Invocation was given by Pastor Don Lewis, St. Margaret of Scotland Episcopal Church. ROLL CALL PRESENT: Phillip R. Schwartze, Mayor Lawrence F. Buchheim, Mayor pro tem Anthony L. MINUTES Regular Meeting of September 1, 1981 It was moved by Councilman Hausdorfer, seconded by Councilman Friess that the Minutes of the Regular Meeting of September 1, 1981, be approved as submitted. PRESENTATION - NATIONAL COUNCIL ON ALCOHOLISM (61) Tom Gannon, Board Member, National Council on Alcoholism of Orange County, presented a framed, First Day Cover Commemorative Stamp issued by the United States Postal Service with an alcoholism theme. Mr. Gannon advised that the National Council is dedicated to informing the public that alcoholism is a disease which can be cured. Mayor Schwartze expressed the City Council's appreciation. -1- 9/15/81 3'78 2. PROCLAMATION - ORANGE COUNTY COALITION AGAINST DOMESTIC VIOLENCE (71) Mayor Schwartze read the Proclamation in full proclaiming October 12 - 18, 1981, as Domestic Violence Awareness Week. Tom Gannon accepted the Proclamation with appreciation. 3. COMMENDATION - MOBILE HOM (23) Mayor Schwartze presented a Certificate of Commendation (36) to Aaron Powers for his service to the Community as a member of the Mobile Home Park Review Committee. Mr. Powers accepted the Certificate with appreciation. CONSENT CALENDAR It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim that the staff recommendations be accepted for the following items listed on the Consent Calendar. APPROVAL OF WARRANTS (41) The List of Demands dated September 15, 1981, Warrants Register No. 82-032, in the amount of $388,126.61, was approved as submitted. 2. CITY TREASURER'S REPORT OF INVESTMENTS (41) The City Treasurer's Report of Investments as of August 31, 1981, in the total amount of $8,769,474.01, was approved as submitted. 3. CITY TREASURER'S REPORT OF 1911 ACT BOND DELINQUENCIES (41) The City Treasurer's Report of 1911 Act Bond Delinquencies as of August 31, 1981, in the total amount of $35.72, was approved as submitted. 4. CITY TREASURER'S REPORT OF FUND CASH BALANCES (41) The City Treasurer's Report of Fund Cash Balances as of August 31, 1981, was approved as submitted. 5. TRACT 11086, GRANTING OF UTILITY EASEMENT (SOUTHERN CALIFORNIA GAS COMPANY) (85) An Easement for utility purposes within Alipaz Street (73) was granted to the Southern California Gas Company, in (90) accordance with requirements for design and relocation of an existing 30 -inch gas line by Tri -S Homes, developer of Tract 11086. An existing utility easement will be quitclaimed to the City following relocation of the gas line, as set forth in the report dated September 15, 1981, from the Director of Public Works. 6. HEARING DATE - APPEAL OF ENVIRONMENTAL REVIEW BOARD (23) A Hearing on the appeal of the decision made by the (68) Environmental Review Board, filed by Walter A. Talley, on (95) behalf of Tony Gregory in conjunction with Rezone 81-5A, was set for the regular meeting of Tuesday, October 6, 1981. -2- 9/15/81 379 7. LIBRARY ARCHITECTURAL PLANS - RELEASE OF PROGRESS PAYMENT (GRAVES) (38) A progress payment in the amount of $19,150.24 was authorized to Michael Graves, Architect, in accordance with contract conditions for design of the San Juan Capistrano Branch Library buildings. PUBLIC HEARINGS 1. ACCEPTANCE OF FOCUS ENVIRONMENTAL IMPACT REPORT Councilman Buchheim left the Council Chamber at 7:14 P.M. due to a possible conflict of interest. (44) Proposal: (68) Adoption of a precise alignment for Junipero Serra Road (83) west of the Interstate 5 Freeway to the future extension of Alipaz Street in conjunction with the development of the Pueblo Serra Planned Community and acceptance of the focus Environmental Impact Report. Applicant: Thisis as City -initiated Public Hearing. Written Communications: (1) Report dated September 15, 1981, from the Director of Community Planning and Development, forwarding the recommendations of the Planning and Traffic and Transportation Commissions that Alternate 9 be adopted as the precise road alignment. (2) Letter dated September 11, 1981, from Myron Smith, P. O. Box 936, San Juan Capistrano, requesting that a precise alignment be held in abeyance until the Las Colinas road study is complete; or, that the portion west of the railroad tracks be deleted. Councilman Bland arrived at 7:30 P.M. and assumed his duties. Notice having been given as required by law, Mayor Schwartze opened the Public Hearing and the following persons responded: (1) Fred Estrada, 501 East Katella, Orange, representing the Juaneno Indian Band, requested that the project be subject to further archaeological