ADJOURNED REGULAR MEETING - CITY COUNCIL - CITY OF SAN JUAN CAPISTRANO
The adjourned regular meeting was called to order at 6:03 PM by
Mayor Forster.
The pledge of allegiance was recited. Invocation was given by
Mr. T. J. Meadows.
The City Clerk called the roll. Councilmen present: William A.
Bathgate, Edward S. Chermak, Josh Gammell, James F. Thorpe and Thomas A.
Forster.
1. Staff Feasibility Report on the Proposed Annexation of
Capistrano Beach -Dana Point to the City of San Juan Capistrano
It was moved by Councilman Chermak and seconded by Councilman
Thorpe to accept the staff's feasibility report for study. Carried
unanimously.
The Mayor asked for Council discussion on the report. Councilman
Chermak opened the discussion by saying that he would like more elabor-
ation on the population, voter registration and land area data contained
on Page 16 of the draft report. He wished to protect San Juan Capis-
trano's representation on future City Councils should annexation take
place. He voiced concern regarding the ratio of voting strength in the
three communities. Mayor Forster said he shared Councilman Chermak's
concern, but felt that any annexation which created a larger city would
require the Council to reflect the enlarged city and expanded constituency.
Councilman Bathgate said he also shared the concern of the Mayor
and Councilman Chermak, and believed that as population patterns changed
in San Juan Capistrano, Capistrano Beach and Dana Point, it would be
necessary to realign Council districts to maintain equal representation.
Councilman Thorpe felt that staff should be asked to develop
detailed procedures for councilmanic district representation.
The City Council then discussed the timing for the release of the
staff report to the public. Consensus was to release it on a limited
basis to the press and involved citizen groups, as well as Chambers of
Commerce who had taken an official interest in the proposed annexation.
The Mayor then mentioned his interest in the question of the status
of special districts following annexation. He also noted that the staff
report recommended any proposed annexation of Capistrano Beach and Dana
Point be handled as separate questions and suggested that this recommend-
ation could be elaborated upon in the text of the report to make it more
apparent to the public.
Additional discussion ensued on the merits of Council representation
by district rather than at large. The City Attorney advised that any
change in representation would probably require a public vote.
Council determined to withhold a decision on the exact procedures
for Council representation following possible annexation until proponents
voiced their preference. At the conclusion of Council's discussion,
Councilman Chermak moved, seconded by Councilman Gammell, that the draft
of the Staff Feasibility Report for the Proposed Annexation of Capistrano
Beach and Dana Point be given to local newspapers, citizens groups who

were participating in the question of annexation, and the Chambers of
Commerce of San Juan Capistrano, Capistrano Beach and Dana Point. Motion
carried unanimously.
2. Classification and Salary Survey
Moved by Councilman Thorpe, seconded by Councilman Bathgate to
receive Cooperative Personnel Services Classification and Salary Survey
for City employees. Carried unanimously.
The City Manager explained that report was submitted to Council
for its reaction to the first phase of a comprehensive study, which also
included a new set of personnel ordinances, rules and regulations, which
were forthcoming. The Mayor asked for Council remarks on the classifi-
cation and salary portion of the personnel system study.
Council expressed satisfaction with their preliminary review of
the report and tabled it for action in conjunction with the forthcoming
personnel ordinances, rules and regulations,
ADJOURNMENT
Council adjourned at 6:59 PM to an Executive Session for the pur-
pose of discussing qualifications of various applicants to the vacant
Planning Commission position.
The meeting reconvened at 7:06 PM. Mayor Forster asked Councilman
Thorpe to announce Council's decision on the appointment. Councilman
Thorpe stated Mr. John B. Sweeney had been selected,for the Planning
Commission position and gave information on Mr. Sweeney's occupation
and address.
It was moved by Councilman Thorpe, seconded by Councilman Gammell,
that Mr. Sweeney be appointed to the Planning Commission vacancy, effec-
tive immediately. Unanimously approved.
Councilman Chermak then asked Council consideration for a policy
prohibiting smoking in the Council Chambers during Council meetings.
The Mayor said that this request may be in the best public interest and
asked Council to consider a resolution on the subject at the November
22nd meeting.
The Mayor then asked the City Manager to announce a joint Council -
Planning Commission meeting scheduled for 6:00 PM, Wednesday, November
17, 1971, at the Captain's Anchorage, 34311 Coast Highway, Dana Point.
City Manager stated the purpose of the meeting was for a joint discus-
sion on city growth policies.
