66-0627_CC_Minutes_Regular Meeting131 Minutes of the Meeting of the City Council of San Juan Capistrano JUNE 27, 1966 The regular meeting of the City Council was called to order at 7:30 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Attorney, John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. The minutes of the regular meeting of June 13, 1966 and the adjourned regular meeting of June 20, 1966, were accepted as corrected. ORAL COMMUNICATIONS (a) Mr. James Barr, President, Val Verde Corp., asked status of sewer system bond, street improvement bond, street lighting bond and monumentation bond. During the course of discussion it was pointed out that the sewer and street improve- ment bonds had been exonerated, with street lighting and monumentation bonds being outstanding. At this time Councilman Buchheim, seconded by Councilman Bathgate, moved to release the monumentation bond, subject to the approval of the City Engineer. Motion carried unanimously. Street lighting bond to remain in full force and effect. (b) Mr. Joe Feeney of Engineering -Science, Inc., discussed proposed Assessment District No. 66_1 and Assessment District No. 64-1, stating spreading of assessment is about to take place. He then gave approximate figures. He also read a letter from Colich Construction Co. regarding final payment and extras contemplated on the job. (c) Mr. Bruce Winton appeared asking Council permission for precise alignment of proposed airport access road, stating County would consent to start condem- nation proceedings, with the blessings of the City. Mayor Durnford, seconded by Councilman Bathgate, moved that the City Engineer proceed with the align- ment of the proposed access road and authorize the County to process the condemnation. The motion carried by a majority vote, Councilman Forster abstaining. COMMITTEE REPORTS (a) City Engineer to present downtown parking report at next regular meeting. (b) Councilman Buchheim brought up the question of proposed curbside delivery of mail in the City and inquired of the City Attorney if it would be possible to prohibit placing of mailboxes six inches back from the curbs. After discussion of the matter, Mayor Durnford made a motion that an urgency ordinance be ini- tiated prohibiting curbside mailboxes. Matter deferred to later in the meeting. L-27-66 TREASURY DEMANDS The list of demands for the month ending June 30, 1966 was presented by Director of Finance, Harold L. Albert. Councilman Forster moved that Warrant Nos. 1888 through 1951, inclusive, in the total amount of $30,200.33, be issued. Council- man Buchheim seconded the motion and it carried unanimously. PLANNING COMMISSION MATTERS (a) The Secretary of the Planning Commission stated Commission approval of RZ 66-102 (Country Land Co.). Council set public hearing for July 18, 1966 at (1) the hour of 6:30 PM. Approved (b) The Secretary of the Planning Commission reported on the following: (1) DL 66-104 (Russell). Approved subject to conditions. (2) DL 66-101 (Dozier). Amendment granted to permit building setback exception. (3) Tract 5624 (PD Site Plans). Amendment granted to permit patios in rear of each unit. (4) LUV 64-117 (Palmer). Variance terminated and sign granted by variance processed under Ordinance No. 115. UNFINISHED BUSINESS (a) Mayor Durnford, seconded by Councilman Buchheim, moved that second reading of proposed Ordinance No. 118 be read by title only. Motion carried unanim- ously. City Attorney rendered second reading of ordinance entitled "An Ordinance of the City Council of the City of San Juan Capistrano approving the annexation to the City of San Juan Capistrano of the territory known as 'Doss - Watkins' Annexation." Councilman Bathgate offered Ordinance No. 118 for adoption. The ordinance was passed, approved and adopted by unanimous vote. (b) Councilman Buchheim, duly seconded, moved that second reading of proposed Ordinance No. 119 be read by title only. Motion carried unanimously. City Attorney rendered second reading of ordinance entitled "An Ordinance of the City Council of the City of San Juan Capistrano amending the 'Precise Zoning Map' as adopted by Ordinance No. 115, Section 3.01.3, to be designated 'Amendment No. 11." Councilman Buchheim offered Ordinance No. 119 for adoption. The ordinance was passed, approvedand adopted by unanimous vote. (c) Councilman Bathgate moved that second reading of proposed Ordinance No. 120 be read by title only. Councilman Forster seconded motion and it