86-0401_CC_Minutes_Regular Meeting357 APRIL 1, 1986 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA The Regular Meeting of the City Council of the City of San Juan Capistrano, California, was called to order by Mayor Schwartze at 7:05 p.m., in the City Council Chamber, followed by the Pledge of Allegiance to the Flag. Invocation was given by Pastor Arch Rutherford, Coast Bible Church. ROLL CALL PRESENT: Phillip R. Schwartze, Mayor Gary L. Hausdorfer, Mayor pro tem Anthony L. Bland, Councilman Lawrence F. MINUTES Regular Meeting of March 18, 1986: It was moved by Councilman Buchheim, seconded by Councilman Hausdorfer, that the Minutes of the Regular Meeting of March 18, 1986, be approved as submitted. The motion carried by the following vote: AYES: Councilmen Friess, Bland, Buchheim, Hausdorfer, and Mayor Schwartze NOES: None ABSENT: None MOTION TO READ BY TITLE ONLY It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim, that all Ordinances be read by title only. The motion carried by the following vote: AYES: Councilmen Friess, Bland, Buchheim, Hausdorfer, and Mayor Schwartze NOES: None ABSENT: None -1- 4/1/86 3 5 8 PRESENTATIONS AND COMMENDATIONS 1. PROCLAMATION - SUPPORTING Written Communications: Report dated April 1, 1986, from the City Clerk, advising that Joseph Inch, Vice Chairman of the State Department of Parks and Recreation, Recreational Trails Committee, had requested that the City join with Governor Deukmejian in supporting State -Wide Trail Days on April 19, and 20, 1986. Approval of Proclamation: Mayor Schwartze read the Proclamation and, with the consensus of Council, proclaimed April 19, 1986, and April 20, 1986, as Trail Days in San Juan Capistrano. Ilse Byrnes, Chairman of the Equestrian Commission, was present to accept the Proclamation. 2. EMPLOYEE RECOGNITION - RAYMUNDO BECERRA (500.1) Written Communications: Report dated April 1, 1986, from the Assistant to the City Manager, advising that a plaque had been prepared for Raymundo Becerra, a long-term employee who recently submitted his resignation. Mayor Schwartze stated the plaque had been prepared in recognition of Mr. Becerra's 13 years of service to the City. Mr. Becerra was present to receive the plaque and Council expressed appreciation for his work on a multitude of City projects. CONSENT CALENDAR It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim, that the staff recommendations be accepted for the following items listed on the Consent Calendar. APPROVAL OF WARRANTS (202.2) The List of Demands dated March 26, 1986, Warrant Register No. 86-092, in the total amount of $168,259.41, was approved as submitted. 2. CITY TREASURER'S REPORT OF FUND CASH BALANCES (201.20) The City Treasurer's Report of Fund Cash Balances as of February 28, 1986, in the total amount of $12,100.19, was approved as submitted. -2- 4/1/86 3. REPORT OF CULTURAL ARTS AND HERITAGE COMMISSION ACTIONS 3 5 ., 90 A The Report dated April 1, 1986, from the Secretary of the Cultural Arts and Heritage Commission, regarding actions taken at the meeting of March 11, 1986, was ordered received and filed. 4. REPORT OF PARKS AND RECREATION COMMISSION ACTIONS (138.4) The Report dated April 1, 1986, from the Secretary of the Parks and Recreation Commission, regarding actions taken at the meeting of March 17, 1986, was ordered received and filed. 5. APPEAL OF PLANNING COMMISSION DECISION APPROVING ARCHITECTURAL CONTROL 78-1, MODIFICATION OF PHASE II TO SITE As set forth in the report dated April 1, 1986, from the City Clerk, a Hearing was scheduled for the meeting of April 15, 1986, to consider the appeal filed by Albert F. Simmons, Vice -Chairman of the San Juan Mobile Estates Residents Association, in conjunction with the February 25th Planning Commission approval of modification to the Phase II Site Plan for Architectural Control 78-1. 6. PROCLAMATION - TRAFFIC SAFETY WEEK, MAY 18, 1986, THROUGH MAY 24, 1986 (114.2) As set forth in the report dated April 1, 1986, from the City Clerk, the week of May 18, 1986, through May 24, 1986, was proclaimed Traffic Safety Week in the City, pursuant to a request received from Peter O'Rourke, the Governor's Highway Safety Representative. 7. APRIL 8, 1986, MUNICIPAL ELECTION STATUS REPORT (406.62) The status report dated April 1, 1986, from the City Clerk, regarding the April 8, 1986, municipal election was ordered received and filed. 8. CONTINUATION OF CONSIDERATION - GENERAL PLAN As set forth in the report dated April 1, 1986, consideration of General Plan Amendment 86-2B was continued to the City Council meeting of May 6, 1986, for inclusion with additional amendment items. 