66-0926_CC_Minutes_Regular MeetingMinutes of the Meeting of the City Council of San Juan Capistrano SEPTEMBER 26, 1966 The regular meeting of the City Council of San Juan Capistrano was called to order at 6:05 PM by Mayor Don Durnford. The pledge of allegiance to the flag was recited. The invocation was given by City Administrator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. The minutes of the regular meeting of September 19, 1966 were accepted as presented. WRITTEN COMMUNICATIONS Letter, League of California Cities regarding Notice of Hearings on Operation of Local Agency Formation Commission Law and. District Reorganization Law, to be held in San Diego. Mayor Durnford and Mr. Thompson to attend. TREASURY DEMANDS The accounts payable October 1, 1966 were presented by Director of Finance, Harold L. Albert. Councilman Buchheim, seconded by Councilman Bathgate, moved that Warrant Nos. 2058 through 2115, inclusive, for a total amount of $20,274.90 be paid. Motion carried unanimously and was so ordered. PLANNING COMMISSION MATTERS Memorandum report was submitted by Secretary of the Planning Commission denoting actions taken at their meeting of September 20, 1966. UNFINISHED BUSINESS (a) Consideration of sewer trunk system for properties lying Easterly of San Juan Creek. Dr. Watkins appeared before Council requesting additional time for consideration. Matter to be continued. (b) Proposed Uniform City Food Sanitation Ordinance - Continued (c) Formation of Junior College District. Councilman Bathgate offered a reso- lution endorsing the recommendations presented by Mrs. Marilyn Williams at previous meeting regarding the formation of South Orange County Junior College District. Resolution carried by vote of 3 to 2, Councilmen Forster and Olivares voting "No". NEW BUSINESS __ Land Acquisition Service letter transmitting Easement Deed LAS -545, Parcel No. 5 to the City. Mayor Durnford offered a resolution accepting Easement Deed LAS -545, Parcel No. 5, executed by C. Russell Cook for recordation. The resolution was passed, approved and adopted by unanimous vote. 9 - z t. -bb 171 RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) Stated Certification of "Airport" Annexation had been received from Secretary of State dated September 21, 1966. (2) At 2:4.5 PM this date, Deputy Sheriff personally serviced "Notice of Application for Leave to Sue" to the City. Reply is to be filed within ten days. (3) John Dawson, City Attorney, in hospital for short stay. He is sending a stand-in attorney for next regular meeting. Is to be notified of proposed litigation. (b) Director of Public Works, T. J. Meadows (1) Has been promised two informal bids for road seal -coating by Wednesday, September 28th. (2) Numerous telephone calls coming in regarding spreading of assessment for Assessment District No. 64-1. (c) City Engineer, Jack Y. Kubota (1) Regarding San Diego Freeway: a. Has advised State of sewer force main, making arrangements to relocate line. b. Is in possession of plans for freeway. Any questions regarding design of freeway may be directed to him. C. State has done nothing about drainage problem at Junipero Serra. d. Mayor Durnford offered a resolution endorsing all recommendations the City Engineer has projected to the State Division of Highways in previous communications. The resolution was passed, approved and adopted by a majority vote, Councilman Buchheim abstaining. (2) Re: Baptist Chruch project on Del Obispo. Received letter from engineer asking City to provide preliminary engineering design for ultimate drainage along Del Obispo. Councilman Buchheim stated policy should be established whereby developer should pay for preliminary engineering designs. (d) Councilman Buchheim - Stated he would, like to see a report from Waterworks District No. 4. Councilman Buchheim moved that Mayor Durnford be directed to contact Supervisor Allen regarding this report. Councilman Bathgate seconded the motion and it carried unanimously. (d) Mayor Durnford - Concerned about the condition of La Zanja Street at E1 Camino Real. Nothing has been done for two months. City Engineer stated he had written to Mr. Kempa regarding this condition and suggested waiting for `!- )'L -G 4 7 2 an answer. I£ no answer is forthcoming by next week, bonding company should be contacted to see what can be done to implement this work. ADJOURNMENT The meeting adjourned at 6:45 PM - est � nest A.
