74-1203_CC_Minutes_Adjourned Regular MeetingDECEMBER 3, 1974 ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF SAN JUAN CAPISTRANO The Adjourned Regular Meeting of the City Council was called to order by Mayor Byrnes at 7:02 P.M. in the City Council Chamber. ROLL CALL: COUNCILMEN PRESENT: COUNCILMEN ABSENT 255 Roy L. Byrnes, Mayor James K. Weathers, Mayor pro tem Councilman Yvon O. Heckscher Councilman Douglas B. Nash Councilman John B. Sweeney, who joined the meeting at 7:05 P.M. None STAFF PRESENT: John O'Sullivan, Interim City Manager/Director of Administrative Services; George Madsen, Sr. Project Engineer; William Murphy, Public Works Director/City Engineer; David Smith, Director of Planning; Carl Neuhausen and Ed Haworth, Planning Consultants; James Okazaki, City Attorney; Mary Ann Hanover, City Clerk. PUBLIC HEARING - SAN JUAN CAPISTRANO GENERAL PLAN (CONTINUATION) Notice having been given as required by law, Mayor Byrnes declared the Public Hearing re -opened. Council received copies of a report dated November 25, 1974, from the Director of Planning which compiled comments made by individual Council members relative to proposed changes in the General Plan. The memoranda of Council members' comments and the Planning Director's Report are hereby incorporated by this reference as though fully set forth herein. Council continued its deliberations with discussion of the Composite Land Use Map and the various Elements of the General Plan as set forth in the Planning Director's Report. The following items in addition to those contained in the November 25 Report were referred to the Planning Commission for report back to the City Council: Parks and Recreation Element: Page 1. The lack of a park designation in the south end of the City. Composite Land Use Map: Page 3, Item (6). Move floodplain line back to original position on property in San Juan Creek immediately northeast of freeway. Page 4, Item (16). Mr. Ahern - Recreation/Open Space designation; size of neighborhood commercial facilities; deletion of open space designation on Mission Hills Ranch wea. Council noted that with regard to Item consideration of a junior college...." "....consideration of a State college -1- (18) the words, ". should be changed to or university...." 12/3/74 Page 4, Item (20). Mr. Heinley - The retention of commercial 5 designation on the Huntington property at Del Avion and Alipaz. Item (24). Mr. Kinoshita - Agricultural issue and being caught "in the interim" while the City is trying to determine precisely how the agricultural lands can be saved. He also raised the point of the expansion of agricultural preservation to all Class One soils through- out the City. It was moved by Councilman Sweeney, seconded by Councilman Weathers that the agricultural designation of the properties on Del Obispo owned by Mr. Kinoshita, Mr. Cook and Mr. Vermeulen be referred to the Planning Commission. The motion carried by the following vote: AYES: Councilmen Sweeney, Weathers, Heckscher and Mayor Byrnes NOES: Councilman Nash ABSENT: None Item (25). Mr. Gilfillan - Mission Hills Ranch properties. Item (26). Mr. McMechan - Rodgers and McGauly property to be increased to an intensity of two units per acre vice one unit per acre. General Plan Volume I: Overview: Page 6, Item (1). Change title to read, "Summary of the General Plan Process." Introduction: Page 6, Item (1). Page 1, first paragraph. I see no reason why Volumes I and II should be two separate documents. Suggest that in final publication they be combined in one document for ease of use. Thus, revise wording in first paragaph and delete pages i -iii and pages 1-3 in current Volume II. Circulation Element: Page 7, Item (1). My past support of the move to reduce 6 lane highways to 4 lane highways has been predicated on the idea that the right of way planning would allow sufficient width to include broad medians (available for landscaping), as well as bike, equestrian and hiking trails adjacent to the roads. The essential point is to acquire sufficient right of way to allow the amenities indicated above to be con- structed at the desire of the citizens. I would not like to see the above principle violated in an attempt to "preserve the village atmosphere of San Juan." Item (2). I am not in favor of widening Camino Capistrano to four lanes north of Junipero Serra, and would set as a policy that, until usage or other clear proof demonstrates the need, no highway should be built more than two lanes wide. Item (5). Nowhere in Circulation Element do I find any criteria for avoiding the residential circulation problems we are now facing in the Alto Capistrano area. I.e., one tract becoming.an "arterial" for a subsequent tract. This should be treated and included in Summary Element. RECESS AND RECONVENE Council recessed at 8:50 P.M. and reconvened at 9:10 P.M. -2- 12/3/74 Circulation Element (Continued): 257 Page 9, Item (17). Page 12, paragraph 2. Define what is meant by "full highway segment ultimately needed." Housing Element: Page 10, Item (9). Page 18, middle of top paragraph. Is this a veiled suggestion that the City should not allow any more housing approvals until after 1977? Clarify. Poge 13, Item (36). Incorporate thrust of above comments under "Implementation Measures" section of Housing Element. Page 28, first paragraph. Delete "or when the developer provides them in advance of their provision by the public sector." This assumes that the developer can by-pass or leap -frog the plans of the public sector. Only when the public sector's schedule of facilities construction can accommodate the developer's own schedule, should "advance" developer provision of facilities be considered. As currently written, the paragraph places public sector facilities planning on an equal footing with developer "advance" construction. Council also recommended that the word "either" be deleted in the antipenultimate sentence. Noise Element: Page 17, Item (10). Page 51-B, top paragraph. If units are allowed to cluster outside of affected noise area of a parcel or parcels, we should have a firm policy on what status the remaining "affected" area shall have. E.g., permanent open space, project open space, parking lots, etc. Item (12). It is my understanding that a CNEL of 60 is a level of noise high enough to interfere with normal speech or conversation. If this understanding is correct, I am puzzled why this level should be established as the threshold beyond which residential construction shall not be allowed (page 51-B). It should obviously be lower. Item (13). No demonstration has been made to the City Council of the actual meaning of dba levels of 45, 55, etc. How can we therefore approve the Implementation Measures listed on pages 52 and 53? Public Safety Element: Page 19, Item (5). Page 67, 2nd paragraph, line 6. What are the "existing obstructions to flood flows?" Clarify. Parks and Recreation Element: Page 19, Item (1). I am in favor of the central park theme; however, I'm not sure where this will best be located and certainly don't feel committed to the Los Rios Area. Council suggested the words "for example" be added after the reference to the Los Rios Area. Page 20, Item (13). Page 75. I would wish to explore the possibility of increasing the current ratio of seven (7) acres per 1,000 to ten (10) acres per 1,000. Historical/Archaeological Element: Page 12, Item (12). Page 86, bottom four paragraphs. Delete first three words in all four.
