82-0921_CC_Minutes_Regular MeetingSeptember 21, 1982 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA The Regular Meeting of the City Council of the City of San Juan Capistrano, California, was called to order by Mayor Buchheim at 7:01 p.m., in the City Council Chamber, followed by the Pledge of Allegiance to the Flag. Invocation was given by Pastor Gale Smedley, Capistrano Church of the Nazarene. ROLL CALL PRESENT: Lawrence F. Buchheim, Mayor Anthony L. Bland, Mayor pro tem Kenneth E. Friess, Councilman Gary L. Hausdorfer, Councilman Phillip R. Schwartze, Councilman. ABSENT: None STAFF PRESENT: Stephen B. Julian, City Manager; Bob Boone, Accounting Officer; William D. Murphy, Director of Public Works; Larry Lawrence, Senior Planner; James S. Okazaki, City Attorney; Mary Ann Hanover, City Clerk. DEDICATION OF MEETING TO MEMORY OF CARL H. HANKEY (36) Mayor Buchheim dedicated the meeting to the memory of Mr. Carl H. Hankey, who passed away on September 8 at the age of 86. Mr. Hankey was a City resident for over 60 years, kept accurate rainfall measurements during that time and was responsible for implementing the orange grove and citrus industry in the area. He was Chairman of the County Committee for the Ortega Highway; was active in the Community Presbyterian Church, having organized Christian Endeavor; and, was a member of local School Boards for 30 years. CONDOLENCES (TODD HART (36) Mayor Buchheim expressed condolences for the Wyatt Hart family on behalf of the Council, Todd Hart having been severely injured during a recent college football game. PROCLAMATION - UNITED WAY MONTH - OCTOBER, 1982 (71) It was moved by Councilman Schwartze, seconded by Councilman Friess and unanimously carried to authorize the Mayor to proclaim the month of October 1982, as United Way Month in the City of San Juan Capistrano. CONSENT CALENDAR It was moved by Councilman Schwartze, seconded by Councilman Hausdorfer that the staff recommendations be accepted for the following items listed on the Consent Calendar. APPROVAL OF WARRANTS (41) The List of Demands dated September 21, 1982, Warrant Register No. 83-032, in the total amount of $126,143.32, was approved as submitted. 2. CITY TREASURER'S REPORT OF INVESTMENTS (41) The City Treasurer's Report of Investments as of August 31, 1982, in the total amount of $7,924,920.74, was approved as submitted. 3. CITY TREASURER'S REPORT OF 1911 ACT BOND DELINQUENCIES (41) The City Treasurer's Report of 1911 Act Bond Delinquencies as of August 31, 1982, was approved as submitted. 4. CITY TREASURER'S REPORT OF FUND CASH BALANCES (41) The City Treasurer's Report of Fund Cash Balances as of August 31, 1982, was approved as submitted. -2- 9/21/82 5. REPORT OF 2UESTRIAN COMMISSION ACTIONS OF X91 (23) The report dated September 21, 1982, from the Secretary of the Equestrian Commission, regarding actions taken at the meeting of September 13, 1982, was ordered received and filed. 6. RELEASE OF GRADING BOND, PLAZA DEL CAPISTRANO i (49) As set forth in the Report dated September 21, 1982, from the Director of Public Works, the developer has completed all grading work required and the work has been inspected by the Building and Safety Division and found to be in conformance with the approved grading plan and the City's Grading Code. Staff was authorized to release Grading Bond No. 400 Fr 4308 issued by St. Paul Fire and Marine Insurance Company in the amount of $114,000. 7. CLAIM FOR DAMAGES (TURNER) (35) The claim filed on August 19, 1982, by Adrienne and Robin Turner, for damages allegedly sustained on August 3, 1982, was denied and referred to the City's Claim Adjuster, Carl Warren Insurance, as set forth in the report dated September 21, 1982, from the City Clerk. 8. RECORD OF SURVEY, TRACTS 8087 AND 8319, MEREDITH CANYON (85) Record of Survey 95-11 was certified as the official boundary map for Tracts 8087 and 8319 as set forth in the report dated September 21, 1982, from the Director of Public Works. 