SAN JUAN CAPISTRANO CITY COUNCIL
EXECUTIVE SESSION MEETING
Mayor Farias called the February 6, 2024, Regular Executive Session meeting of the
City Council to order at 3:00 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Sergio Farias, Mayor Pro Tem Troy
Bourne (arrived after commencement), and Council Members Howard Hart, John Taylor,
and John Campbell.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning price and terms of payment
concerning the City Hall and Permanent Supportive Housing properties located
at 32400 and 32410 Paseo Adelanto, San Juan Capistrano, CA 92675.
Negotiating party: Jamboree Housing Corporation.
b. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at the northeast corner of La Novia
Avenue and San Juan Creek Road, APNs 666-013-03, 04, and 06 and 666-042-
10 and 11. Negotiating party: The Ecology Center.
c. Pursuant to Government Code section 54957.6, the City Council conferred
with its labor negotiators (Benjamin Siegel, City Manager, and
Shelley Velez, Human Resources Manager) as to the memoranda of
understanding with represented employees, including salaries and fringe
benefits. The affected bargaining units are San Juan Capistrano Classified
Employees Association and San Juan Capistrano Management and
Professional Employees Association.
d. Pursuant to Government Code Section 54956.9(d) (4), the City Council
conferred with Legal Counsel to discuss initiation of litigation (2 items).
e. Pursuant to Government Code Section 54956.9 (a), (d)(2), the
City Council conferred confer with Legal Counsel to discuss anticipated
litigation – significant exposure to litigation (1 Item).

ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Council Member Taylor
recused from item E due to proximity to his residence. Council Member Hart recused
from one of the items under D due to proximity to his residence.
ADJOURNMENT:
There being no further business, Mayor Farias adjourned the meeting to Tuesday,
February 6, 2024, at 5:00 p.m. for a Public Business Session, in the City Council
Chamber at the Nydegger Building – 31421 La Matanza Street.