reports due to recent location of archaeological sites. Mr. Estrada also requested that a Juaneno Band Member or survey team member be on site whenever further digs are undertaken. (2) Don Hanna, 30161 Branding Iron Road, representing the Pueblo Serra Planned Community, stated that no evidence had been discovered to date to indicate the existence of a permanent Indian settlement on the property, and commended Mr. Merrell for the presentation, and stated the developer's preference for approval of Alignment 7. (3) Bill Bathgate, 29643 Camino Capistrano, recommended that the areas westerly of the railroad tracks in the vicinity of the creek and the easterly portion of the proposed alignments receive additional study to assure flexibility of future development. (4) Pat Douglas, 21775 Via Belardes, stated that Alipaz Street was downgraded to a 4 -lane roadway in November, 1977, and requested that any approved alignment not cause increased street traffic onto or intersecting Alipaz Street. -3- 9/15/81 (5) Edith Banning, 26466 Calle Rio Vista, cited concerns with traffic safety and presented a petition signed by 35 residents of the Rio Vista development urging the reconsideration of the proposed extension of Alipaz since ". . . traffic resulting from this extension would create a serious hazard in our residential community which is made up mostly of young families with children." Mrs. Banning requested that, if Alipaz is extended, right turns not be permitted into Calle Rio Vista and that a "No Left Turn" sign be installed at Via Belardes and Paseo Belardes. There being no further response, Mayor Schwartze declared the Public Hearing closed. Acceptance of Focus Environmental Impact Report: It was moved by Councilman Hausdorfer, seconded by Councilman Friess and unanimously carried with Councilman Buchheim absent that the focus EIR for the precise alignment of Junipero Serra Road be accepted as complete and adequate. Council noted that the EIR addresses archaeological concerns and that the new findings will be considered through existing City controls. Council Discussion: Mayor Schwartze cited an inter -relationship between the Junipero Serra alignment study and future alignments to the north and suggested that a portion of the alignment be approved to allow the Peublo Serra project to proceed without impacting future circulation possibilities, i.e., approval of an alignment for some distance to the west while leaving options open for a precise alignment as development projects are processed. Councilman Hausdorfer suggested that Alignment 7 produces more options than 9 and that a decision should entail only the area up to the railroad tracks. Councilman Friess concurred and suggested that the alignment stop at either the existing Camino Capistrano or at the railroad tracks pending future development. Councilman Bland noted his support for Alternate 9 as having less impact on aesthetics and major constraints in considering extension of the roadway and concurred in approval of an alignment that would allow the Pueblo Serra project to proceed. Approval of Junipero Serra Road Alignment: It was moved by Councilman Hausdorfer and seconded by Councilman Friess that the following Resolution be adopted approving an alignment of Junipero Serra Road approximately as designated by Alternate No. 7 terminating at the westerly right-of-way line of the Atchison, Topeka & Santa Fe Railway property; any further extensions of the roadway are to be determined by development and circulation needs and the alignments of Camino Capistrano and the Las Colinas de Capistrano roadways: RESOLUTION NO. 81-9-15-1, JUNIPERO SERRA ROAD EXTENSION - ALTERNATE 7 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING ALTERNATE 7 BETWEEN INTERSTATE 5 AND THE WEST SIDE OF THE AT&SF RAILROAD RIGHT-OF-WAY AS THE BASIS FOR THE EXTENSION OF JUNIPERO SERRA ROAD -4- 9/15/81 The motion carried by the following vote: AYES: Councilmen Friess, Hausdorfer, Bland, and Mayor Schwartze NOES: None ABSENT: Councilman Buchheim Councilman Buchheim returned at 8:23 P.M. and resumed his duties. 2. AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE - (25) Proposal: (55) Approval of an amendment to Section 9-3.408 of the Municipal Code to require issuance of a Conditional Use Permit for mobile home parks and establish regulations for setbacks, space sizes, street frontages, parking, specific plan requirements and planned development parks. Applicant: This is a City -initiated Code Amendment. Approval of Agreement: It was moved by Councilman Hausdorfer, seconded by Councilman Friess and unanimously carried to approve the Agreement with Willdan Associates for design of the Camino Capistrano Bridge in the total amount of $139,405 in Capital Improvement Budget funds under the Federal Aid Urban Program and to void the Agreement dated March 19, 1980. 