9. APPROVAL OF APPORTIONMENT OF ASSESSMENTS, ASSESSMENT DISTRICT 78-3 (CHURCH OF THE NAZARENE ITOP SCHOOL (74) As set forth in the report dated September 21, 1982, from the Director of Public Works, the application for apportionment of assessments in Assessment District No. 78-3 submitted by the Church of the Nazarene and ITOP Schools was approved. The City Clerk and Director of Public Works were directed to execute and process the application and amended diagram map. PUBLIC HEARINGS 1. APPEAL OF ZONING ADMINISTRATOR'S DECISION - ZONE VARIANCE 82-20 (BLAGDON) (95) Appeal: An Appeal of the decision made by the Zoning Administrator on July 28, 1982, in denying a request for a zone variance -3- 9/21/82 3 9 2 in conjunction with completion of a playroom within one of the garage parking spaces in the Casitas Capistrano development. Appellant: Grace Blagdon, 30742 Calle Chueca, San Juan Capistrano 92675 Written Communications: _ (1) Report dated September 21, 1982, from the Director of Community Planning and Development submitting the staff analysis that there are no special or unusual circumstances unique to the property that justify granting the variance pursuant to State requirements. (2) Letter dated August 17, 1982, from Charles Collis Lyle, Jr., Attorney at Law, 401 Calle Delicada, San Clemente 92672, submitting the Appeal on behalf of Mrs. Blagdon. (3) Petition signed by approximately 51 owners or residents of the area in opposition to the Appeal. (4) Approximately 19 letters in opposition to granting of the Appeal. (5) Approximately 3 letters in support of granting of the Appeal. Public Hearing: Notice having been given as required by law, Mayor Buchheim opened the Public Hearing and the following persons responded in support of the Appeal: (1) Charles Collis Lyle, Jr., representing Mrs. Blagdon. The following persons responded in opposition to the Appeal: (1) Lyle Robertson, Attorney at Law, representing the Casitas Capistrano Homeowners Association No. II. (2) William O'Conner, President, Casitas Capistrano Homeowners Association No. I. There being no further response, Mayor Buchheim declared the Hearing closed. Denial of Appeal: Following discussion, it was moved by Councilman Schwartze, seconded by Councilman Hausdorfer that the following Resolution be adopted: RESOLUTION NO. 82-9-21-1, ZONE VARIANCE 82-20 (BLAGDON) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, UPHOLDING THE ZONING ADMINISTRATOR'S DECISION TO DENY ZONE VARIANCE 82-20 (BLAGDON) -4- 9/21/82 393 The motion carried by the following vote: AYES: Councilmen Friess, Hausdorfer, Bland, Schwartze, and Mayor Buchheim NOES: None ABSENT: None The Resolution sets forth the following findings: (1) There are no special circumstances applicable to the property which do not apply generally to other properties in the neighborhood. This property is no different than adjacent properties. (2) The variance is not necessary for the preservation of privileges enjoyed by other properties in the vicinity and under identical zoning classification. No other resident of the City has received a variance approval to modify the garage in such manner so as to reduce the required number of parking spaces. (3) The granting of the variance will contribute to a property development which may be materially detrimental to the public welfare or injurious to the property improvements in the vicinity in that it could contribute to the existing parking and street congestion problem. Council urged the residents to resolve the problem in a manner compatible with regulations. 2. VACATION OF PORTIONS OF PUBLIC STREETS, TRACT 9786 (HIDDEN MOUNTAIN VENTURE) (85) Proposal: Vacation of the following streets within Tract 9786: Avenida La Mancha, Paseo Aldonza, Via Dulcinea, Via Cruzada, Via Quixote, Paseo Andante, Via Cervantes, Via Fernando, and Paseo Isabella Applicant: Hidden Mountain Venture, c/o Patrick Development 2643 Fourth Avenue, San Diego 92103. Written Communications: Report dated September 16, 1982, from the Director of Public Works. The Director of Public Works advised that the adjacent property owner, the University of California, had cited certain concerns with the proposal. -5- 9/21/82 394 Public Hearing: Notice having been given as required by law, Mayor Buchheim opened the Public Hearing and the following persons responded: (1) Tim Kruer, representing Hidden Mountain Venture, was present to answer questions. _ There being no further response, the Hearing was closed. Vacation of Streets, Subject to Confirmation: It was moved by Councilman Hausdorfer, seconded by Councilman Friess that the following Resolution be adopted: RESOLUTION NO. 82-9-21-2, VACATION OF PORTIONS OF JUAN CAPISTRANO, CALIFORNIA, ORDERING THE VACATION AVENIDA LA MANCHA, PASEO ALDONZA, VIA DULCINEA, VIA CRUZADA, VIA QUIXOTE, PASEO ANDANTE, VIA CERVANTES, FERNANDO AND PASEO ISABELLA The motion carried by the following vote: AYES: Councilmen Friess, Hausdorfer, Bland, Schwartze, and Mayor Buchheim NOES: None ABSENT: None OF VIA The City Clerk was directed to forward the Resolution to the Orange County Recorder, following confirmation from the Director of Public Works. 3. AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE - REGULATION OF COLOR AND REFLECTIVITY OF NEW CUSTOM HOMES (INTRODUCTION (55) Proposal: An amendment to Section 9-3.505 of the Municipal Code establishing standards and procedures for review of high -visibility custom homes by the Environmental Review Board. The items subject to such review would be color of building walls and reflectivity of exposed exterior surfaces. Applicant: This was a City -initiated proposal. Written Communications: Report dated September 21, 1982, from the Director of Community Planning and Development forwarding the recommendation of approval made by the Planning Commission on August 24, 1982. -6- 9/21/82 =� 95 Public Hearing: Notice having been given as required by law, Mayor Buchheim opened the Public Hearing; and, there being no response, declared the Hearing closed. Approval of Amendment: It was moved by Councilman Bland, seconded by Councilman Friess that the following Ordinance be introduced: ORDINANCE NO. 472, COLOR AND REFLECTIVITY OF HIGH -VISIBILITY CUSTOM HOMES - AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, AMENDING SECTION 9-3.505 OF THE MUNICIPAL CODE, ADDING PROVISIONS REGARDING THE COLOR AND REFLECTIVITY OF HIGH -VISIBILITY CUSTOM HOMES The motion carried by the following vote: AYES: Councilmen Friess, Hausdorfer, Bland, Schwartze, and Mayor Buchheim NOES: None ABSENT: None 4. PROPOSED AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE - PENNANTS AND DIRECTIONAL SIGNS FOR NEW RESIDENTAL (25) Proposal: Consideration of an amendment to Section 9-3.603 of the Municipal Code to provide more effective directional identification of new residential developments in the City for the benefit of the traveling public. Applicant: This was a City -initiated proposal in response to a request of Thomas Jenks, Spinnaker Development Company. Written Communications: Report dated September 21, 1982, from the Director of Community Planning and Development forwarding the recommendation against adoption made by the Planning Commission on August 24, 1982. Public Hearing: Notice having been given as required by law, Mayor Buchheim opened the Public Hearing and the following persons responded: (1) Collene Campbell, Chairman of the Planning Commission, clarified that it was her personal recommendation that further consideration be given to identification of hard -to -find developments and not that of the full Commission. -7- 9/21/82 396 (2) Ann Schauwecker, Paseo Don Jose, spoke in opposition to the proposed amendment. (3) Carolyn Nash, representing San Juan Beautiful, Inc., P.O. Box 301, spoke in opposition to the proposed amendment. There being no further response, Mayor Buchheim closed the Public Hearing with the right to re -open at any time. Discontinuance of Consideration: Council noted that no indications of support had been received from developers and noted difficulties inherent in attempting to resolve current problems with home sales through legislation. It was moved by Councilman Bland, seconded by Councilman Friess and unanimously carried that no action be taken with regard to adoption of the proposed Code amendment. 5. AMENDMENT TO TITLE 6 OF THE MUNICIPAL CODE - OF THE INDUSTRIAL WASTE CONTROL PROGRAM (INT (79) Proposal: An amendment to Title 6 of the Municipal Code to add Chapter 9, Sections 01 through 12 to establish regulations for pre-treatment of industrial waste, pursuant to State and Federal funding conditions for the SERRA Treatment Plant. Applicant: This was a City -initiated Public Hearing. Written Communications: Report dated September 21, 1982, from the Director of Public Works. Public Hearing: Notice having been given as required by law, Mayor Buchheim opened the Public Hearing and there being no response, closed the Hearing with the right to reopen at any time. CONSULTANT'S REPORT ON FEES AND FINAN( SERVICES INSTITUTE) (41) Written Communications: Report dated September 21, 1982, from the City Manager forwarding the report submitted by Management Services Institute regarding the cost of providing municipal services and sources of revenue. Adjourned Council