66-0822_CC_Minutes_Regular Meeting15; Minutes of the Meeting of the City Council of San Juan Capistrano AUGUST 22, 1966 The regular meeting of the City Council was called to order at 6:07 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Attorney, John H. Dawson. The Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Mayor Don Durnford. Councilman Forster, seconded by Councilman Buchheim, moved that the minutes of the meeting of August 1$, 1966 be accepted as presented. Motion carried unanimously. WRITTEN COMMUNICATIONS (a) Notice, Orange County League of Cities meeting for August 1966 - Informational (b) Notice, League of California Cities - Subject: National Highway Week, September 18 - 24, 1966 - Notice accepted and filed. (c) Copy of letter, Local Agency Formation Commission to Secretary of State regard- ing proposed annexation to the City of San Juan Capistrano designated as Capistrano Shores Annexation. City Attorney, John H. Dawson, suggested that Ordinance No. 122, approving the annexation of Capistrano Shores, be sent to Secretary of State in the usual routine manner. He stated that he intends to dismiss the Writ of Mandate previously presented, but urged that all City officials attend LAFCO hearing to object to the inclusion of Capistrano Shores annexation in proposed incorporation of Capistrano Beach/Dana Point. (d) Letter from E. L. Christiansen regarding Land Use Element Map (Darmi Tract). The matter to be continued for Council review. (e) Letter, Christiansen & Assoc., with attachments, regarding preliminary inquiry concerning Federal assistance for water projects, sewer projects and waste treatment plants. At this time the City Engineer reported on the meeting held with Dr. Watkins and property owners regarding possible assessment district. He suggested that Council refer matter to the Director of Public Works and Engineering -Science for a report in conjunction with this type of funding. (f) City Attorney read letters received from Senator Kuchel and Congressman Utt acknowledging receipt of Resolution adopted June 27th prohibiting the erection of certain structures within public rights of way, Congressman Utt commending Council for its action. PUBLIC HEARING i-' , . / Mayor Durnford opened public hearing on Amendment No. 2 to the Streets and High- ways Master Plan. No one appeared to oppose the proposed amendment. Public hearing 8--,�-z 40 to X56 closed. Councilman Buchheim offered a resolution adopting Amendment No. 2 to the Streets and Highways Master Plan. Resolution passed, approved and adopted by unanimous vote. PLANNING COMMISSION MATTERS A memorandum was presented by the Secretary of the Planning Commission regard- ing action taken by the Commission at its meeting August 16, 1966. Report received and filed. UNFINISHED BUSINESS City Attorney reported on proposed Uniform City Food Sanitation Ordinance pro- posed by Orange County Health Department. He stated his criticism in that additional charges would be made for administrative functions of permits. He is to clarify with the Health Department and suggested not adopting ordinance at this time. Mayor Durnford moved that the matter be postponed for a future meeting. Council- man Buchheim seconded the motion and it carried unanimously. RECOMMENDATIONS AND REPORTS (a) City Engineer, Jack Y. Kubota (1) Received letter from First Baptist Church August 19th. Recommended that Council take no action at this time as final design plans have not been submitted. (2) Re Sewerage study - report of informal meeting of August 17, 1966, was made under Written Communications. After further discussion of the matter, Councilman Buchheim, seconded by Councilman Bathgate, moved that an expenditure not to exceed $200.00 be allocated and that Engineering - Science, Inc. be authorized to make a more detailed engineering plan for sewering the area. (b) Councilman Bathgate Stated next regular meeting date in conflict with Dana Point Harbor program. (c) Mayor Durnford Asked that Mayor Pro Tem Olivares preside over next regular Council meeting as he will be out of the City. As Mr. Thompson, City Clerk -Administrator, was on vacation, Mayor Durnford entertained a motion that Mrs. Lee Vallavanti be designated as Deputy City Clerk. Councilman Bathgate so moved. The motion was seconded by Councilman Buchheim and carried unanimously. So ordered.
