65-0809_CC_Minutes_Regular Meeting19 Minutes of the Meeting of the City Council of San Juan Capistrano AUGUST 9, 1965 The regular meeting of the City Council was called to order at 7:34 P.M. by Mayor Durnford. The pledge of allegiance was recited. The invocation was given by City Administrator, Ernest A. Thompson. The City Clerk called the roll. Councilmen present were: Carl E. Buchheim, Edward S. Chermak, Antonio M. (Tony) Olivares and Don Durnford. Councilmen absent: ^ William A. Bathgate. The minutes of the regular meeting dated July 26, 1965, were approved as submitted. WRITTEN COMMUNICATIONS Notice _ Orange County League of Cities - Executive Meeting for August - Informational. COMMITTEE REPORTS (a) Re - Joint Powers Committee - Sewer facilities - San Juan Capistrano and Dana Point Sanitary Districts. Director of Public Works, T. J. Meadows, stated that the matter would possibly be scheduled for the next meeting of the Dana Point Sanitary District. (b) Orange Coast Sightseeing Corp. Re: Off-street Parking. City Attorney John H. Dawson stated that he had reviewed the application regarding off-street parking. His conclusion was that the City was not justified in imposing off-street parking for a tour of this nature. TREASURER'S REPORT The Treasurer's Report for the month of July was submitted by the City Treasurer, Alice M. Ross. Councilman Chermak moved to accept and file the Treasurer's Report for the month of July. The motion was seconded by Councilman Olivares and it carried unanimously. So ordered. PLANNING COMMISSION MATTERS (a) Reports: (1) Tentative Tract Map 5996 (Johnson. The Secretary of the Planning Com- mission submitted a memorandum recommending approval of the division of some 6.97 acres of land into 17 residential lots, subject to 15 conditions. (2) Division of Land 65_104 (Kainz). The Secretary of the Planning Commission submitted a memorandum recommending approval of the division of a parcel of land into 2 parcels in E-3 District, subject to 3 conditions. 13 (3) Re: Frediani - Single Family Residence. The Secretary of the Planning Commission submitted a memorandum upholding recommendation of the Archi- tectural Board of Review and approved elevations for proposed residence in R-2 H District. (b) Recommendations - None (c) Orange County Master Plan of Arterial Highways, Amendment No. 91 City Engineer, Jack Y. Kubota, presented a letter from the Orange County Planning Commission stating that they propose a number of changes in the Master Street Plan, which would directly affect the City of San Juan Capis- trano in the area of La Pata and E1 Horno. Councilman Buchheim moved that the City Engineer and Planner -Tech attend the meeting of the Orange County Planning Commission and submit a letter of request for continuing the hearing until such time as the Planning Commission could review and make a recommendation. Councilman Chermak seconded the motion and it carried unanimously. So ordered. (a) City Attorney John H. Dawson gave the second reading of Ordinance No. 109, entitled: "An Ordinance of the City of San Juan Capistrano amending Ordinance No. 5 and adopting sectional district map defining the boundaries of the R-1 Single Family Dwelling District, and R-3, Multiple Family and Apartment District, within the City of San Juan Capistrano". Councilman Buchheim offered a resolution adopting this Ordinance and the resolution was passed, approved and adopted by a unanimous vote. (b) Orange County Water Works District #4 - Transfer of Jurisdiction. The City Administrator related his conversation with Mr. Bartle Wells. Until he can get enough information to make a comprehensive report, the matter is at a standstill. (c) 1965-66 Budget. Councilman Buchheim recommended that due to the absence of one of the Council- men, the matter should be continued until the next regular meeting, or until such time as all Councilmen are present. NEW BUSINESS (a) Resolution of Jurisdictional Authority - Orange County Health Department - Re: Health and Safety Code, Division 13, Chapter 5, Article 1, Section 17961. Councilman Buchheim moved that the matter be referred to the City Attorney for study and report. Councilman Chermak seconded the motion and it carried unanimously. So ordered. f- / r T (b) Amendment to Ordinance No. 99 - Fixing salary of City Treasurer - Councilman Buchheim made a motion that this subject be continued until a time when the entire City Council was present. The motion died for lack of a second; however, the Mayor, with the consent of Councilmen present, continued the matter until the next budget hearing. (c) Documents for Conveyance of Easements for sidewalks in Tracts 4678 and 5125 (Darmi). The City Engineer stated that the matter is still pending. (d) Document regarding abandonment of sewer easement (Mock). The City Attorney, John H. Dawson, will draw the necessary papers for the abandonment. (e) better from Town & Country Homes, Inc., Re: Tract 5624, requirement of a masonry wall on northerly boundary of Tract. Mayor Durnford moved that this request be referred to the Planning Commission for study and recommendation to the City Council. The motion was seconded by Councilman Buchheim and it carried unanimously. So ordered. RECOMMENDATIONS AND REPORTS (a) City Attorney, John H. Dawson (1) Stated he will prepare the abandonment of sewer easement for the Council in proper form so that it may be passed at the next Council meeting. (2) Report on 1911 Act Lawsuit - Hearing is set for August 12, 1965. He will try to get low bid of contractor. There will be no oral argument as a stipulation of facts has been submitted. (b) City Engineer, Jack Y. Kubota (1) Curb and gutter construction started on Croddy property, San Juan Creek Road. (2) Kolbet - Tract 5733• Working on sub -grade for street paving. (3) Access road to Ready -Mix plant coming along well (Consolidated Rock). (4) Continuing work on Freeway boring. Miscellaneous work on Tract 4678 (Darmi) (5) Rough grading on Tract 5946, second unit, finished. (6) Val Verde Tract 5513 - Memo to bonding agent to have maintenance problem eliminated. (7) Received revised plans providing for drainage of property where new shop- ping center is scheduled. This seems to solve the problem of drainage. (8) Tract 5947 - Plans are virtually completed. (9) Re Grading Bonds for Tract 5399. No reply received from Orange County Building Department. j_q-6s 9 (c) Councilman Buchheim (1) Question regarding relinquishing of Grading Bond for Capistrano Mesa. He moved that the Council instruct the City Administrator to write the Orange County Building Department to determine what action had been taken regarding this matter. The motion was seconded by Councilman Olivares and it carried unanimously. So directed. (2) Council should consider establishing a requirement for all subdivisions for underground utilities and slope planting. (d) Councilman Chermak inquired if there were any legal means to require merchants to provide adequate trash containers for refuse. Study should be made into cost to place receptacles in City areas.
