OCTOBER 3, 1966
The regular 11�ing of the City Council of the City of San Juan Capistrano
was called to order at 6:03 PM by Mayor Don Durnford.
The pledge of allegiance was recited. Invocation was given by Mr. Karl Wray.
The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl
E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford.
The minutes of the regular meeting of September 26, 1966 were approved as
presented.
Mr. Roberts of the staff of the City of Anaheim Legal Counsel was present on
behalf of City Attorney John H. Dawson, who is recuperating from surgery.
WRITTEN COMMUNICATIONS
(a) Letter from Senator Thomas H. Kuchel acknowledging receipt of resolution
adopted by City Council opposing curbside delivery of mail - Informational
(b) Letter, City of Fullerton, inviting Council to attend "The Night in Fullerton",
an event sponsored by the cultural groups of Fullerton - Informational
(c) Notice of Public Hearing on Water Quality Control Policy received from San
Diego Regional Water Quality Control Board - Informational
ORAL COMMUNICATIONS
(a) Mr. Karl Wray, President of the San Juan Capistrano Chamber of Commerce,
asked that matter of directional signs be deferred until the next regular
meeting.
(b) Mr. James Barr, President of Val Verde Corp., stated his company has complied
with all requirements in Minute Order regarding temporary Country Club
trailer, and asked for Council approval of temporary service power pole for
electricity.
Councilman Buchheim, seconded by Councilman Bathgate, moved that permission
be granted for use of temporary service power pole, subject to conditions
of variance in process. The motion carried unanimously.
(c) Mr. Bruce Winton appeared before Council requesting rezoning of recently
annexed Airport and industrial property to M-1.
Councilman Buchheim moved that the matter be submitted to the Planning
Commission to initiate action for a public hearing on rezoning of the
airport property. The motion was seconded by Mayor Durnford and carried
unanimously. So ordered.

(a) Consideration of sewer trunk system for properties lying Easterly of San Juan
Creek - Continued

NEW BUSINESS
I (a) Mayor Durnford offered a resolution accepting Easement Deed LAS -545, Parcel
8 (Alipaz Street), executed by Maude M. Boston, and recordation of same.
The resolution was passed, approved and adopted by unanimous vote.
(b) Mr. Mike Koll appeared before Council on behalf of Kolbet Co., requesting
deferment of installation of sidewalks and approaches on Lots 47 through 60
for the present time. Councilman Buchheim, seconded by Councilman Olivares,
moved that permission be granted for the relief on Lots 47 through 60, sub-
ject to the approval and recommendations of the City Engineer.
(c) Director of Finance, Harold L. Albert, presented bids from several dealers
for the purchase of City automobiles. Councilman Buchheim stated storage
for City vehicles should be resolved before purchase of same, whereupon City
Engineer, Jack Y. Kubota, again reviewed plan of proposed storage area at
the site of the old sewer treatment plant.
Councilman Forster moved to table the item for staff study. Motion was secon-
ded by Mayor Durnford and carried unanimously.
RECOMMENDATIONS AND REPORTS
(a) City Administrator, Ernest A. Thompson
(1) Stated City Engineer had made preliminary plan of drainage for the City
and recommended he consumate finalization of drainage study for Council
adoption. He also recommended that legal counsel draft ordinance
setting forth fee schedule. City Engineer is to pursue subject and
present model ordinance.
(2) Recommended precise alignment of Alipaz Street north of Del Obispo Street
to Oso Road for Master Plan of Streets and Highways. Councilman Bathgate,
seconded by Councilman Buchheim, moved that the City Engineer be author-
ized to design precise alignment of Alipaz in stated area. The motion
carried by a unanimous vote.
(b) Mr. Roberts, Acting City Attorney
Stated he had had opportunity to check with County Counsel regarding
Capistrano Shores Annexatinn. County will be permitted to file Provisional
Filing. Attorney General may give extra time due to Mr. Dawson's incapacitation.
Councilman Forster left the meeting at 7:40 PM
(c) Director of Public Works, T. J. Meadows
(1) Reported that break in ocean outfall pipeline more serious money -wise
than anticipated. Under terms of Joint Powers Agreement with Dana Point
Sanitary District, City is responsible for half the cost of maintenance

and repairs, which will run a total of $10,000 to $12,000. He requested
authorization to proceed with the repair of pipeline. Mayor Durnford
stated the City has no choice.
(2) Road sealing by Dennis Construction Company proceeding throughout City.
Cost may run over projected budget figure. Mayor Durnford made a
motion, seconded by Councilman Buchheim, that the job be completed
regardless of cost, as the sealing was considered preventive maaintenance
and would save money in the long range. The motion carried unanimously
and was so ordered.
(3) UCI beginning classes on Water Quality Control from October 4 to
December 1. Fee of $50.00. Requested Council permission for plant
operator, Ed Vallavanti, and himself to attend.
(d) City Engineer, Jack Y. Kubota
(1) Had discussion with Mr. Kempa and Mr. Moote regarding condition of La
Zanja at E1 Camino Real. They have promised action in getting road
finished.
(2) Reported on Tract 5513 (Val Verde) regarding street lighting and monumen-
tation bonds. He recommended exoneration of monumentation bonds. Council-
man Bathgate, seconded by Councilman Buchheim, moved that the bonds of
monumentation on Tract 5513 be exonerated. Motion carried unanimously
and was so ordered.
(3) Reported on current construction in City: Tract No. 5974 is close to
completion; sewer work being done at Drive_In Theater; Engineers for
Baptist Church project are proceeding with preliminary plans.
(e) Councilman Bathgate
Stated he would like to see further consideration by Council for construction
of a street necessary for development of proposed industrial area surrounding
the airport. After discussion, Council generally felt that such an access
road should also be made available to adjacent property owners, thereby
becoming a public street. This problem should be resolved before purchase of
property through condemnation. No action taken at this time.
(f) Councilman Buchheim
As Camino Capistrano toward the Southern part of the City was being slurry
sealed, suggested that the City Administrator notify Orange County Road
Department Disposal Division to clean up debris on both sides of the street.
(g) Councilman Olivares
Questioned as to why assessment fee is to be paid to Colich Construction
Company.

Sewer line ditch on west side of Camino Capistrano south of Casitas
Capistrano filled with debris. City Engineer to investigate.
