SAN JUAN CAPISTRANO CITY COUNCIL
REGULAR EXECUTIVE SESSION MEETING
Mayor Hart called the January 17, 2023, Regular Executive Session Meeting of the
City Council to order at 3:05 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Hart, Mayor Pro Tem Sergio Farias
(arrived after commencement) and Council Members John Taylor, and John Campbell.
COUNCIL MEMBERS ABSENT: Troy Bourne.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the
City Council conferred with legal counsel pertaining to existing litigation in the
matter of City of San Juan Capistrano v. Save Our San Juan, Orange County
Superior Ct. Case No. 30-2022-01297444-CV-MC-CXC.
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for license of certain
real property located at 29943 Camino Capistrano (Roger Y. Williams Swanner
House) Negotiating party: Frontier Real Estate Investments, LLC.
c. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment concerning certain real
property located at La Novia Ave. and San Juan Creek Road (APN: 666-011-27,
666-011-28, 666-013-06, 666-042-10 and 666-042-11). Negotiating party:
San Juan Hills Golf Club, L.P.
d. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for sale of certain real
property located at APN 664-071-01, also known as Mission Trails Stables.
Negotiating party: Paul Valenzuela, Mission Trails Stables.
e. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for lease of certain real
property described as the Rancho Mission Viejo Riding Park at San Juan
Capistrano generally located at the southwest corner of Ortega Highway and
Avenida La Pata and addressed as 30753 Avenida La Pata. The property owner
is the City of San Juan Capistrano. Negotiating party: Action Sports Management
Group, LLC dba The Ridland Group.

f. Pursuant to Government Code section 54957.6, the City Council conferred with its
labor negotiators (Benjamin Siegel, City Manager, and Shelley Velez,
Human Resources Manager) as to the memoranda of understanding with
represented employees, including salaries and fringe benefits. The affected
bargaining units are San Juan Capistrano Classified Employees Association and
San Juan Capistrano Management and Professional Employees Association.
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Council Member Taylor
recused himself from item B due to an economic interest.
ADJOURNMENT:
There being no further business, Mayor Hart adjourned the meeting to Tuesday,
January 17, 2023, at 5:00 p.m. for a Public Business Session, in the City Council
Chamber at the Nydegger Building – 31421 La Matanza Street.
