SAN JUAN CAPISTRANO CITY COUNCIL REGULAR MEETING
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
1. Pursuant to Government Code Section 54957, the City Council conducted a
performance evaluation of the City Manager
Mayor Swerdlin called the adjourned regular meeting of the City Council of the City of
San Juan Capistrano to order at 7:05 p.m. in the City Council Chamber. Council
Member Bathgate led the Pledge of Allegiance and Council Member Allevato gave the
invocation.
ROLL CALL
COUNCIL MEMBERS PRESENT: Wyatt Hart, Diane Bathgate, Joe Soto, Mayor pro
tem Sam Allevato, and Mayor David M. Swerdlin.
COUNCIL MEMBERS ABSENT: None
' STAFF PRESENT: Dave Adams, City Manager; Meg Monahan, City Clerk; William M.
Huber, Assistant City Manager; and Eileen White, Recording Secretary
ORAL COMMUNICATIONS
Ben Bengali, City resident and President of the Marbella Homeowners Association,
requested maintenance of Rancho Viejo Road, adjacent to the Marbella community.
William M. Huber, Assistant City Manager, exchanged contact information with Mr.
Bengali and staff will follow up with his concerns.
Joan Prestly, City resident, requested assistance with mosquito problems she attributed
to holding ponds associated with the Ladera Ranch development. Mayor Swerdlin,
Orange County Vector Control President, agreed to contact her to discuss the situation.
PRESENTATION
1. ORANGE COUNTY TRANSPORTATION AUTHORITY LONG RANGE
TRANSPORTATION PLAN RELATING TO EXTENSION OF ROUTE 73
PRESENTED BY ORANGE COUNTY TRANSPORTATION AUTHORITY

' Paul Taylor, Orange County Transportation Authority (OCTA), Executive in
charge of Planning & Development (accompanied by Tammy Warren, Public

Relations staff member), provided an overview of proposed transportation _
improvements and grouped the improvements based on availability of funds.
The concept of extending the 73 toll road to the future 241 toll road is grouped
among projects dependent upon very high levels of funding which are not
currently within reach. The concept has not been studied or clearly defined.
Bill Huber, Assistant City Manager, provided a brief history of the 73 extension
concept.
Public Comment:
Bob King, City resident, representing Save Our San Juan and homeowners
associations including Village San Juan, Summerwalk, Capo Royale, and the
Hunt Club, stated that many residents did not receive proper notice of tonight's
meeting. He felt the extension of the 73 toll road would have devastating effects
on the northern entrance to the City and the City's equestrian lifestyle. The
extension will destroy the unique character of the City and decrease property
values. He requested formal Council opposition to the proposal and that it be
removed from further consideration by OCTA. He asked Council to consider a
petition opposing the proposed extension as they discuss the concept and
forwarded it to the City Clerk.
Jerry Williams, City resident and president of the Village Townhouse Association,
was opposed to any extension of the 73 toll road.
Steve Getty, City resident and Village San Juan Association Vice President, was
opposed to the proposal as it would destroy their neighborhood.
Dan Bardy, City resident, opposed the proposed 73 extension as it would
negatively affect nearby schools.
Jack Eidt, City resident, felt the proposed extension was an effort to provide
transportation to the Rancho Mission Viejo project, which is deficient in meeting
transportation needs. The proposal would devastate the City's equestrian
lifestyle.
John Giovannone, City resident, said he and many of his neighbors did not
receive notice of this meeting. He requested Council take action to formally
oppose the project.
James O'Sullivan, City resident, opposed extension of the 73 toll road and felt
the proposal was inconsistent with the Mayor's stated goals.
Thomas H. Barrett, City resident, President of Stoneridge Homeowners —
Association, asked Council to protect the City from this proposal. He felt meeting
notice was provided very late.

Steve Mandala, City resident, requested the Council take action to formally
oppose an extension of the 73 toll road.
Paul Schneider, City resident, was opposed to extension of the 73 toll road as it
would be devastating to equestrian community and the ambience it provides.
Eddie Rose, Laguna Niguel resident, was opposed to the project and provided
some personal insights concerning transportation needs, as well as announcing
his candidacy for the Board of Supervisors.
Ben Bengali, City resident, felt more notice should have been provided
concerning the meeting. He ascertained that the proposed extension of the 73
toll road is not on the 2006 long range plans for the OCTA. He was opposed to
such an extension.
Anne Harringan, City resident, did not receive notice of the meeting. She
expressed opposition to the project and several projects promoted by the City of
Mission Viejo.
Reed Royalty, City resident, was opposed to the project because it would
decrease local property values.
' Richard Gardner, Capo Beach Resident, stated that Measure M funds would be
used to improve transportation conditions in North Orange County. He urged
Council and City residents to fight the toll road proposal and push for better
transportation solutions.
Diane Clossen, City resident, was opposed to extension of the 73 toll road as she
had purchased her property with the understanding that it was surrounded by
open space.
Joel Cowell, City resident, inquired into the process of opposing the extension of
the 73 toll road. Mayor Swerdlin, Dave Adams, City Manager, and William M.
Huber, Assistant City Manager, provided an overview of how the city could
respond.
Kevin Sanchez, City resident, felt that many more people would have attended
tonight's meeting if notice had been accurate and timely. He strongly opposed
the proposed extension.
Council Comment:
' Council Members agreed that an extension of the 73 toll road as proposed by the
OCTA would not be in the best interests of the City; supported a resolution to
strongly oppose the proposal and ask that the extension of 73 be removed from

future consideration; assured the residents their comments would be forwarded
before the deadline; and apologized for the late notice to residents.
ITEM ADDED TO CITY COUNCIL AGENDA ON 4/5TH VOTE
Council Action: Moved by Council Member Soto, seconded by Mayor pro
tem Allevato, and carried unanimously, 5-0 to add Consideration of Formally
Opposing Orange County Transportation Authority's Concept Alternatives to
Extend the 73 Toll Road to the Future 241 Toll Road to the agenda based on the
finding that since posting of the March 27, 2006, City Council meeting agenda,
new facts have been brought to the attention of the City Council that require
action in order to meet timely submission of public comments concerning the
project's Draft Environmental Impact Report.
Council Action: Moved by Council Member Soto, seconded by Council
Member Hart, and carried unanimously, 5-0, to adopt Resolution No. 06-03-27-
01 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, OPPOSING THE ORANGE COUNTY
TRANSPORTATION AUTHORITY'S LONG RANGE TRANSPORTATION PLAN
FOR THE EXTENSION OF ROUTE 73 TO THE FUTURE ROUTE 241."
ADJOURNMENT
There being no further business, Mayor Swerdlin adjourned the meeting at 8:32 p.m. to
Tuesday, April 4, 2006, at 5:30 p.m. for Closed Session, and 7:00 p.m. for the Public
Business Session, in the City Council Chamber.