9. CITY-WIDE CLEAN-UP WEEK, APRIL 20, 1986, THROUGH APRIL 26, 1986 (SOLAG) (905.2) As set forth in the report dated April 1, 1986, the week of April 21 through 26, 1986, was designated as City -Wide Clean -Up Week. -3- 4/1/86 300 PUBLIC HEARINGS PERMIT - "RIDE Proposal: Consideration of a request for a parade permit to conduct a Bike-a-Thon on Sunday, April 27, 1986, from 11:00 a.m., to 4:00 p.m., to benefit cancer research at St. Judes Children's Hospital. The proposed route will begin at Acu Canyon Park and utilize streets in the Alto Capistrano, Meredith Canyon, and Connemara developments. Applicant: Carol and Jim Curwood, South County Cyclery, 32302 Camino Capistrano, San Juan Capistrano. Written Communications: Report dated April !—,-1986, from the Director of Public Works, forwarding the proposed route and a recommendation of approval. The report advised that the Sheriff's Department was aware of the event and would monitor its activity. Since the event was not a race, no street closures or traffic delays were anticipated and impacts to City streets would be minimal. Councilman Hausdorfer inquired whether Homeowner Associations in the area had been notified and was advised that Public Hearing Notices had been posted and published and specific notification had been forwarded to the Sheriff and Fire Departments and Homeowner Associations. He suggested that as a matter of policy, Homeowner Associations should be notified of any matter affecting their area. Public Hearing: Notice having been given as required by law, Mayor Schwartze opened the Public Hearing and, there being no response, closed the Hearing with the right to re -open at any time. Approval of Parade Permit: It was moved by Councilman Hausdorfer, seconded by Councilman Buchheim, and unanimously carried to approve the Parade Permit for the South County Cyclery's "Jack Latham Memorial Ride Against Cancer" on Sunday, April 27, 1986, _ subject to the conditions that all entrants be required to obey all traffic control devices and all streets be left in a clean condition after the event. RECESS AND RECONVENE Council recessed at 7:21 p.m., to convene the San Juan Capistrano Community Redevelopment Agency, and reconvened at 7:23 p.m. -4- 4/1/86 361 ADMINISTRATIVE ITEMS CITY MANAGER 1. LEASE OF PUBLIC LANDS POLICY (110.3/708.1) Written Communications: Report dated April 1, 1986, from the City Manager, forwarding a Council Policy regarding the lease of public lands. The policy would be used as a guideline for evaluating proposed uses. Requests for lease of public lands would be submitted to the City Manager's Office for analysis and review. If the use was deemed unobjectionable, the applicant would begin the normal City processes for project approval. The City Manager made an oral report, advising that the policy would apply to long-term use proposals for land, such as park property, which is not fully developed, or property which has been vacant for a period of time. Councilman Hausdorfer initiated discussion regarding involvement of the Council in the process, citing concern that Council should be involved in a long-term lease request, particularly one including cost -of -living adjustments, etc. There was a consensus of Council to modify the last sentence of the Policy to add a provision that upon being found unobjectionable by the City Manager's Office, the project would be reviewed by Council prior to beginning the City processes for project approval. Approval of Policy as Amended: It was moved by Councilman Friess, seconded by Councilman Hausdorfer, and unanimously carried to approve the Lease of Public Lands policy, with the clarification regarding Council review, and to direct staff to include the policy in the Council Policy Manual. RATIFICATION OF EQUESTRIAN STUDY COMMITTEE APPOINTMENTS 705.7 Written Communications: Report dated April 1, 1986, from the Assistant City Manager, forwarding a list of persons selected to serve on the Equestrian Study Committee. The report advised that the first meeting will be set for early April, with an anticipated completion date of May 30, 1986. Ratification of Committee Members: It was moved by Councilman Friess, seconded by Councilman Buchheim, and unanimously carried to ratify appointment of the following persons to the Equestrian Issues Study Committee: Jerry Harris - Western Heritage Association Jim Miles - Western Heritage Association -5- 4/1/86 362 DeeDee Gates - Stable