SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL EXECUTIVE SESSION MEETING
Mayor Hart called the September 5, 2023, Special Executive Session meeting of the
City Council to order at 3:33 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Howard Hart, Mayor Pro Tem Sergio
Farias, and Council Members Troy Bourne, John Taylor, and John Campbell.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a.Pursuant to Government Code Section 54956.9(d) (4), the City Council conferred
with Legal Counsel to discuss initiation of litigation (2 items).
b.Pursuant to Government Code Section 54956.9 (a), (d)(2), the
City Council conferred with Legal Counsel to discuss anticipated litigation –
significant exposure to litigation (4 items).
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Mayor Pro Tem Farias
announced recusing from one of the items listed under executive session A.
Alisha Winterwyk, Assistant City Attorney, announced that with regard to one of the
items listed under item A, City Council direction was given to participate and support as
amicus curiae to the U.S. Supreme Court – City of Grants Pass vs. Johnson et al case.
ADJOURNMENT:
There being no further business, Mayor Hart adjourned the meeting to Tuesday,
September 5, 2023, at 5:00 p.m. for a Public Business Session, in the City Council
Chamber at the Nydegger Building – 31421 La Matanza Street.
