ADJOURNED REGULAR MEETING OF THE CITY COUNCIL - CITY OF SAN JUAN CAPISTRANO
The City Council of the City of San Juan Capistrano, California, met for
an adjourned, adjourned meeting on 'Monday, July 20, 1970, at 6:31 P.M. in the
Council Chambers of the City Hall, with Mayor Thomas A. Forster presiding.
The meeting opened with the pledge of allegiance.
COUNCILMEN PRESENT: Chermak, Gammell, Thorpe and Forster.
COUNCILMEN ABSENT: Bathgate
The Mayor asked for staff reports of the request for the retroactive
extension of Tentative Tract 6788 (Del Obsipo Company) from date of expiration,
May 18, 1970, for a period of 90 days. Written legal opinion from the City
Attorney was that it was a right and proper procedure. City Administrator
reported the tract was ready for acceptance and recordation, having received
all the required fees and/or bonds necessary for final approval.
Ron Birtcher, representing the developer, spoke in favor of this request
for extension caused by extenuating delays beyond their control. After
Council discussion and presentation from the floor by Jack Kubota, City
Engineer, his recommendation was to accept the final tract map for recordation,
by Council action. Councilman Gammell moved to grant the extension of time for
a period of 90 days to include all existing conditions and agreements between the
Del Obispo Company and the City. Councilman Chermak seconded the motion, carried
by a 4 to 0 vote.
7-J1/`-/ Further discussion by T. J. Meadows, Director of Public Works, stated the
developers had posted the required bonds for water improvements for the sub-
division. His recommendation for Waterworks District No. 4 was to accept the
final map and authorize its recordation. Councilman Chermak offered Resolution
No. 70-7-20-1 accepting final tract map 6788 and authorization for its recording.

The Mayor directed the City Administrator to contact the City Attorney for the
purpose of obtaining a legal opinion with respect to a reimbursement provision and
connection fee schedule as pertains to an area of benefit for the adjacent
properties and the 1911 Assessment District No. 66-1
Mayor Forster stated acceptance of the budget would be taken up at the next
regular council meeting and hopefully adopted, based on the same tax rate,
