01-0829_CC_Minutes_Adjourned Regular MeetingMINUTES August 29, 2001 SAN JUAN CAPISTRANO CITY COUNCIL Mayor Hart called the Adjourned Regular Meeting of the City Council of the City of San Juan Capistrano, California, to order at 7:02 p.m. in the City Council Chamber. Council Member Bathgate led the Pledge of Allegiance to the Flag. Mayor pro tem Swerdlin gave the Invocation. ROLL CALL COUNCIL MEMBERS PRESENT: Diane Bathgate, John Gelff, Mayor pro tem David Swerdlin and Mayor Hart. COUNCIL MEMBERS ABSENT: None STAFF PRESENT: George Scarborough, City Manager, Ken Smart (for John Shaw), City Attorney; Meg Monahan, City Clerk. ORAL COMMUNICATIONS: None COUNCILMANIC ITEMS COLLENE CAMPBELL APPOINTED INTERIM COUNCIL MEMBER, FILLING THE VACANT COUNCIL SEAT; AND RESOLUTION NO. 01-8-29-1 CALLING A SPECIAL ELECTION FOR NOVEMBER 5, 2002 ADOPTED (610.50) Description: A City Council seat became vacant by the resignation of John Greiner, effective on August 1, 2001. At a Special Meeting on August 16, 2001, the Council established a process to accept applications from residents interested in filling the vacant Council seat and consider making an appointment on August 29, 2001. Applications were accepted until 5:00 p.m. August 27, 2001. Fourteen applications were received. Written Communications: Report dated August 29, 2001 from Meg Monahan, City Clerk. Applications were received from Michael Eggers, Derek Reeve, Joe Soto (Aug 20 & 27), Matthew W. Gaffney, Richard Hill Adams, Angela Duzich, Sheldon Cohen, Jack Campbell, Collene (Thompson) Campbell, Thomas Anthony Forster, Thomas Russell Lytle, Tamara Jean McIntyre, Bill Campbell, and Cloyce Allen Kelly. _ Oral Presentation: Mayor Hart noted a revision to the Alternate Actions on the Agenda Item report of August 29, 2001, striking alternative number five (5), as an available alternative for Council's action. cc Minutes 1 08-29-01 Public Comment: Jack Heath, 26000 Avenida Aeropuerto #225, encouraged Council to select an appointee from candidates of the November 2000 election. Michael D. Thorpe, 26000 Avenida Aeropuerto, felt that candidates from the November 2000 election were known to the voters, therefore most eligible for appointment. Trish B. Hodges, 26000 Avenida Aeropuerto #221, suggested that a recall effort would be initiated for the four sitting Council Members. Bobbie Decker, 26000 Avenida Aeropuerto #49, felt that Council was not responding to issues related to traffic and development. She asked that an appointment be made from the candidates of the November 2000 election. Lucienne Austin, 26000 Avenida Aeropuerto #50, was concerned with pro - development. She supported a recall effort if Council did not select an appointee from the un -elected candidates of the November 2000 election. Council Comments: Council Member Gelff indicated that he had been actively listening to comments and concerns of community members and maintaining the direction of his political ideology. He related the experience of receiving a threatening telephone call. Council Member Bathgate supported making an interim appointment to fill the vacant seat and calling a special election in November 2002, as the Council had not budgeted for a March 2002 election. She commented regarding the number of talented and dedicated people who had applied for the position. Mayor pro tem Swerdlin remarked regarding the many talented individuals willing to serve the community. He felt that issues related to cultural diversity, traffic, water and development required strength and experience. He suggested applicants Sheldon Cohen, Joe Soto and Collene Campbell were the most qualified applicants. Mayor Hart thanked the fourteen individuals who had applied and those who supported their applications. He indicated that four seats would be up for election in November 2002, providing voters with the opportunity to elect Council Members. Council Action: Moved by Council Member Bathgate, seconded by Mayor Hart and carried unanimously, 4/0, to appoint Collene Campbell as interim Council Member and adopting Resolution No. 01-8-29-1 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CC Minutes -2- 08-29-01 CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 5, 2002 FOR THE ELECTION OF A COUNCIL MEMBER TO FILL THE VACANCY AS REQUIRED BY THE PROVISIONS OF LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES."
