75-0611_CC_Minutes_Adjourned Regular Meeting394 JUNE 11, 1975 ADJOURNED REGULAR MEETING OF THE CITY COUNCIL SAN JUAN CAPISTRANO, CALIFORNIA The Adjourned Regular Meeting of the City Council was called to order by Mayor Weathers at 7:02 P.M. in the City Council Chamber. ROLL CALL: COUNCILMEN -PRESENT: James K. Weathers, Mayor John B. Sweeney, Mayor pro tem Councilman Roy L. Byrnes Councilman Yvon O. Heckscher Councilman Douglas B. Nash COUNCILMEN ABSENT: None STAFF PRESENT: James S. Mocalis, City Manager; William Murphy, Director of Public Works/City Engineer; George Lohnes, Associate Civil Engineer; David J. Smith, Director of Planning; Mary Ann Hanover, City Clerk. Mayor Weathers announced that the Council would recess to personnel session at 9:00 P.M. in order to meet and confer with the Employees Association. LAND USE MANAGEMENT CODE AND OFFICIAL ZONING MAP - CONTINUATION OF PUBLIC HEARING Notice having been given as required by law, Mayor Weathers announced that this is the time and place set for the continuation of the Public Hearing on the Proposed Land Use Management Code and Official Zoning Map and inquired if anyone in the audience wished to address the Council either for or against the proposed Official Zoning Map. There being no one wishing to address the Council on this subject, Mayor.Weathers inquired if anyone in the audience wished to present general testimony on the Land Use Management Code itself. The following persons addressed the Council: 1. Mr. Manuel Perez, 800 North Main Street, Santa Ana, Director of Governmental Affairs for the Building Industry Association. 2. Mr. George Maschmeye-r, Mariner Savings & Loan Association, Westcliff at Dover, Newport Beach. 3. Barbara Davies, President, Town Hall Association, 29391 Edgewood Road. 4. Marilyn Williams, 29931 Camino Capistrano. 5. Justus Gilfillan, 4300 Campus Drive, Newport Beach, representing Mission Hills Ranch, Inc. 6. Roland Olsen, 25952 Avenida Mariposa. 7. Ron Hoeffer. There being no one else wishing to address the Council, Mayor Weathers declared the Public Hearing closed with the right to re -open at any time. The City Manager advised Council that, pursuant to discussions with the City Attorney, he would recommend that Chapter II of the Code be re -written in order to facilitate administration of the Code and that consideration should be given to preparing a preface to the Code and a set of administrative rules so that codification may be accomplished. The proposed Home Warranty -1- 6/11/75 Program is being considered separately from the Land Use Code; other portions of the Code could be amended as the ordinances are codified. The Director of Planning made a slide presentation on the proposed sign program, including input from citizen organizations received in the past. Council discussion ensued; and, pursuant to the Planning Director's recommendation, Mayor Weathers directed that the sign ordinance portion of the Land Use Management Code be reproduced and copies forwarded to the following organizations for further comment and recommendation: San Juan Beautiful Architectural Board of Review Chamber of Commerce Town Hall Association Mayor Weathers directed that further consideration of the proposed sign ordinance be tabled until the Council meeting of June 25, 1975. Council commenced their review of the Land Use Management Code at Chapter 3 and requested information regarding the mechanism available for appeals to decisions of staff. RECESS AND RECONVENE Council recessed at 9:05 P.M. to a personnel session to discuss meet and confer negotiations and reconvened at 9:45 P.M. PERSONNEL - EMPLOYEE RETIREMENT SYSTEM RESOLUTION NO. 75-6-11-1: SELECTION OF RETIREMENT PLAN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AUTHORIZING AN ELECTION TO DETERMINE EMPLOYEE PREFERENCE FOR RETIREMENT SYSTEM was read by title by Mayor Weathers. It was moved by Councilman Heckscher and unanimously 75-6-11-1 be adopted. LAND USE MANAGEMENT CODE Byrnes, seconded by Councilman carried that Resolution No. Mayor Weathers announced that Council consideration of the Code would continue from Page 3-8 and continued the Public Hearing to the next regular meeting date of Wednesday, June 18, 1975. BICENTENNIAL CELEBRATION - FREEDOM TRAIN Mayor Weathers advised that the City is seeking a commitment from the American Revolution Bicentennial Freedom Train Foundation that they will schedule a train stop in the City during their tour of California and requested that citizens and organizations in the City and in surrounding communities direct letters to Jon Foust, President of the Foundation, to encourage a train visit. Copies of such letters are to be retained in the City files. ADJOURNMENT There being no further business before the Council, the meeting was adjourned at 10:06 P.M. to the next regular meeting date of Wednesday, June 18, 1975, at 7:00 P.M. in the City Council Chamber.
