66-0314_CC_Minutes_Regular Meeting91 Minutes of the Meeting of the City Council of the City of San Juan Capistrano MARCH 14, 1966 The regular meeting of the City Council was called to order at 7:30 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Attorney, John H. Dawson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. Absent: Councilman Carl E. Buchheim. The minutes of the regular meeting of February 28, 1966, were approved as submitted. WRITTEN COMMUNICATIONS (a) Resolution, Huntington Beach Chamber of Commerce, urging study for a nuclear desalinization plant offshore from their City - Informational (b) Letter, City of Los Angeles Planning Committee, regarding need for cooperation on problems common to urban areas - Informational ORAL COMMUNICATIONS (a) Mr. Sant, representing Country Land Company, requested remporary closing of Camino Del Avion to complete street improvements. Mr. Kinoshito, who was in the audience, stated the residents in the immediate area would have no object- ions to the road being closed for a short period. Councilman Bathgate then made a motion that permission be granted for closing of Camino Del Avion for a period of five working days, Monday through Friday, provided there was adequate barricading. The motion was seconded by Council- man Olivares and carried unanimously. So ordered. (b) Mr. Ed Sampson of Engineering -Science, Inc., reported on the high cost of electricity furnished to the water quality control facility, and stated they have taken steps to reduce these costs. COMMITTEE REPORTS Mayor Durnford reported on the meeting held with Mr. McLellan, Orange County Building Department, Mr. Scullin of the Grading Department, Mr. Twichell of Dike & Colgrove, and Mr. Clark, a resident of the tract, regarding slope plantings in Tracts 5399 and 5675. Commitments having been fulfilled, he recommended that the grading bonds be exonerated. Councilman Chermak, duly seconded by Councilman Bathgate, moved that the bonds in question be exonerated. Motion carried unanimously. So ordered. 3-i•,/-6 4 TREASURER'S REPORT The Treasurer's Report for the month ending February 28, 1966, was presented by Director of Finance, Harold L. Albert. Councilman Bathgate moved that the Treasurer's Report, as presented, be filed for audit. Motion was seconded by Councilman Chermak and carried unanimously. So ordered. PUBLIC HEARING Mayor Durnford opened Public Hearing on Resolution No. 66_2_28_1, declaring intention to modify proceedings in Assessment District No. 64-1. There being no protests, written or oral, he declared Public Hearing closed. Councilman Chermak _ then offered Resolution No. 66-3_14-1, being a resolution or Bering changes and modifications for Assessment District No. 64-1, for adoption. The resolution was passed, approved and adopted by a four-fifths vote. PLANNING COMMISSION MATTERS (a) The Secretary of the Planning Commission reported on DL 66-102 (Glendale Federal), proposing to divide two parcels of land into three parcels, stating Commission approval subject to conditions. He then read letter from Glendale Federal, same subject, requesting relief on the immediate improvement on San Juan Creek Road, Parcel No. 1. Discussion followed. Mayor Durnford moved that the appeal be received and tabled. Councilman Chermak seconded motion, and it carried unanimously. So ordered. (b) The Secretary of the Planning Commission reported on LW 66-103 (Halcomb), to permit a carport and front yard set -back variance, and stating public hearing set for March 15, 1966. (c) The Secretary of the Planning Commission reported on Tentative Tract No. 6169, proposing a 50 lot subdivision in E2 "Medium Estate" District. (d) Planning Commission recommends approval, subject to conditions, of temporary 6' X 9' off-site directional sign (LUv 66-104 - Kolbet). Councilman Chermak, duly seconded by Councilman Bathgate, moved that the recommendation of the, Planning Commission be upheld. Motion carried unanimously. (e) RZ 66_101 (Capistrano Land Investment Co.) Prezoning some 75.21 acres of land. Planning Commission recommends approval and further consideration of Del Obispo Right -of -Way. Mayor Durnford set public hearing for March 28, 1966. (f) Planning Commission requests citations be issued to violators of City Ordinances. Councilman Bathgate moved to uphold the recommendation of the Planning Com- mission in the enforcement of City Ordinances, with citations to be issued to violators of Land Use Ordinances and Divisions of Land. Councilman Chermak seconded motion and it carried unanimously. TEN MINUTE RECESS .... ........... 