carried unanimously. City Attorney rendered second reading of ordinance entitled "An Ordinance of the City of San Juan Capistrano, California, granting to 6 -z7 -6G 3� McRae Company, its successor and assigns, a non-exclusive franchise to con- struct, install, maintain and operate a system of poles, wires, conduits and appurtenances for a community antenna television and FM transmission system in, along or across, over or under the public streets, highways, alleys, public properties, or public easements within said City of San Juan Capistrano". Mayor Durnford offered Ordinance No. 120 for adoption. The ordinance was passed, approved and adopted by a 4 to 1 vote, Councilman Buchheim voting "No". (d) City Attorney gave first reading of proposed ordinance relating to the park- ing of vehicles for purpose of sales. Councilman Forster, seconded by Council- man Bathgate, moved to table item for further study. Motion carried unanimously. (e) City Attorney prepared Easement Grant Deed to be presented to Birtcher-Pacific for execution. (f) Orange County Building & Safety Contract Agreement. Councilman Buchheim moved that the City accept the format, with the exception that modification time limit be changed from six months to 30 days, and authorizing the Mayor and City Clerk to execute the Agreement. Councilman Bathgate seconded the motion and it carried unanimously. (g) Contract Services Agreement Renewal with County of Orange. Councilman Buchheim moved that the Mayor and City Clerk be authorized to execute the Agreement. Councilman Forster seconded the motion and it carried unanimously. (h) Proposed Ordinance - Industrial Waste Disposal. Councilman Buchheim moved that this item be tabled. Motion seconded by Councilman Bathgate and carried unanimously. (i) Health and Medical Plan. Councilman Buchheim moved that approval and author- ization as requested be granted, with the right of inclusion of Council members in the plan. Motion seconded by Councilman Bathgate. The motion carried by a 3 to 2 vote, Councilmen Forster and Olivares voting "No". NEW BUSINESS (a) Proposed Annexation to City of San Clemente. Councilman Buchheim, seconded by Mayor Durnford, moved that the proposal be tabled indefinitely. Motion carried unanimously. (b) Request for extension of time on proposed TV service franchise (Darmi, Inc.). Councilman Buchheim moved that the request for extension of time be granted subject to no occupancy. If occupancy exists prior to twelve months from this date, service is to be made available. Motion seconded by Councilman Bathgate and carried unanimously. So ordered. (c) At this time, City Attorney read corrected draft of Ordinance No. 121. 134 Councilman Buchheim offered Ordinance No. 121, entitled "An Ordinance prohibiting the erection of certain structures within the public rights of way within the City of San Juan Capistrano; and declaring the urgency thereof". Ordinance No. 121 was adopted by a unanimous vote. RECOMMENDATIONS AND REPORTS (a) (b) (c) (d) (e) City Administrator - Ernest A. Thompson Received tentative bid for painting inside City Hall in the amount of $375, which would include interior ceiling, walls and partitions. Mayor Durnford moved that the City Administrator be authorized to direct City Hall be painted at a sum no more than $375• Councilman Buchheim seconded the motion and it carried by a majority vote, Councilmen Forster and Olivares voting "Non Director of Public Works - T. J. Meadows Presented tentative construction costs and tentative assessment spread. City Engineer - Jack Y. Kubota (1) Attended meeting re Alipaz Street project this date and conveyed request of City for extentions of time for project. Committee gave favorable action for request for 180 to 270 days. Suggested proceeding with right of way and that City should sponsor a general meeting for property owners concerned. Mayor Durnford moved that the recommendation of the City Engineer be upheld. Motion seconded by Councilman Bathgate and carried unanimously. (2) Plans have been approved for Birtcher-Pacific right of way on Forster. Looks like Bank of America is on its way. (3) Received word from County Road Department. Thirty inch transmission line is completed and they want release from the City. (4) SDG&E work completed on Camino Capistrano. Company should be commended for job well done. Councilman Bathgate Amber flood lights in Casas Capistrano distracting to drivers on Camino Capistrano. City Administrator to so notify.
