23-1003_CC_Minutes_Regular Meeting1 10/03/2023 MINUTES October 3, 2023 SAN JUAN CAPISTRANO CITY COUNCIL REGULAR MEETING BUSINESS SESSION: Mayor Hart called the Regular meeting of October 3, 2023, of the City Council of the City of San Juan Capistrano to order at 5:16 p.m. Mayor Pro Tem Farias led the Pledge of Allegiance and Council Member Bourne gave the Invocation. ROLL CALL: COUNCIL MEMBERS PRESENT: Mayor Howard Hart, Mayor Pro Tem Sergio Farias, and Council Members Troy Bourne, John Taylor, and John Campbell. COUNCIL MEMBERS ABSENT: None. Agenda items are presented in the originally agendized format for the benefit of the minutes’ reader but were not necessarily heard in that order. CITY CLERK ANNOUNCEMENT: Per Assembly Bill 23, Maria Morris, City Clerk, announced that each Housing Authority Board Member is receiving a $50.00 stipend for conducting the Housing Authority meeting. ORDINANCE NO. 1114 ADOPTED ENTITLED “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING SPECIFIC SECTIONS OF TITLE 8 OF THE SAN JUAN CAPISTRANO REGARDING THE 2022 CALIFORNIA BUILDING CODE AND 2022 CALIFORNIA RESIDENTIAL CODE AND FINDING THE ORDINANCE NOT SUBJECT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT” (450.30) Joel Rojas, Development Services Director, provided an agenda report and responded to questions. 2 10/3/2023 Mayor Hart opened the public hearing and invited public testimony. Council Action: Moved by Council Member Taylor, seconded by Council Member Campbell, and carried unanimously to adopt ORDINANCE NO. 1114 entitled “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING SPECIFIC SECTIONS OF TITLE 8 OF THE SAN JUAN CAPISTRANO REGARDING THE 2022 CALIFORNIA BUILDING CODE AND 2022 CALIFORNIA RESIDENTIAL CODE AND FINDING THE ORDINANCE NOT SUBJECT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.” CONSENT CALENDAR: Council Action: Moved by Mayor Pro Tem Farias, seconded by Council Member Bourne, and carried unanimously to approve consent calendar items E1 through E6, as recommended by staff. TO PERFORM TRAFFIC ENGINEERING SUPPORT SERVICES FOR AN APPROXIMATE FOUR-YEAR TERM BEGINNING OCTOBER 3, 2023, AND ENDING DECEMBER 31, 2027; AND FORMAL BIDDING PROCESS WAIVED PURSUANT TO MUNICIPAL CODE SECTION 3-4.306(E)(3) (600.30) 3 10/3/2023 E6. CITY COUNCIL POLICY 137 – CITY USE OF SOCIAL MEDIA AMENDED TO INCLUDE INSTAGRAM AS AN APPROVED SOCIAL MEDIA PLATFORM (610.30) E7. FULL FEE WAIVER FOR GREAT OPPORTUNITIES IN THE AMOUNT OF $198.64 FOR USE OF DESCANSO PARK FOR A “BIKESTRAVAGANZA” EVENT ON SATURDAY, OCTOBER 14, 2023, APPROVED; FULL FEE WAIVER FOR USE OF DESCANSO PARK TO CONDUCT AN ANNUAL “BIKESTRAVAGANZA” EVENT IN 2024 THROUGH 2028, APPROVED; AND PROPOSED ACTION FOUND EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO STATE CEQA GUIDELINES SECTION 15601(B)(3) (390.30) • Public Comments: Eric Gross, Great Opportunities. Council Action: Moved by Mayo Pro Tem Farias, seconded by Council Member Campbell, and carried unanimously to approve a full fee waiver for Great Opportunities in the amount of $198.64 for use of Descanso Park for a “BikeStravaGanza” event on Saturday, October 14, 2023; approve full fee waiver for use of Descanso Park to conduct an annual “BikeStravaGanza” event in 2024 through 2028; and find that the proposed action is exempt from the California Environmental Quality Act pursuant to State CEQA Guidelines Section 15601(b)(3). ADMINISTRATIVE ITEMS: F1. CITY MANAGER a. CITY MANAGER AUTHORIZED TO FINALIZE AND EXECUTE A ONE-YEAR AMENDMENT TO THE EXISTING AGREEMENT WITH FLOCK SAFETY TO INSTALL TEN ADDITIONAL AUTOMATED LICENSE PLATE READERS AND INSTALL 20 SECURITY CAMERAS AT CITY PARKS, FACILITIES AND TRAFFIC SIGNALS; COMPETITIVE BIDDING PROCESS WAIVED FOR THIS PROCUREMENT PURSUANT TO MUNICIPAL CODE SECTION 3-4.310(E); $150,000 APPROPRIATED FROM THE GENERAL FUND; AND PROPOSED ACTIONS FOUND EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO STATE CEQA GUIDELINES SECTION 15061(B)(3) (600.30/300.30) Matisse Reischl, Assistant City Manager, provided a PowerPoint presentation and responded to questions. Justin Montano, Chief of Police Services, Benjamin Siegel, City Manager, and Alisha Winterswyk, Assistant City Attorney responded to questions. Council Action: Moved by Council Member Taylor, seconded by Council Member Bourne, and carried 4-1 with Mayor Hart opposed to authorize the City Manager to finalize and execute a one-year amendment to the existing agreement with Flock Safety to install ten additional automated license plate readers and install 20 security cameras at City parks, facilities and traffic signals; waive the competitive bidding process for this procurement pursuant to Municipal Code 4 10/3/2023 Section 3-4.310(e); appropriate $150,000 from the General Fund; and find that the proposed actions are exempt from the California Environmental Quality Act pursuant to State CEQA Guidelines Section 15061(b)(3). CITY COUNCIL REPORTS: •Mayor Hart reported attending the Symphony on the Go at Los Rios Park. •Council Member Campbell reported attending the Deputy Haney Flagpole Dedication; and attending the Shea Therapeutic Center BBQ. •Council Member Bourne asked staff to look into Caltrans signs on Ortega Highway pointing direction to the Mission San Juan Capistrano. ADJOURNMENT: There being no further business Mayor Hart adjourned the meeting at 6:43 p.m. to Tuesday, October 17, 2023, at 3:00 p.m. for an Executive Session, and 5:00 p.m. for the public Business Session, in the City Council Chamber at the Nydegger Building – 31421 La Matanza Street.
