SAN JUAN CAPISTRANO CITY COUNCIL
EXECUTIVE SESSION MEETING
Mayor Hart called the May 16, 2023, Regular Executive Session Meeting of the
City Council to order at 3:01 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Hart, Mayor Pro Tem Sergio Farias
(arrived after commencement), and Council Members Troy Bourne (arrived after commencement),
John Taylor, and John Campbell.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment for
lease of certain real property described as the Rancho Mission Viejo Riding
Park at San Juan Capistrano generally located at the southwest corner of
Ortega Highway and Avenida La Pata and addressed as 30753 Avenida La
Pata. The property owner is the City of San Juan Capistrano. Negotiating party:
Action Sports Management Group, LLC dba The Ridland Group.
b. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment
concerning certain real property located at portions of APN’s: 666-013-03,
666-013-06, 666-042-10, 666-042-11. Negotiating party: Camino Real
Playhouse.
c. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning price and terms of payment
concerning the City Hall and Permanent Supportive Housing properties located
at 32400 and 32410 Paseo Adelanto, San Juan Capistrano, CA 92675.
Negotiating party: Jamboree Housing Corporation.
d. Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at 31796 El Camino Real,
31872 El Camino Real, 31882 El Camino Real. Negotiating Party: San Juan
Capistrano Performing Arts Center, a California nonprofit corporation.

e.Pursuant to Government Code Section 54956.8, the City Council met with
its Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment for
license of a portion of property located at 31421 La Matanza Street, also known
as TJ Meadow Building. Negotiating party: George Peppas, Chamber of
Commerce.
f.Pursuant to Government Code Section 54956.9(d) (4), the City Council
conferred with Legal Counsel to discuss initiation of litigation (2 items).
g.Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation – significant
exposure to litigation (2 items).
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Mayor Pro Tem Farias
recused himself from one of the F items due to proximity to his residence. Council
Member Taylor recused himself from items D and G, at the advice of the City Attorney.
ADJOURNMENT:
There being no further business, Mayor Hart adjourned the meeting to Tuesday,
May 16, 2023, at 5:00 p.m. for a Public Business Session, in the City Council Chamber
at the Nydegger Building – 31421 La Matanza Street.
