MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO
The Special Meeting of the City Council of the City of San
Juan Capistrano was called to order at 5:35 P.M. by Mayor Edward S.
Chermak.
All members of the City Council were present.
The City Administrator related the pertinent factors con-
cerning the subject tract, Tract No. 6969, regarding those items
whcich were contingent to be fulfilled and/or complied with.
All matters conforming except for the factor of "flood
hazard" as indicated in a letter report from the Orange County
Flood Control District.
The mayor responded with an attitude of reluctance to
acceptance and approval until such time that several areas of ques-
tion can be answered more clearly.
Mr. Jack Hall, consulting engineer for the development, pro -
jetted his statements of support- for having the tract map accepted,
approved and recorded, - also the submittal of a subsequent letter
from the Orange County Flood Control District, dated September 41h,
1969.
Mr. George Sant, developer of the tract responds with state-
ments of problems being created by the "flood hazard" aspect as
presently submitted by the Orange County Flood Control District.
Discussion followed by relating the provisions of the sub-
division ordinance, Ordinance No. 56, setting forth the design and
improvement criteria to be based upon a twenty-five (25) year storm
frequency factor calculation, and therefore to impose anything more
than that would be unreasonable - or the ordinance is inadequate
and should be amended accordingly.
Therefore, Councilman William A. Bathgate offered a resolution
of acceptance and approval for recordation Tract No. 6969, without
stipulation of "flood hazard" being placed upon said tract map. The
resolution was approved and adopted by a majority vote of 4 to 1.
(Councilman Olivares voted No).
