MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF SAN JUAN CAPISTRANO
The Mayor called the meeting to order at 6:30 P.M. All members of the
City Council were present. Thereupon, the City Council, in their capacity
as the Board of Directors for the Orange Councy Waterworks District No. 4,
entered immediately into those matters and agenda items.
(Refer to Water District Minutes).
1. At 7:25 P.M., Jack Y. Kubota made a report concerning a request for
bond exoneration on Tracts No. 5733, 5974 and 6225. Further, that it
is a matter of concern that portions of work have not been completed.
The matter was referred back to staff and the City Attorney for a report
and recommendation in written form.
2. Access rights and utilities - City Hall Facilities Building. Councilman
William Bathgate reported on the meeting with the Oyharzabal's, their
attorney, Mrs. Terry Rodriquez, the City Attorney, Director of Public
Works and City Engineer.
Apparently, a moral obligation not yet fulfilled, became a matter of con-
siderable concern. That is - what had been a commitment by the San Juan
Capistrano Sanitary District Board for the conveyance of an additional
strip of land to contain and allow a building and a wellsite to remain
intact had not been consummated. To that end, some arbitrary method to
resolve this issue was proposed. The conveyance of a triangular parcel
at the northwest corner of the City's property which would be approximately
25 feet in depth along the westerly property line and an undetermined
length, except in line to a eucalyptus tree, along the northerly property
line.
At 7:52 P.M., the City Council and those in attendance adjourned to the
site for visual review of the matter as it might affect the property.
Upon returning at 8:22 P.M. and further discussion, Councilman Chermak
made a motion to authorize staff and the City Attorney to draft the
necessary maps and deeds, along with the required surveying and legal
process, to effect the dedication and acquisition. The motion was
duly seconded by Councilman Thorpe, passed and so ordered.

3. Then, the Director of Public Works was instructed to request the
water district to privide water service for the temporary City Hall
facilities building.
The meeting adjourend into a budget study session at 9:03 P.M.
