SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL EXECUTIVE SESSION MEETING
Mayor Hart called the November 7, 2023, Special Executive Session meeting of the
City Council to order at 3:33 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Howard Hart, Mayor Pro Tem Sergio
Farias, and Council Members Troy Bourne, John Taylor, and John Campbell.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a.Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at 29943 Camino Capistrano (Roger Y. Williams Swanner
House), 30291 Camino Capistrano, APN 121-050-18, 121- 050 - 21 (Northwest
Open Space) Negotiating party: Legacy Ranch Partners LLC.
b.Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for license of a portion
of property located at 31421 La Matanza Street, also known as TJ Meadow
Building. Negotiating party: George Peppas, Chamber of Commerce.
c. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with Legal Counsel pertaining to existing litigation in the matter of
Pacifica San Juan Community Association v. City of San Juan Capistrano,
Matt Ottoson. OC Superior Court, Case No. 30-2023-0135855 1-CU-WM-CJC.
d.Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation – significant
exposure to litigation (1 item)
e.Pursuant to Government Code Section 54956.9(d) (4), the City Council conferred
with Legal Counsel to discuss initiation of litigation (1 item).

ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Council Member Taylor
announced recusing from executive session A because his son rents from him and
works for the applicant.
ADJOURNMENT:
There being no further business, Mayor Hart adjourned the meeting to Tuesday,
November 7, 2023, at 5:00 p.m. for a Public Business Session, in the City Council
Chamber at the Nydegger Building – 31421 La Matanza Street.
