66-0725_CC_Minutes_Regular MeetingMinutes of the Meeting of the City Council of San Juan Capistrano JULY 25, 1966 The regular meeting of the City Council was called to order at 6:03 PM by Mayor Don Durnford. The pledge of allegiance to the flag was recited. Invocation was given by City Attorney John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. Councilman Forster, seconded by Councilman Buchheim, moved that the Minutes of the meeting of July 18, 1966, be approved as presented. Motion carried unanimously, WRITTEN COMMUNICATIONS (a) Notice of Orange County League of Cities General Meeting for July 1966 - Info (b) Invitation from Mr. George W. Leddicoatt and staff to attend First Anniver- sary Celebration of Job Corp Conservation Center - Informational (c) Letter confirming receipt of City Resolution No. 66-.7-11-7 from State Division of Highways, District VII - Informational (d) Resolution, Board of Supervisors, requesting California Highway Commission to permit a connection of the Route 5 Freeway at Camino Las Ramblas - Info TREASURY DEMANDS The list of accounts payable August 1, 1966 was presented by Director of Finance, Harold L. Albert. Councilman Bathgate, seconded by Councilman Buchheim, moved that Warrant Nos. 1952 through 2003, inclusive, be issued in the total amount of $19,434.95. Motion carried unanimously. PUBLIC HEARINGS Mayor Durnford declared public hearing opened on proposed "Airport" Annexation. No one appeared to speak against the proposed annexation. Public hearing closed. Councilman Bathgate offered a resolution declaring that there were "No - Majority Protests" to this proposed annexation. Resolution passed, approved and adopted by unanimous vote. Mayor Durnford, seconded by Councilman Bathgate, made a motion that proposed ordinance accepting "Airport" Annexation be read by title only. Motion carried unanimously. City Attorney rendered first reading of ordinance accepting "Airport" Annexation by title only. Councilman Bathgate moved that Mr. Dawson be granted authority by Council to represent all interested parties in all phases of said annexation. Motion seconded by Councilman Buchheim and carried unanimously. PLANNING COMMISSION MATTERS Council was presented with reports from Planning Commission on following items: 14� (1) Amendment No. 2 to Master Plan of Streets and Highways. Public Hearing set for August 2, 1966. (2) DL 66-105 (Schauer). Proposed Division of Land in Meisner Tract approved subject to conditions. (3) LUV 65_104 (Croddy). Relocation of an approved sign. UNFINISHED BUSINESS (a) Councilman Buchheim, seconded by Councilman Bathgate, moved that proposed ordinance enacting Amendment No. 2 to Land Use and Zoning Ordinance No. 115 (Re: Country Land Corp.) be read by title only. Motion carried unanimously, and City Attorney gave first reading of proposed ordinance by title only. (b) Councilman Buchheim, seconded by Councilman Bathgate, made a motion that second reading of proposed ordinance approving "Capistrano Shores" Annexation, be read by title only. City Attorney rendered said reading by title only. Councilman Bathgate offered Ordinance No. 122 relative to acceptance of "Capistrano Shores" Annexation for adoption. Ordinance was passed, approved and adopted by unanimous vote. (c) City Attorney gave second reading, in full, of proposed ordinance pertaining to prohibiting parking of vehicles for purpose of sales. Councilman Bathgate offered Ordinance No. 123 for adoption. Ordinance was passed, approved and adopted by unanimous vote. NEW BUSINESS (a) Council received copies of letters from Casitas Capistrano Company for dedi- cation of sanitary sewers in Tract Nos. 5624, 5946, 5947 and 6121. City Engineer, Jack Y. Kubota, recommended that bonds be exonerated for Tracts 5624 and 5946 only as work on other two tracts has not been completed. Councilman Buchheim, seconded by Councilman Bathgate, moved that the City accept dedications on Tracts 5624 and 5946 as recommended by City Engineer. Motion carried unanimously and was so ordered. Councilman Buchheim moved that Council comply with recommendations of City Engineer and that exoneration of bonds for Tracts 5947 and 6121 be held in abeyance until recommended for release by City Engineer. Motion seconded by Mayor Durnford and carried unanimously. Councilman Bathgate moved that sewer bonds on Tracts 5624 and 5946 be exoner- ated. Councilman Buchheim seconded motion and it carried unanimously. So ordered. -1116 (b) Contract Agreement, County of Orange, for services of Superintendent of Water District (T. J. Meadows). Councilman Buchheim, seconded by Council- man Forster, moved that the Mayor and. City Clerk be authorized to sign the proposed contract on behalf of the City of San Juan Capistrano. Motion carried unanimously. (c) On the recommendation of Director of Public Works, T. J. Meadows, the following sewer connection fees were discussed and acted upon: (1) Spaulding Equipment Company - Connection charge of $150,00- (2) San JuanAnimal Hospital (2,520 sq. ft.) - Connection charge set at $300.00, with agreement stipulation. (3) Mission Drive -In Theater (4,613 sq. ft.) - Connection fee of $600.00. Councilman Bathgate, seconded by Councilman Buchheim, moved that the recom- mendations of Director of Public Works be upheld. Motion carried unanim- ously and was so ordered. (d) City Administrator suggested Council set tax rate for City for fiscal year 1966-67. Councilman Forster, seconded by Councilman Olivares, moved to set a tax rate of 90¢ per $100.00 valuation. Motion carried by a majority vote, Councilman Buchheim voting "No". (e) City Administrator stated recommendation of financial advisor, setting sewer tax rate for redemption for General Obligation Bonds, is rate of 35¢ per $100.00. Councilman Bathgate, seconded by Mayor Durnford, moved that 35¢ per $100.00 valuation be set as sewer tax rate for fiscal year 1966-67. Motion carried unanimously and was so ordered. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson (1) Asked Council for Budget recommendation. Mayor Durnford, seconded by Councilman Forster, moved that the budget as presented be approved. Motion carried unanimously. (2) Stated Supervisor Phillips had extended invitation to City Council for presentation of Engineering-Science/Lowry & Associates Sanitation Survey Report to be presented to Orange County Board of Supervisors. (b) City Attorney, John H. Dawson Will contact Attorney Clarence Hunt, attorney for Capron property, to arrange conference to work out agreement establishing delineation of access road on Capron property and discussion of easements being ,released. (4) Having some difficulty with CAN franchise people. Hope they will reach understanding as to manner they will operate in City. (d) Director of Public Works, T. J. Meadows Reported on Weed Abatement Program, stating it was almost completed. (e) Councilman Buchheim City Administrator should get in touch with A. S. Koch regarding trash along Camino Capistrano. Closer survelliance by Sheriff's Department might improve situation. ADJOURNMENT The meeting adjourned at 8:05 PM to an Executive Session. Ernest A.