2. AWARD OF BID FOR VEHICLE STORAGE IMPROVEMENTS AND PAVINGS (HUNT MIX) (38) Written Communications: (74) (1) Report dated September 15, 1981, from the Director of Public Works, submitted as an addition to the Agenda forwarding the results of bids received for paving improvements to the Public Works vehicle storage area. Award of Bid: It was moved by Councilman Buchheim, seconded by Councilman Friess and unanimously carried to award the bid to the low bidder, Hunt Mix, in an amount not to exceed $10,530 and to reject all other bids received. ADMINISTRATIVE ITEMS DIRECTOR OF COMMUNITY PLANNING AND DEVELOPMENT REVIEW OF PROPOSED GENERAL PLAN AMENDMENT 81-3 - HOUSING ELEMENT (46) Written Communications: (1) Report dated September 15, 1981, from the Director of Community Planning and Development, advising that the State may extend the deadline for adoption of local Housing Elements until 1982. The draft Element was distributed to Council prior to the meeting. -9- 9/15/81 Mr. Merrell advised that the revised Housing Element would require the City to prepare and adopt a Property Maintenance Ordinance, provide for public improvements to the area known as Mission Hill, and commit the City to low-cost housing and energy conservation programs. An extension of the deadline for adoption would allow utilization of the 1980 Federal Consus figures. Councilman Hausdorfer requested that the document provide flexibility with regard to installation of public improvements to Mission Hill, due to the need for particular sensitivity in the area. Councilman Friess noted that the document adequately addresses State mandates and local concerns. Council commended the Planning staff for the Element presented. DIRECTOR OF PUBLIC WORKS 1. APPROVAL OF PURCHASE OF TAX DELINQUENT PROPERTIES AND APPROVAL OF PURCHASE AGREEMENT (COUNTY OF ORANGE; (38) written Communications: (73) (1) Report dated September 15, 1981, from the Director of Public Works, regarding the proposed purchase of tax delinquent properties known as Assessor's Parcel Nos. 666-120-02 and 668-230-02 located on Ganado Drive at Calle Arroyo and on Alipaz Street at Mariner Drive. (2) Letter dated August 25, 1981, from Donna J. Shutt, Tax Deeded Property Agent, Office of the County Tax Collector -Treasurer, forwarding a proposed purchase Agreement providing that the City will retain the property and devote it to public purposes for a minimum of ten years. Authorization to Purchase: It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim and unanimously carried to approve the Agreement between the City and the County of Orange for the purchase of the State of California's title to tax deeded property, pursuant to the California Revenue and Taxation Code and to adopt the following Resolution offering to purchase the properties in the total amount of $200.00: RESOLUTION NO. 81-9-15-3, PURCHASE OF COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, OFFERING TO PURCHASE TAX DEEDED PROPERTY FROM THE COUNTY OF ORANGE TO BE USED FOR PUBLIC ACCESS The motion carried by the following vote: AYES: Councilmen Friess, Hausdorfer, Bland, Buchheim and Mayor Schwartze NOES: None ABSENT: None COMMISSIONS, BOARDS, COMMITTEES PLANNING COMMISSION 1. REPORT OF MEETING OF SEPTEMBER 8, 1981 (67) The Report of actions taken by the Planning Commission at the meeting of September 8, 1981, was ordered received and filed. -10- 9/15/81 TRAFFIC AND TRANSPORTATION COMMISSION 1. ACJACHEMA STREET CIRCULATION STUDY (44) Written Communications: (83) (1) Report dated September 15, 1981, from Edward Rugel, (52) Commission Secretary, forwarding the recommendation made by the Traffic and Transportation Commission on August 12, 1981, that Acjachema Street remain open to through traffic unless provisions can be made to provide an alternate circulation route for buses and passenger vehicles between Camino Capistrano and E1 Camino Real in the vicinity of the proposed Library buildings and the Old Mission grounds. Councilman Friess advised that the Library and Mission architects preferred closing the street to enhance pedestrian movement between the two sites. It was moved by Councilman Friess, seconded by Councilman Hausdorfer and unanimously carried that the architects be directed to pursue a design with through vehicular traffic on Acjachema Street encompassing the design concepts as proposed, with the understanding that future street closure would be considered should traffic safety needs increase. LA NOVIA AVENUE PARKING STUDY (64) Written Communications: (1) Report dated September 15, 1981, from the Commission Secretary. (2) Letter dated September 14, 1981, from Ronald G. Otterbein, Sunhollow Homeowners Association Board of Directors, requesting that consideration of the parking study be postponed for a 30 -day period of time. Deferral of Consideration: With the concurrence of Council, Mayor Schwartze directed that the parking study be re -scheduled for Council consideration at the regular meeting of November 3, 1981. 