66-0509_CC_Minutes_Regular Meeting14: Minutes of the Meeting of the City Council of San Juan Capistrano MAY 9, 1966 The regular meeting of the City Council was called to order at 7:35 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was goven by City Administrator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Marco F. (Tom) Forster, Antonio M. (Tony) Olivares and Don Durnford. The minutes of the regular meeting of April 25, 1966 and the adjourned regular meeting of May 2, 1966 were accepted as corrected. WRITTEN COMMUNICATIONS (a) Notice of meeting, Orange County League of Cities. Mayor Durnford and Council- man Olivares to attend. (b) Letter, Orange County League of Cities, urging officers to attend meetings - informational (c) Letter, State Division of Highways Re: Legal interpretation by State Division of Contracts and Rights of Way concerning Section 74.5 of Streets and Highways Code - Informational (d) Letter, Orange County Flood Control District, Re: Engineer's Report for issuance of additional district bonds. Councilman Bathgate moved that the item be tabled. Councilman Buchheim seconded the motion and it carried by a unanimous vote. ORAL COMMUNICATIONS (a) Mr. Clarence Brown appeared to ask reconsideration of sewer connection fee of $2,000 for Colony Kitchen and Standard Station. Fee was paid under protest. After considerable discussion, Mayor Durnford, seconded by Councilman Buchheim, moved that the property be charged $1,025 and setting the policy of $400 for service stations and $125 per 1500 square feet, of portion thereof, for commer- cial buildings. Motion carried by a majority vote, with one abstention. (b) Proposed Assessment District No. 66-1. In the absence of Mr. Feeney of Engineer- ing -Science, Director of Public Works, T. J. Meadows, stated they are making additional studies and hope to have a preliminary plan to present at the next regular meeting. COMMITTEE REPORTS Committee reported on the on-site inspection of the Greenlee property had been made and work is completed to the satisfaction of the committee. They are now await- ing spreading of the assessment. f 9 -GG 5 TREASURER'S REPORT The Treasurer's Report fot the month ending April 30, 1966 was submitted by Director of Finance, Harold L. Albert. Councilman Bathgate, seconded by Councilman Buchheim, moved that the Treasurer's Report be filed for audit. Motion carried unanimously. So ordered. PUBLIC HEARING Colich Construction Company Change Order #3 in the total amount of $3,680.29. Mayor Durnford opened the public hearing. No one appeared to speak against the Change Order, and City Administrator stated letter of consent had been received. Public Hearing closed. Councilman Buchheim offered a resolution authorizing the Change Order in the amount of $3,680.29. The resolution was passed, approved and adopted by a unanimous vote. PLANNING COMMISSION MATTERS (a) The Secretary of the Planning Commission reported on the following: (1) One year extension granted for Tentative Tract Maps 5622 & 5975 (Kolbet). (2) Plans for proposed signle_family residence in C2A zone approved (Van Schnabel) (3) Division of Land 66-103 (Stroschein) placed on Planning Commission agenda for May 17, 1966. (b) The Secretary of the Planning Commission read memorandum and presented plans for front and rear yard setbacks in E-2 District (LUV 66-107, Palmer) and stating Commission approval subject to conditions. Councilman Buchheim, seconded by Mayor Durnford, moved that the recommendation of the Planning Commission be upheld. Motion carried unanimously. (c) The Secretary of the Planning Commission read a memorandum recommending approva=_ of Amendment to LUV 65-104 (Croddy), subject to conditions. Councilman Bathgate: moved that the recommendation of the Planning Commission be upheld. Motion was seconded by Councilman Buchheim and carried unanimously. TEN MINUTE RECESS............ UNFINISHED BUSINESS (a) (b) City Attorney presented draft of Amendment to Ordinance No. 53. Councilman Buchheim moved that proposed ordinance be read by title only. Motion was seconded by Mayor Durnford and carried unanimously. City Attorney read pro- posed Ordinance No. 116 by title only. This constituted the first reading. The City Clerk read a letter from Val Verde Corp. regarding Division of Land contemplated on corner of La Novia and San Juan Creek Road. Mr. Barr appeared before Council asking relief on street improvements. After considerable dis- cussion, Councilman Buchheim, seconded by Councilman Forster, made a motion of 116 intention subject to values as set forth by the City Engineer and stipulations of guarantees by the City Attorney. Motion carried unanimously. (c) LUV 64-112 (Sign, Val Verde Corp.) After presentation by Mr. Barr, Councilman Bathgate, seconded by Councilman Forster, moved that the revision of LUV 64-112 basic plan in general, be accepted subject to specifics of the City Engineer and Planner -Tech as to details, with time limit of 60 days to complete land- scaping. Basic plans to be identified as Exhibit "A". Motion carried unanimously. (d) Request for exoneration of street bonds, Tracts 5513, 5514 and 5515, Val Verde Cbrp. Val Verde to make necessary corrections and present request for exoner- — ation of said bonds at the next regular meeting. (e) Upon motion of Mayor Durnford, seconded by Councilman Bathgate and carried by a unanimous vote, City Attorney read Ordinance No. 115 by title only. Council- man Bathgate offered Ordinance No. 115 for adoption. Ordinance No. 115 was adopted by unanimous vote. NEW BUSINESS Residents of San Juan Park protesting escalation of sewer connection fees. Six property owners voiced their opinions on escalation of fees. Due to the late hour, Councilman Buchheim moved that the meeting be adjourned until 7:30 PM Tuesday May 10, 1966. Motion carried unanimously.
