70-0421_CC_Minutes_Adjourned Regular MeetingAPRIL 21, 1970 ADJOURNED REGULAR MEETING - CITY COUNCIL - CITY OF SAN JUAN CAPISTRANO The City Council of the City of San Juan Capistrano, California, met for an adjourned regular meeting on Tuesday, April 21, 1970, at 7:04 P.M. in the Council Chambers of the City Hall, with Mayor Edward S. Chermak presiding. COUNCILMEN PRESENT: Bathgate, Durnford, Forster, Olivares and Chermak i COUNCILMEN ABSENT:- None The meeting opened with the pledge of allegiance. Invocation was given by the City Administrator, Ernest A. Thompson. The Mayor gave explanation that certification of the election by the Council would be to total the votes cast and tally them with the number counted. The City Administrator gave certification of the canvass. Tally sheets were passed around to the Council for their review. Councilman Durnford offered Resolution No. 70-4-21-1 - a resolution reciting the fact of the General Municipal Election held in said City of San Juan Capistrano on the 14th day of April, 1970, declaring the result thereof and such other matters as are provided by law: WHEREAS, a regular general municipal election was held and conducted in the City of San Juan Capistrano, County of Orange, State of California, on Tuesday, the 14th day of April, 1970, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, the City Clerk of the City of San Juan Capistrano canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part thereof as "Exhibit A." NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That there were (2) voting precincts established for the purpose of holding said election consisting of consolidations of the regular APR 21 Y970 X65 Minutes of the Meeting of April 21, 1970. election precincts in the City of San Juan Capistrano as established for the holding of state and county elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the law relating to cities in the State of California, to wit: Three (3) members of the City Council of -said City for the full term of four years; SECTION 3. That the whole number of votes cast in said City (except absent voter ballots) was 837. That the whole number of absent voter ballots cast in said City was 24, making a total of 861 votes cast in said City. SECTION 4. That the names of persons voted for at said election for Member of the City Council of said City are as follows: NAMES OF NOMINEES: Edward S. 'Chermak Don Durnford Georgia E. Covert Josh M. Gammell Carol (Dolly) Olivares William T. Reid Donald D. Routt Gary J. Sodikoff James F. Thorpe Patrick D. Kendley (Write-in) That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates were as listed in Exhibit "A" attached. SECTION 5. The City Council does declare and determine that: EDWARD S. CHERMAK was elected as Member of the City Council of said City for the full term of four years; JOSH M. GAMMELL was elected as Member of the City Council of said City for the full term of four years; JAMES F. THORPE was elected as Member of the City Council of said City for the full term of four years. SECTION 6. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; APR 21197Q (5) The number of votes given in the City to each person. SECTION 7. That the City Clerk shall immediately make and upon com- pliance by the persons elected with the provisions of Section 11.565 and Section 1.1568 of the Elections Code of the State of California, shall deliver to each of such persons so elected a Certificate of Election signed by him and duly authenticated; that he shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in his office. Where- upon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. Thompson, City Clerk of the City of San Juan Capistrano, County of Orange, State of California, do hereby certify that I have canvassed the returns of the regular general municipal election held in said city on the 14th day of April, 1970, and find that the number of votes given at each precinct and the number of votes given in the City to persons voted for, the respective offices for which said persons were candidates were as follows: DATED: April 21, 1970. The Mayor authorized the City Clerk to sign the new Councilmen's Certificates of Election and Oath of Office forms. The oath of office for City Councilman was administered by the City Clerk, Ernest Thompson, to Josh Gammell, James Thorpe and Edward S. Chermak. So installed. Councilmen Durnford and Olivares vacated their chairs to their successors. The meeting was turned over to the City Clerk for conducting nomina- tion for the position of Mayor. Councilman Gammell nominated Thomas A. Forster, APR 211970 seconded by Councilman Thorpe. Councilman Chermak nominated Councilman Bath- gate; there was no second to the nomination. Councilman Gammell moved to close the nominations, seconded by Councilman Thorpe. Councilman Chermak moved to have Thomas Forster elected Mayor, seconded by Councilman Bathgate, carried and so ordered. Mayor Forster took control of the meeting. Council- man Gammell nominated Councilman Bathgate for Mayor Pro -Tem, seconded by ,'ouncilman Thorpe. Councilman Thorpe moved to close the nominations, seconded by Councilman Gammell, carried unanimously and nominations were closed. It was unanimous to have Councilman Bathgate elected Mayor Pro -Tem. Mayor Forster stated that 54% of the voters turned out for the election. lie offered Resolution No. 70-4-21-2 commending Mr. Don Durnford and Mr. Tony Olivares for their service and time to the City of San Juan Capistrano.