Meeting: There was a concurrence of Council that a meeting be scheduled for Thursday, September 30, 1982, at 7:00 p.m., for a presentation and discussion of the consultant's report. DIRECTOR OF PUBLIC WORKS 1. ADJUSTMENT TO SOLID WASTE COLLECTION RATE COLLECTION (SOLAG DISPOSAL) (45) Written Communications: Report dated September 21, 1982, from the Director of Public Works regarding the impacts of gate fees to be instituted at -11- 9/21/82 2. County landfills effective October 11, 1982. Residential rate increases of 950 per month and commercial increases of $4.50 per month are proposed. Setting of Public Hearing Date: It was moved by Councilman Schwartze, seconded by Councilman Friess and unanimously carried to set a public hearing for the meeting of October 5, 1982, at 7:00 p.m, in the City Council Chamber for consideration of the proposed rate increases. SERRA DISASTER LOAN, PROJECT COMMITTEE NO. 2 (79) Written Communications: An additional agenda item dated September 21, 1982, from the Director of Public Works regarding responsibility for payment of expenses incurred by SERRA due to 1980 flooding conditions and terms for repayment of the loan. Approval of Payment: It was moved by Councilman Hausdorfer, seconded by Councilman Schwartze to approve the payment of the City's proportionate share of the SERRA Disaster Fund bank loan interest of $5,885.98, payable from the Sewer Enterprise Fund, Project Committee No. 2. COMMISSION, BOARDS, COMMITTEES PLANNING COMMISSION REPORT OF MEETING OF SEPTEMBER 14, 1982 (67) The report of Actions taken by the Planning Commission at meeting of September 14, 1982, was ordered received and filed. COUNCIL ACTIONS APPOINTMENT OF DELEGATE AND ALTERNATE TO THE ORANGE COUNTY HEALTH PLANNING COUNCIL (59) Written Communications Report dated September 7, 1982, and resubmitted September 21, 1982, forwarding applications received for appointment as Delegate and Alternate representatives to the Orange County Health Planning Council. It was moved by Councilman Hausdorfer, seconded by Councilman Friess and unanimously carried to appoint Barbara Adams as Delegate and David Hanson as Alternate representatives to the Orange County Health Planning Council. -12- 9/21/82 401 COUNCIL REMARKS AND COMMITTEE REPORTS 1. NEWSPAPER COVERAGE (34) Council welcomed Keith Thursby, Daily Sun Post newspaper, who has been assigned to report City activities. A letter of appreciation is to be written to Jean Olswang, who formerly covered the City for the Sun Post. 2. ORANGE COUNTY WASTE MANAGEMENT COMMISSION (45) Councilman Friess cited a memorandum dated September 10, 1982, regarding formulation of a County Waste Management Commission. Recommendation for Appointment: It was moved by Councilman Friess, seconded by Councilman Bland and unanimously carried that Councilman Schwartze and Mr. Tom Trulis be recommended for appointment to the Commission. 3. PARKING OF RECREATIONAL VEHICLES (MISSION GLEN) (63) Councilman Friess cited a letter dated September 8, 1982, from David Hanson, President, Mission Glen Homeowners Association, regarding parking of recreational vehicles. There was a concurrence of Council that the City Manager and Director of Public Works respond to the letter. 4. CABLE TELEVISION SERVICES (43) Councilman Schwartze cited a letter dated September 17, 1982, from TM Cablevision and advised that franchise rules and regulations indicate that approval is required for implementation of subscriber television. Mr. Schwartze also indicated that Storer Cable Television had experienced approximately 19 outages during the past 30 days. 5. REQUEST FOR SCHOOL CROSSING GUARDS DEL OBISPO AND MARCO FORSTER SCHOOLS) (78) Mayor Buchheim noted that he had been advised of a request by the Parent Teachers Organization for implementation of crossing guards at Camino del Avion and Del Obispo Street. The request will be considered at an upcoming Traffic and Transportation Commission meeting. 6. REQUEST FOR ENFORCEMENT OF LEASH LAW REGULATIONS (70) Mayor Buchheim cited a letter dated September 18, 1982, from Priscilla C. Gehrig, 31942 Avenida Evita, regarding damage to property caused by dogs running loose and requested that leash law enforcement be increased. -13- 9/21/82 402 7. SOUTHERN CALIFORNIA CITY CLERKS ASSOCIATION (31) Mayor Buchheim commended the City Clerk for the meeting of the Southern California City Clerks Association held in the City on September 16, 1982.
