MINUTES FROM THE REGULAR MEETING OF SEPTEMBER 3, 2002, APPROVED AS SUBMITTED 2. CRA WARRANTS DATED SEPTEMBER 5, 2002, IN THE AMOUNT OF $124,000.42 RECEIVED AND FILED (300.30) 3. REPORT OF INVESTMENTS, MONTH ENDING AUGUST 31, 2002, RECEIVED AND FILED (350.30) CRA Minutes 1 10-1-02 4. INVESTMENT POLICY FOR THE SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY FOR FISCAL YEAR 2002-2003 APPROVED; AND, THE AGENCY SECRETARY DIRECTED TO FORWARD THE INVESTMENT POLICY TO THE CALIFORNIA DEBT AND INVESTMENT ADVISORY COMMISSION (350.30) BOARD ACTIONS: C1. MODIFICATION TO THE COMMUNITY ENHANCEMENT HOUSING PROGRAM, RULES, POLICIES AND PROCEDURES APPROVED (32063 PASEO CAROLINE/MCANDREWS) (430.30) Project Description: Community Enhancement Housing Program regulations prevent the transfer or sale of property within a three-year period. This regulation does not address the untimely passing of participants that qualified for program benefits. This situation arose when Joseph McAndrews, Sr., passed away in December 2000, having qualified for the program and living in his unit only 15 months. Heirs to the unit have continued to rent the unit as affordable rental property to a very low- income resident. This is a recommendation to revise program regulations to allow for the transfer of units in the event of a participant's death, subject to the condition the property remains a rental unit available to households below 50% of the area median income, for a minimum of 15 years. Board Action: Moved by Director Gelff, seconded by Director Bathgate and carried unanimously, 4-0, to approve modifications to the Community Enhancement Housing Program Rules, Policies and Procedures; transfer of title of 32063 Paseo Carolina to Joseph P. McAndrews Jr., and Janice McAndrews, husband and wife; and, Executive Director authorized to execute all documents necessary to ensure the transfer of the secured loan and 15 -year rental restrictions.
