ADJOURNED REGULAR MEETING OF THE CI'T'Y COUNCIL
OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA
The Adjourned Regular Meeting of the City Council was called to
order by Mayor Nash at 7:12 P.M. in the City Council Chamber for
the purpose of continuing discussion of the proposed 5 -year budget.

joined the meeting at 7:24 P.41.
ABSENT: Councilman John B. Sweeney

Director of Administrative Services; William D. Murphy, Director
of Public Works/City Engineer; George M. Lohnes, Associate Civil
Engineer; Thomas G. Merrell, Director of Planning; James S.
Okazaki, City Attorney; Mary Ann Hanover, City Clerk.
CITY COUNCIL - RESIGNATION OF RICHARD D. McDOWELL
(32) Mayor Nash expressed his regrets to Councilman McDowell on the
fact of his recent notification of his intention to resign as a
member of the City Council due to his wife's illness. Mr.
McDowell submitted a letter dated June 10, 1976, advising the
Council of his decision to resign effective July 31, 1976.
Mayor Nash requested a review of the requirements for filling
an unexpired Councilmanic term. The City Manager advised
that Council may make an appointment by majority vote of the
quorum within 30 days after the effective date of a resigna-
tion or, if no appointment is made, an election would be
consolidated with the November general election. The City
Attorney also advised that Council may adopt an ordinance
providing that a person appointed to fill a vacancy holds
office only until the date of the special election. Mayor
Nash requested that the City Manager prepare a report setting
forth the requirements for filling a Council vacancy, includ-
ing time frames and approximate costs of holding a special
or a general election. Mayor Nash also requested a brief
review of City Council appointments or other methods utilized
in the past for filling Council vacancies in the City.
Councilman McDowell suggested he would make his resignation
effective at an earlier date if that were more feasible for
replacement procedures.
SERRA OCEAN OUTFALL PERMIT CONDITIONS
(79) The Director of Public Works reported that he had attended a
Public Hearing in San Diego today before the San Diego
Regional Water Quality Control hoard on permit conditions
for the ocean outfall. Since the plant was recently completed,
daily samples of water quality will be reviewed before further
action is taken.
DISCUSSION OF PROPOSED 5 -YEAR BUDGET
(24) Council commenced discussion of the proposed budget document
at Page 20, and continued through Page 46,having covered the
following departments and services: City Council, City
Manager, City Clerk, City Attorney, Payroll Burden, Community
Promotion, and Police.

Council recessed at 8:40 P.M. and reconvened at 9:02 P.M.
CONTINUATION OF BUDGET DISCUSSION
(2) The proposed allocation for a City newsletter is to be
identified as a separate budget item.
(3) The sum of $3,000 is to be added to the City Clerk's
budget for costs of a possible election during 1976-77.
(4) Information is to be provided showing amounts paid by
other cities for full-time City Attorney services; a
time analysis is to be prepared indicating hours spent
on staff and Commission meetings.
(5) An estimate is to be prepared showing the effect on
citation issuance should another patrol unit be
included in the police services budget.
ADJOURNMENT
The meeting was adjourned at 9:55 P.M. to the next regular meeting
date of Wednesday, June 16, 1976, at 7:00 P.M. in the City Council
Chamber.
