ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA
The Adjourned Regular Meeting of the City Council of the City.
of San Juan Capistrano, California, was called to order by
Mayor Heckscher at 7:07 P.M. in the City Council Chamber,
followed by the Pledge of Allegiance to the Flag.
ROLL CALL PRESENT: Yvon 0. Heckscher, Mayor
Kenneth E. Friess, Mayor pro tem
Richard D. McDowell, Councilman
Douglas B. Nash, Councilman
John B. Sweeney, Councilman
ABSENT:
None
STAFF PRESENT: James S. Mocalis, City Manager; William D.
Murphy, Director of Public Works/City Engineer; Thomas G.
Merrell, Director of Planning; James S. Okazaki, City Attorney;
Mary Ann Hanover, City Clerk.
MOTION TO READ BY TITLE ONLY
It was moved by Mayor Heckscher, seconded by Councilman Nash
and unanimously carried that all Ordinances be read by title
only.
ORAL COMMUNICATIONS
1. 1977-1982 FISCAL BUDGET
(24) Marilyn'Williams, 29931 Camino Capistrano, addressed the
Council regarding general Fund revenues as set forth in
.the preliminary budget relating to transfers from the
sewer maintenance and sewer bond retention funds and gas
tax funds, and regarding the projections for City Attorney
services.
ORDINANCES
1.
(85) Council received copies of a proposed ordinance to amend the
Land Use Management Code relating to use and occupancy permits,
as directed at the Council meeting of April 6, 1977. Mayor
Heckscher suggested that the ordinance wording should include
certain contingencies in any sales contracts for new residences
requiring the signature of the buyer regarding the conditions
of approval to be fulfilled by subdividers and a statement
regarding the legality of occupancy. Mayor Heckscher stressed
that the intent was not to place another hurdle in the way of
developers, but rather to avoid the types of problems
encountered in the past when conditions of approval have not
been met. The City Attorney advised that an ordinance would
be prepared for Council consideration at the next meeting.
COUNCIL ACTIONS
1. APPOINTMENT OF TRAFFIC AND TRANSPORTATION
COMMISSIONER S11ARON A. NEELY
(23) it was moved by Councilman Sweeney and seconded by Councilman
McDowell that Sharon A. Neely, 31098 Via Santo Tomas, be
appointed to fill the existing vacancy on the Traffic and

Transportation Commission. The motion carried by the
following vote:
AYES: Councilmen Sweeney, McDowell, Friess,
and Mayor Heckscher I
NOES: Councilman Nash
ABSENT: None
Couucilman Nash clarified that he had voted in the
negative -ince he had not had an opportunity to review
Mrs. Neely's application.
2. REVIEW OF 1977-82 PRELIMINARY BUDGET
(24) Council received copies of the preliminary budget for
the five years beginning July 1, 1977, and ending June
30, 1982. The City Manager made an oral presentation and
noted that the budget contains a schedule for Council and
Commission review of the document and includes two Public
Hearings, one on June 8 and the second onJune 29 in
conjunction with budget adoption.
Mayor Heckscher suggested that in order to have the benefit of
public input prior to June 8, comments from the public should be
submitted in writing with copies to Council members; or, objec-
tions could be voiced during the "Oral Communications" period,
Councilman Sweeney suggested that the'number of persons
attending the budget sessions be included in the record.
The Director of Administrative Services then made an
oral presentation of the various accounts as presented.
Mayor Heckscher requested that any detailed questions from
Council members be directed to Mr. O'Sullivan outside of
meeting times and that objections bd voiced after the
Public Hearings.
Councilman Nash requested that the titles of accounts
and departments be set forth in a consistent manner, and
Mr. O'Sullivan advised that a budget manual would be provided
to Council.
Mayor Heckscher noted that Council should address the
practice of placing Reserve Fund interest in the General
Fund rather than being retained in the various Reserves.
Mr. O'Sullivan advised that a report would be submitted on
the impact of interest being credited to the Reserves.
Council members commented on the various accounts including
costs to the Water District for legal services, liability
insurance, support for community organizations, and parks
and recreation maintenance fees. Councilman Sweeney
suggested that purchase of the Mini Park and Esslinger
building on Camino Capistrano be included in the budget.
SCHOOL DISTRICT BUSES
(78) Councilman Sweeney noted the unsightly condition of the
many old buses parked at Bucheim Field on El Camino Real.
Mayor Heckscher requested that the City Manager investigate
the matter.
CABLE TELEVISION HEARING
(43) The City'Manager advised that an administrative hearing is
scheduled in the Council Chamber for Thursday, April 21,
1977, at 7:00 P.M. to hear comments from the public
with regard to cable television service. The consultant
hired by the City will also attend.

There being no further business before the Council, the meeting
was adjourned at 9:20 P.M. to the next regular meeting date of
Wednesday, April 20, 1977, at 7:00 P.M. in the*City Council
Chamber.
