88-0209_CC_Minutes_Adjourned Regular Meeting89 FEBRUARY 9, 1988 ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA The Adjourned Regular Meeting of the City Council of the City of San Juan Capistrano, California, was called to order by Mayor Bland at 7:05 p.m., in the City Council Chamber. ROLL CALL PRESENT: Anthony L. Bland, Mayor Kenneth E. Friess, Councilman Gary L. Hausdorfer, Councilman Phillip R. Schwartze, Councilman ABSENT: Lawrence F. Buchheim, Mayor pro tem STAFF PRESENT: Stephen B. Julian, City Manager; Glenn Southard, Assistant City Manager; Mary Ann Hanover, City Clerk; John R. Shaw, City Attorney; Robert G. Boone, Director of Administrative Services; William D. Murphy, Director of Public Works; Thomas G. Merrell, Director of Community Planning and Development; Cheryl Johnson, Recording Secretary. MOTION TO READ BY TITLE ONLY It was moved by Councilman Hausdorfer, seconded by Councilman Schwartze, that all Ordinances be read by title only. The motion carried by the following vote: AYES: Councilmen Schwartze, Friess, Hausdorfer, and :Mayor Bland NOES: None ABSENT: Councilman Buchheim PUBLIC HEARINGS 1. WESTSIDE ANNEXATION NO. 2 - PROTEST HEARING (620.20) Proposal: Protest hearing held pursuant to State law to receive input from residents and property owners within the proposed annexation area. LAFCO approved the proposed annexation of approximately 200 acres located on the City's western ridgeline and known as the Bear Brand Ranch tracts 9880 and 9390, on November 18, 1987. Applicant. This was a City -initiated Public Hearing. -1- 2/9/88 WO Written Communications: Report dated February 9, 1988, from the Assistant City Manager, discussing the issues raised by property owners in the area and the City's response to those concerns. The concerns included the possibility of higher building fees; treatment of plans in process with the County; and, City development standards, such as building color and height, outdoor lighting and tennis court construction. In each instance, regulations were adopted which clarify the City's position. The report noted that if more than 50% of the registered voters living within the annexation area protest, the annexation must be terminated and abandoned. If 25% to 50% of the registered voters protest, or if at least 25% of the number of landowners owning at least 25% of the assessed valuation protest, an election must be held to confirm the annexation. Introduction/Report by Staff: Mayor Bland advised that the meeting had been called specifically for review of the proposed annexation, and noted the procedures to be followed during the meeting. The Assistant City Manager made an oral report, noting that the area was completely within the City's sphere of influence. Annexation would provide City jurisdiction over an area which contributes substantial runoff into the City's storm drainage system and over the western viewshed. He advised that 23 written protests had been received and were on file with the City Clerk. Public Hearing: Notice having been given as required by law, Mayor Bland opened the Public Hearing and the following person spoke in opposition to the proposed annexation: (1) Dean Dawson, 6 Burning Tree. There being no further response, Mayor Bland closed the Hearing with the right to re -open at any time. Discussion ensued regarding the need to verify signatures of registered voters who had filed protests. The City Attorney recommended that the Hearing be re -opened and continued to the meeting of March 1, 1988, at which time additional protests or withdrawals could be considered. Continuation of Hearing: Mayor Bland re -opened the Public Hearing and it was moved by Councilman Hausdorfer, seconded by Councilman Friess and unanimously carried to continue the Hearing to the meeting of March 1, 1988. SA 2/9/88 ADJOURNMENT There being no further business before the Council, the meeting was adjourned at 7:15 p.m., to the next regular meeting date of Tuesday, February 16, 1988, at 7:00 p.m., in the City Council Chamber.