Operators Robert Davies - Planning Commissioner Ilse Byrnes - Equestrian Commissioner Duke Hallan - Parks & Recreation Commissioner Tom Erin - Rancho Alipaz Homeowners Association Dave Kramer - Hidden Mountain Homeowners Association First Meeting Date: Councilman Friess advised that he and Councilman Buchheim would attend the first meeting, and there Council to direct staff to prepare notices meeting would be held on April 9th at 6:00 Conference Room. DIRECTOR OF PUBLIC WORKS 1. - PASEO was a consensus of that the first p.m., in the ION. PARCEL Written Communications: Report dated April 1, 1986, from the Director of Public Works, recommending acceptance of an easement from the Community Redevelopment Agency for the 200 -foot northerly extension of Paseo Adelanto at Del Obispo Street, pursuant to Resolution 83-11-15-1, which required the developer of the Las Hadas project to provide adequate traffic circulation by improving Paseo Adelanto. Acceptance of Easement: it was moved by Councilman Bland, seconded by Councilman Buchheim, and unanimously carried to accept the easement deed for street, highway, and utility purposes from the Community Redevelopment Agency for the northerly extension of Paseo Adelanto. The City Clerk was authorized to forward the deed to the Orange County Recorder's Office. COUNCILMANIC ITEMS FOOTHILL/EASTERN TRANSPORTATION CORRIDOR (801.7) Councilman Hausdorfer advised he had attended a meeting of the Operations Committee of the Foothill/Eastern Transportation Corridor on March 31st. The major issue was the bottleneck connection between the Corridor and the 55, 57, and Garden Grove Freeways. He noted that an information meeting had been scheduled for April 16, 1986, at 7:30 p.m., at Marco Forster Junior High School. 2. SAN JUAN CREEK CHANNEL (906.2) Councilman Hausdorfer noted a memorandum dated March 24, 1986, regarding the San Juan Creek Channel, stating that the issue was a sensitive one in terms of County treatment of the channel versus City treatment. He requested that Council be kept informed of the item. 4/1/86 363 3. HERITAGE FESTIVAL (115.5) Councilmen Hausdorfer and Friess and Mayor Schwartze expressed appreciation to City staff and those involved in the Heritage Festival activities, stating that the 10K run and Community Picnic had been well -attended. Councilman Friess expressed appreciation to City crews for clean-up activities following the Rodeo and Swallows Day Parade. Councilman Buchheim advised that a Boy Scout troop had gathered trash and suggested consideration of a commendation. 4. TOWN HALL FORUM (105.1) Councilman Hausdorfer advised that Congressman Packard would be conducting a Town Hall forum on April 2nd at San Juan Elementary School, beginning at 7:00 p.m. 5. PAROLE CONDITIONS (108.1) It was moved by Councilman Bland and seconded by Councilman Hausdorfer to prepare a resolution supporting legislation which would allow the Governor to review decisions of the State Parole Board with regard to release on parole of convicted killers. Following discussion, the motion was modified to direct that a letter of support be prepared for the Mayor's signature. The motion carried unanimously. Councilman Hausdorfer requested that Mr. and Mrs. Campbell receive a copy of the letter. EAGLE SCOUT COURT OF HONOR (114.1) Councilman Bland was advised that Mayor Schwartze will attend a Court of Honor for Eagle Scouts on April 6th. AMTRAK (809.2) Councilman Bland was advised that arrangements were being made with regard to a program whereby Amtrak railroad cars would be named for cities along the Amtrak route. 8. GOOD FRIDAY SERVICES Councilman Bland advised he had represented the City at the first City-wide Good Friday services at the Capistrano Valley Church on March 25th. 9. LEAGUE OF CALIFORNIA CITIES/CABLE TELEVISION (106.15/417.3) Mayor Schwartze advised that on April 10th he would discuss a resolution regarding Cable TV with the Resolutions Chairman of the League of California Cities. -7- 4/1/86 364 10. JOINT/SEVERAL LIABILITY (215.1) Mayor Schwartze advised that he would address the Kiwanis regarding Joint and Several Liability at their meeting on April 3rd at 7:00 a.m. CLOSED SESSION Council recessed to a Closed Session at 7:44 p.m., for discussion of personnel matters, the City Clerk being excused therefrom, and reconvened at 9:25 p.m. ADJOURNMENT There being no further business before the Council, the meeting was adjourned at 9:25 p.m., to the next regular meeting date of Tuesday, April 15, 1986, at 7:00 p.m., in the City Council Chamber.