3. CAMINO CAPISTRANO - REQUEST FOR WEIGHT LIMIT RESTRICTIONS (83) Written Communications: (1) Report dated September 15, 1981, from the Commission Secretary, forwarding the recommendation made by the Traffic and Transportation Commission on September 2, 1981, that weight limit restrictions not be imposed along Camino Capistrano between Avery Parkway and Junipero Serra Road. The request for truck traffic restrictions had been submitted by Ray M. Johnson, 30733 Calle Resplendor. Referral to City Manager: It was moved by Councilman Friess, seconded by Councilman Buchheim and unanimously carried that the City Manager be directed to contact representatives of the County of Orange to resolve the traffic problems; action on the staff report was deferred. 4. APPROVAL OF 4 -WAY STOP CONTROLS LA NOVIA AVENUE AT SAN JUAN CREEK ROAD (82) Written Communications: (1) Report dated September 15, 1981, from the Commission Secretary, forwarding the recommendation made by the Traffic and Transportation Commission on September 2, 1981, that 4 -way stop controls be installed at the intersection of La Novia Avenue and San Juan Creek Road as an urgency measure due to increased traffic conditions. -11- 9/15/81 Approval of Traffic Controls: It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim and unanimously carried to approve the installation of 4 -way stop control devices as recommended by the Commission. COUNCIL ACTIONS 1. MOBILE HOME PARK REVIEW COMMITTEE VACANCY (23) Written Communications: (1) Report dated September 15, 1981, from the Administrative Assistant to the City Manager, forwarding applications received for appointment to the existing vacancy on the Mobile Home Park Review Committee. Interview Committee: There was a concurrence of Council that no action be taken at this time and that Councilmen Bland and Buchheim interview the applicants and provide a recommendation for appointment. COUNCIL COMMENTS AND COMMITTEE REPORTS 1. FENCE CONDITION - LA NOVIA AT SAN JUAN CREEK ROAD (70) Council concurred with the suggestion of Councilman Friess (81) that the Director of Public Works be requested to review the condition of the fence in the vicinity of La Novia Avenue and San Juan Creek Road to provide a pedestrian barrier from the ditch. 2. CONGRESSIONAL DISTRICT BOUNDARIES (51) Councilman Hausdorfer requested that the City register (89) opposition to the redefining of Congressional District boundaries which would change City representation from the 40th District to the 43rd District of San Diego. There was a consensus of Council that a letter of opposition be prepared for the Mayor's signature, that a telegram be sent to Congressman Badham, and that an off -agenda report be prepared on the circumstances. 3. MOTORCYCLE NOISE - BEAR BRAND RANCH, TRACT 10593 (59) Councilman Bland cited continuing disturbance to the (85) residents of the Sun Ranch and Captain's Hill developments caused by noise from motorcycles using the Bear Brand Ranch property. There was a concurrence of Council that the City Manager contact Robert 0. Hill, the developer, to request assistance with alleviating the problem. 4. PUBLIC SAFETY/NOISE - POWERED HANG GLIDERS (59) Councilman Bland cited safety concerns and noise disturbances (70) from powered hang gliders flying over residential areas. There was a consensus of Council that the City Manager provide an off -agenda report on City options for resolving the problem. 5. EMPLOYEE PARKING RESTRICTIONS (VON'S MARKET) (85) Councilman Buchheim noted that employees of Von's Market in the Plaza del Rio are required to park behind the market building by conditions of development approval. -12- 9/15/81 • 6. ORTEGA HIGHWAY BUS SERVICE (60) Council concurred with the suggestion of Mayor Schwartze (88) that a letter be addressed to the Orange County Transit District and to the Orange County Traffic Commission requesting review of provisions for a bus route along the Ortega Highway. CLOSED SESSION Council recessed to Closed Session at 9:35 P.M. for discussion of legal matters, the City Clerk being excused therefrom, and reconvened at 10:05 P.M.
