65-1215_CC_Minutes_Special MeetingMinutes of the Special Meeting of the City Council of San Juan Capistrano DECEMBER 15, 1965 The Special Meeting of the City Council was called to order at 7:30 PM by Mayor Don Durnford. The pledge of allegiance was recited. The invocation was given by City Clerk, Ernest A. Thompson. The City Clerk called the roll. Councilmen present: William A. Bathgate, Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. The first item on the agenda was the matter of conditional occupancy of the Wax Museum structure prior to December 18, 1965 at 12:00 Noon. The City Administrator read a report from the Engineering and Staff Committee composed of Mr. Cornell and Mr. De Vore, representatives of the Orange County Build- ing and Safety Department; City Engineer, Jack Y. Kubota; Director of Public Works, T. J. Meadows; and City Administrator, Ernest A. Thompson. Mayor Durnford had asked for the report for something to go on due to the confusion of the aspect of temporary occupancy. City Attorney John Dawson stated that if Council wished to issue a permit for temporary occupancy, it should be issued contingent to conditions. Mr. Art Batty, President of the Josephine Tussaud, Inc. waxworks, stated that his company is the franchise agent for wax museums all over the country and that they are responsible for scheduling all figures and getting museums into operation. On behalf of Mr. Drucker, President of the Mission Wax Museum, he cited numerous reasons why the business should be in operation before the Holiday Season and stated it was the intention of all concerned to complete the building site and fulfill all obligations to the fullest. He therefore offered a Certified Check in the amount of $10,000 to guarantee the completion, subject to granting of Temporary Use and Occupancy Permit as of Friday, December 18, 1965. FIFTEEN MUNUTE RECESS .................. After lengthy deliberation, Councilman Bathgate stated that since there were no basic changes in the request since the meeting of Monday, December 13, 1965, and even worse, that Arguello Way could not be paved by Friday, he therefore made a motion that the request be denied. The motion was seconded by Councilman Olivares and passed by a vote of 4 to 1 (Mayor Durnford voting "No"). Three additional items on the agenda contingent to the first item, were automatically eliminated. The meeting adjourned at 8:4.0 PM. ldiN uāœ“āœ“ est A.
