carried unanimously. (2) Several members of the Council felt that purchase of city automobiles should be delayed until adequate storage facilities become available. Councilman Forster moved to table this item indefinitely. Councilman Olivares seconded the motion and it carried by a majority vote, Council- man Buchheim and Mayor Durnford voting "No". NEW BUSINESS Letter from Jean Lacouague regarding construction of pedestrian walkway on single lane bridge crossing San Juan Creek (Ganado Drive). City Engineer is to make study and report back to Council regarding vehicular traffic and recommendation for pedestrian walkway, along with cost of a cat -walk. AGENDA OF OCTOBER 17, 1-9,6-6- WRITTEN 966WRITTEN COMMUNICATIONS (a) Letter, Bruce F. Winton and Ervin L. Watkins, requesting the City to con- struct an access road from Camino Capistrano to Capistrano Valley. After considerable disucssion, Councilman Forster moved to deny the request. Motion was seconded by Councilman Olivares and carried by a majority vote, Councilman Buchheim and Mayor Durnford voting "No". (b) Letter from Robert L. Humphreys regarding use of sound equipment for purpose of campaigning. Deferred until next meeting. 7:30 PM - PUBLIC HEARING - Spreading of Assessments, Assessment District No. 64-1 Mayor Durnford opened public hearing, stating that the hour of 7:30 o'clock having arrived, this was the time and place fixed for the hearing of appeals or 179 objections to the confirmation of the assessment in the matter of certain improve- ments in Assessment District No. 614-1 in the City of San Juan Capistrano, California, as described in Resolution of Intention No. 614-12-14-1, adopted by the City Council of said City on the 14th day of December, 1964. The City Clerk reported that the Notice of the filing of the assessment and of the time and place for hearing were duly and regularly published, posted and mailed, all as prescribed by law, and that the following affidavits showing such compliance were on file in his office: (a) Affidavit of Publication (b) Certificate of Mailing (c) Certificate of Posting F. Mackenzie Brown, legal counsel for the Assessment District, explained to Council and the audience the purpose and scope of the hearing. Mayor Durnford asked the City Clerk if he had received any written protests or objections, whereupon Mr. Thompson announced that he had received eight (8) written protests. He then requested the City Clerk to read to the Council the written protests. The Clerk read in full letters of protest received from the following property owners: Girard V. Smith Julia E. Arce Carl H. Hankey Lillian K. Zaenglein (2 letters) Alice M. Ross Carl Romer Richard C. Masson W. J. Barge, Asst. Executive Secretary of the Lutheran Church of Missouri Synod Mayor Durnford then asked if anyone present wished to address the Council in support of a written protest, whereupon legal counsel asked the Assessment Engineer for establishment of the basis for assessment. Council heard persons having filed written protests. ADJOURNMENT As the hour of 9:00 PM arrived, and, in accordance with City Ordinance No. 117 relating to the time and place of holding regular meetings of the City Council, Mayor Durnford adjourned the meeting until 6:00 PM Mon y, October 24, Er st A.
