MINUTES OF THE MEETING OF THE CITY COUNCIL OF SAN JUAN CAPISTRANO
JUNE 30, 1969
The adjourned regular meeting of the City Council was
called to order by Mayor Edward S. Chermak at 7:00 P.M.
The pledge of allegiance was recited. Invocation was
given by the City Administrator, Ernest A. Thompson.
The City Clerk called the roll. Councilmen present: William
A. Bathgate, Thomas A. (Tony) Forster, Antonio M. (Tony) Olivares
and Edward S. Chermak. Councilmen absent: Don Durnford.
REPORTS
Mr. Cappello gave a progress report on the sewer lines in
the San Juan Creek and stated they are down to checking out the
last two manholes. He also mentioned at this time that there are
approximately two to three weeks of work left. Mr. Cappello
answered questions raised regarding the encasement of the pipes
in cement for further protection. Director of Public Works was
instructed to proceed with the work since it is so close to being
finished. Councilman Bathgate moved to uphold the recommendation
of the Director of Public Works to retain Mr. Cappello for the
completion of the job, seconded by Councilman Forster, carried
unanimously.
City Engineer - Jack Y. Kubota
Title Company responded to inquiry of airport property as
far as legal description - Title Company can perform the work
for $150 fee. Discussion followed as to what is going to be
developed around the airport area, such as the Capron property
being sold for a mobilehome park site. City Engineer clarified
position of the Planning Commission setting up Public Hearing -
but first legal descriptions have to be processed. Council
determination was to process all property involved at the airport.
Decision as to whether or not to go ahead discussed. Also,
question raised as to price of publishing public hearing. City
Engineer directed to proceed with descriptions.
Councilman Bathgate
Inquired as to when we can expect a temporary crossing on
the Trabuco Bridge on Camino Capistrano. Director of Public

Works stated cost of temporary crossing over existing bridge
would run approximately $500 plus posted signs regarding
temporary use. Councilman Bathgate moved to have the Director
of Public Works proceed on temporary structure of crossing of
Trabuco Bridge, seconded by Councilman Oli.vares and to have
Mr. Franklin of Engineering Science give his opinion as to
the safety from the school bus standpoint. Carried unanimously.
City Administrator - Ernest A. Thompson
(a) $5,000 from Mr. Mi_sbin has been pai.d.
(b) Sewer connection fees on Cool: property have been paid.
(c) Tract 6969 - McCarthy -Sant, 44 lots paid.
(d) Stroshein's deed of conveyance of property along Del Obispo
Street extension is being reviewed by the City Engineer.

Mentioned telephone call regarding rebuilding Alipaz Street.
BUDGET
(a) Lengthy disucssion regarding capital improvements and where
the encumbrances are shown if rebudgeted. Director of
Finance stated encumbered fund balances will be shown this
year out of unappropriated surplus amounts.
(b) Director of Finance clarified revenue gap coming from
unappropriated surplus amount.
(c) PL 875 Fund can be used only for replacing what is lost
and nothing else.
(d) Question was raised re: adopting budget or having a budget
as a projected guideline and whether or not that applies to
spending exactly what is appropriated or coming before
Council for approval. An adopted budget requires a Public
Hearing.
(e) Comp, time or overtime - Director of Public Works has re-
quested $500 overtime be put into the budget. He also
requested the hiring of another employee for the Public
Works Department to work the week -end schedule.
(f) Job classifications were brought up as a matter for definite
consideration. Job classification and job descriptions should
be made very clear.
(g) Councilman Forster moved, seconded by Councilman Bathgate to
adopt the 40, 20 16 hour overtime format by modifuing the
recommendation of the City Administrator for establishing 4-30-69

the overtime policy and authorized the City Administrator to
notify appropriate departments. Carried unanimously.
(h) Overtime now accured by two employees in the Public Works
Department, Al Sanchez and James Olivares would be paid down
to 20 hours. Motioned by Councilman Forster, seconded by
Councilman Bathgate, carried unanimously.
(i) Questions raised on the maintenance yard equipment requested -
such as the skip loader scrapper and the back hoe.
(j) Councilman Forster brought up issue of having a Management
Consultant firm do a study on the City. He feels professional
advice in establishing our new City Hall, Public Works
Department, etc. would prove to be a savings in the long
run and stated he would like to see it budgeted for this
year. Councilman Bathgate suggested committee on meeting
with other cities as to the end results and if they were
satisfied with the amount of money spent on such a study.
(k) Question raised as to budgeting for a building department.
(1) Councilman Forster contacted Boyle Engineering regarding
possible interest in submitting engineering proposal for
CityHall facilities.
(m) Councilman Forster inquired if we have heard anything thus
far as to the reimbursement from the county regarding the
Director of Public Works salary.
