ADJOURNED REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA

The Adjourned Regular Meeting of the City Council of the City
of San Juan Capistrano, California, was called to order by
Mayor Schwartze at 6:00 P.M., in the City Council Chamber.
ROLL CALL PRESENT: Phillip R. Schwartze, Mayor
Lawrence F. Buchheim, Mayor pro tem
Anthony L. Bland, Councilman
Gary L. Hausdorfer, Councilman
ABSENT: Kenneth E. Friess, Councilman
(Arrived at 6:07 P.M.)
STAFF PRESENT: Stephen B. Julian, City Manager; James S. Okazaki,
City Attorney; Mary Ann Hanover, City Clerk.
CLOSED SESSION
Council recessed to closed session at 6:01 P.M. for discussion of
legal matters, the City Clerk being excused therefrom, and
reconvened at 6:18 P.M.
COUNCIL ACTIONS
1. GREGORY, ET AL., vs. CITY (RANCHO DEL AVION/RANCHO
ALIPAZ MOBILE HOME PARKS)
(25) It was moved by Councilman Hausdorfer, seconded by Councilman
(35) Buchheim and unanimously carried to authorize the City Attorney
to prepare an Appeal of the ruling made by Judge Crosby on
December 2, 1981, and to authorize filing of a Writ of
Supersedeas.
2. HEARING ON PETITION - MOTION TO TABLE
(RANCHO ALIPAZ MOBILEHOME PARK)
(25) It was moved by Councilman Friess, seconded by Councilman
Hausdorfer and unanimously carried to table consideration of
this matter pending action on the above Appeal.
3. REPORT OF JUDICIAL ACTION
The City Attorney informed Council that Judge Crosby had
determined that the State of California was the regulatory
body for rent increases and, therefore, City Ordinance No. 439
had been pre-empted. The purpose of the Writ of Supersedeas
would be to re -activate Ordinance No. 439 pending the findings
of the Appellate Court.

ADJOURNMENT
There being no further business before the Council, the
meeting was adjourned at 6:25 P.M. to the next regular
meeting date of Tuesday, December 15, 1981, at 7:00 P.M.
in the City Council Chamber.
