66-0203_CC_Minutes_Special MeetingMinutes of the Special Meeting of the City Council of San Juan Capistrano FEBRUARY 3, 1966 The Speical Meeting was called to order at 6:05 PM by Mayor Don Durnford. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. The subject to be discussed was the consideration of an addendum Change Order with regard to Assessment District No. 64-1. Mr. Clarence Magnusen, of Engineering - Science, Inc., was present and reported the adversity confronting Colich Construction Company with regard to appropriate trenching and pipe laying due to excessive ground water. In connection with the ground water, it was recommended to be justified, an additional financial obligation to be met in order to allow additional bedding rock to be placed to a maximum width of 48 inches in lieu of the specified 33 inches, as set forth in the contract. This bedding rock would afford additional stability to the trench section and the restriction of seepage of apparent ground waters in order to provide an additional restriction of seepage of apparent ground waters in order to provide an additional quality of workmanship in constructing the sewer line facilities in the area of San Juan Creek, preliminary estimates ranging in the first instance of a cost of between $2,000 and $3,000. However, it was noted by the Director of Public Works, T. J. Meadows, that a more positive estimate would be between $4,000 and $5,000, based upon observation of increased excessive ground waters on those locations adjacent to the San Juan Creek. Considerable discussion was entered into. The various Councilmen took an attitude that to safeguard the taxpayers within the assessment district, there should be a definite maximum amount set in order to provide for this additional improvement. Therefore, Councilman Buchheim moved that the contractor be authorized a sum of money not to exceed $3,500 to allow for this additional work, and that should the construct- ion demand more than this at a later date, further request would have to be submitted to the City Council. The motion was seconded by Councilman Olivares and approved and passed by a unanimous vote. The meeting adjourned at 6:37 PM. Ernes A.
