70-0604_CC_Minutes_Adjourned Regular Meetingoc�o qzl JUNE 4, 1970 MINUTES OF THE ADJOURNED REGULAR MEETING - CITY COUNCIL -SAN JUAN CAPISTRANO The meeting of the City Council was called to order at 6:03 P.M. by Mayor Thomas A. Forster. The City Clerk called the roll. Councilmen Present: William A. Bathgate, James F. Thorpe and Thomas A. (Tony) Forster. Councilmen Abseat: Josh M. Gammell and Edward S. Chermak. Councilman Gammell arrived at 6:07 P.M. PLANNING COMMISSION MATTERS (a) In regard to the minutes of the Planning Commission, item 7 (b) related the passage of Resolution No. 70-4-7-3, withdrawing condition No. 2 in connection with tentative tract map no. 7200; item 8 (a) was for clarifica- tion as to intent of "return for decision from the Planning Commission." (b) Reported precise alignment Coastal Freeway Interchange at Interstate Route 5. (c) Related a letter received from Spanish Treasures (Daniel Brown II) regarding architectural control. The City Planner was directed to respond by letter relating the facts of the matter. (d) Public Hearing for reviewing the precise alignment for La Novia Avenue has been set for July 7, 1970. At this point during the meeting, Mayor Forster recognized E. L. Christianson, engineer for Marina View Heights Development. Mr. Christianson spoke on the subject of the proposed alignment for La Novia Avenue as it may affect property and access and development in the area. Ordinance No. 161 City Attorney, John H. Dawson read Ordinance No. 161, - an.ordinance amending the "Precise Zoning Map" as adopted by Ordinance No,,1.15;'Sect1on 3.02.2, to be designated as "Amendment No. 15" for its second reading in full. Councilman Bathgate offered the ordinance for adoption. It was adopted, passed and approved by a vote of 4 - 0. Business License Ordinance - Proposed Amendment. The City Administrator presented the revised amendment reflecting the inclusion of mobilehome parks in the fee schedule. Discussion followed, Some questions arose as to the inclusion of "recreational vehicle parks!' also. Then the philosophy of the rate of $1.00 vs. $2.00 for each space within the mobile - home park or recreational vehicle park. JUN 41970 Minutes of the Meeting of June 4, 1970. Thereupon, the staff was instructed to make the appropriate corrections and revisions and submit on June 8, 1970. Access Easement - Temporary City Hall Facility 4- y -/ City Attorney had (a) negotiated for a right-of-way agreement and (b) prepared the grant deed for conveyance of a triangular parcel to the Oyharzabals. Councilman Cammell offered Resolution No and City Clerk to execute said grant deed. and approved by unanimous vote. 295 70-6-4-1 authorizing the Mayor The resolution was accepted, passed Councilman Bathgate offered Resolution No. 70-6-4-2 accepting the right-of- way agreement for access to the temporary City Hall facility. The resolution was accepted, passed and approved by unanimous vote. Proposed Change Order - Combination Lock City Administrator reported that consideration for installing a combina- tion lock in the vault door would be an additional cost of approximately $60.00 and recommended the approval of a proposed change order to provide for this. On motion by Councilman Bathgate, duly seconded by Councilman Thorpe, the proposal for change to provide for installation of the combination lock be approved. So ordered. Parks & Recreation Studv Committee Councilman Thorpe reported a list of names of people on the Parks and Recreation Study Committee for the City of San Juan Capistrano. They were: Dennis Pacquin Mrs. Len Surles Don Jeisy Jim Worthington C. C. McCary Darrel],.Truby.' .. , .. Mrs. Beverly Daniel Sam Chicas Mrs. Rita Davis Mrs. Frank Farrell (Clare) With concurrence of the members of tle City Council, the Mayor so appointed those listed to the study committee, with Councilman Thorpe to be an ex -officio member to give orientation and guidance. COUNCILMAN REPORTS Councilman Bathgate Inquired about directional stake out signs within the public rights of way. JUN 41970 296 The City Administrator related the existing administrative policy that provided for developers within the corporate limits of the City of San Juan Capistrano placement of these signs in the public right of way.. Director of Public Works requested specific instructions in abating those signs not authorized to be placed along the street right of way. The City Administrator was directed to submit a draft of administrative policy to the City Council. Mayor Forster (a) Suggested some decision be made regarding what to do with mobilehome parks. With a new Planning Commission, he suggested the report be submitted to the new members for review and for the new Planning Commission to report a recommended course of action. Discussion followed. Councilman Gammell made a motion to refer report and material to the Planning Commission, to respond and convey some guidelines for some study to give basis for the City Council to make a decision. The responding report to be made within two months. The motion was seconded by Councilman Bathgate, passed and so ordered. (b) Recognized Mr. Jon Surles for comment regarding the concern over the destruction of swallows' nests in the area. Mr. Bob Gannon made a statement assuring the continued return of the swallows as long as the supply of insects existed. City Attorney, John Dawson, recommended that the City Council issue a statement of policy regarding the swallows and project an attitude of request for the preservation and protection of the birds.