3-iy-64 MR, UNFINISHED BUSINESS (a) Redraft of Orange County Health Department resolution. Deferred until next regular meeting. (b) City Attorney rendered first reading of proposed ordinance regulating loud speaker systems in City. (c) Proposal to contract for janitorial services, Ful -Care Maintenance, in the amount of $100.00 per month. Mayor Durnford moved that proposal be received and denied. Motion duly seconded by Councilman Chermak and carried unanimously. NEW BUSINESS (a) Proposal to contract for janitorial services presented by John's Cleaning Service in the amount of $45.00 per month. Councilman Chermak moved that a contract be prepared for John's Cleaning Service to maintain City Hall for a period of one year, effective April 1, 1966. The motion was seconded by Councilman Olivares and carried unanimously. So ordered. (b) Letter of request from Christiansen & Associates, establishing a more emphatic demand for inclusion of the appropriate entry to the San Diego Freeway, Route 5, and Camino Las Ramblas (Darmi Development). City Administrator recommended that a study of maps be made and a firm stand taken at a later meeting. Mayor Durnford concurred. (c) The City Engineer made a presentation of preliminary design plans for improve- ment of Alipaz Street (Arterial Highway Financing Program, Project #307). This presentation tied in with the next agenda item in regard to proposed agreement to pay reasonable charges for the relocation of a packing shed on the Kinoshito property. Mayor Durnford stated that the City should proceed with negotiations and con- sideration for the moving of the packing shed as soon as possible. Councilman Chermak moved that the staff contact the Kinoshito enterprises and apprise them of the Council's feelings with regard to the relocation of the packing shed. Motion was seconded by Councilman Bathgate and carried unanimously. So ordered. (d) Submittal of informal petition for proposed 1911 Act Improvement District for sewers. The City Attorney stated informal petition is sufficient to initiate 46 proceedings for proposed Assessment District No. -65-1. 6� Mayor Durnford offered a resolution to form Assessment District No. 45-1 and designating Engineering -Science, Inc. as the Engineer of Work. The resolution was passed, approved and adopted by a unanimous vote. w 1(e) Acceptance of Easement Deed, Pacific Telephone, in connection with LUV 65_122. Councilman Chermak offered a resolution that the document be accepted and recorded. The resolution was passed, approved and adopted by unanimous vote. 4 (f) Proposal for erection of steel building for vehicle storage. Councilman Chermak made a motion that a feasibility study be made on that certain piece of property and a survey of testing for a topographic layout and plotting, with the appro- priate authorization for the expenditure. Mayor Durnford duly seconded the motion and it carried unanimously. So ordered. ./ (g) Record Tract Map 6121.(Casitas Capistrano). Councilman Bathgate offered a resolution of acceptance for recordation of Tract 6121, subject to the payment of sewer connection fees. The resolution was passed, approved and adopted by a unanimous vote. RECOMMENDATIONS AND REPORTS (a) City Administrator, Ernest A. Thompson Agreement between the City and Dana Point Sanitary District. Councilman Chermak moved that Dana Point Sanitary District be billed for 10% retention fee and be notified at the time it is determined what Federal Grant the City receives, we will then refund them accordingly. Councilman Bathgate seconded, and motion carried unanimously. (b) City Attorney, John H. Dawson Stated Ordinance No. 110 should be amended to include the phrase "underground utility lines that do not necessarily service a tract should be put underground as well to eliminate distribution lines", thereby being in a position to negotiate with utility companies. Councilman Bathgate moved that the City Attorney give first reading of amended Ordinance No. 110 by title only. The motion was seconded by Mayor Durnford and carried unanimously. (c) Director of Public Works, T. J. Meadows (1) Colich Construction should finish laying pipe this week. (2) Problems of street patching. (3) Colich Construction presented Agreement giving partial acceptance of sewers. Mr. Meadows asked to be given authorization to sign the Agree- ment. Councilman Bathgate, duly seconded by Councilman Chermak, moved that he be authorized to sign Agreement. Motion carried unanimously. (4) Recommended connection charges for Colony Kitchen -Standard Oil, combined, be $2,000, and connection charges for Union Oil in the amount of $400.00. Councilman Chermak moved that the recommendation be upheld. Councilman Bathgate seconded, and motion carried unanimously. (d) City Engineer, Jack Y. Kubota (1) State Traffic Engineers looking to identify San Juan Capistrano with sign at Ortega off -ramp. Will have complete modernization of signing. 3 -/+/ —64 NO, Improvement on landmark sign also. (2) Tract 5733 (Kolbet) looking for partial relief of their outstanding street improvement bond. Recommended not more than $40,600. Mayor Durnford moved that the bond be partially released in the amount of $40,600. Councilman Chermak seconded and motion carried unanimously. (e) Councilman Chermak (1) San Juan Park directional sign inappropriate. Should inform the public this is not public park, but a residential district. (2) Sheriff in patrol car not paying attention to Sunday traffic at busy intersection. (f) Mayor Durnford Received latest copy of Bartle -Wells Report. Instructed City Administrator to send copy to each of the Supervisors and copy to Mr. Kymla and Chief Engineer of Flood Control„ Mr. Osborne.
