SAN JUAN CAPISTRANO CITY COUNCIL
EXECUTIVE SESSION MEETING
Mayor Reeve called the September 20, 2022, Executive Session Regular Meeting of the
City Council to order at 3:00 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Derek Reeve, Mayor Pro Tem
Howard Hart, and Council Members John Taylor, Troy Bourne (joined the meeting shortly
after commencement) and Sergio Farias (joined the meeting shortly after commencement).
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS:
• Public Correspondence: Dr. Julie Ryan Johnson, San Juan Capistrano Equestrian
Coalition for items A and B.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met
with real property negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of
payment for license of real property described as the Rancho Mission Viejo
Riding Park at San Juan Capistrano generally located at the southwest
corner of Ortega Highway and Avenida La Pata and addressed as 30753
Avenida La Pata. The property owner is theCity of San Juan Capistrano.
Negotiating party: Action Sports Management Group, LLC dba The Ridland
Group.
b. Pursuant to Government Code Section 54956.9(a) & (d) (1), the
City Council conferred with legal counsel pertaining to existing litigation in
the matter of City of San Juan Capistrano v. Tokio Marine Specialty
Insurance Company, et al., Orange County Superior Ct. Case No. 30-2019-
01061811-CU-IC-CJC.
c. Pursuant to Government Code Section 54956.8, the City Council met
with Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at La Novia Ave. and San Juan
Creek Road (APN: 666-011-27, 666-011-28, 666-013-06, 666-042-10 and
666-042-11). Negotiating party: San Juan Hills Golf Club, L.P.

d. Pursuant to Government Code Section 54956.8, the City Council met with
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at: APN 121-141-25 and 121-141-
26 (City owned portion of Downtown Multi-Modal Lot). Negotiating parties:
SJCM, LLC and SJC Mission Ventures, LLC.
e. Pursuant to Government Code Section 54956.8, the City Council met with
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at 26874 Ortega Highway, 31776
El Camino Real, and 31782 El Camino Real. Negotiating party: 26874
Ortega Highway LLC.
f. Pursuant to Government Code Section 54956.8, the City Council met with
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at: APN: 649-191-04 and 121-160-
21 (City owned portion of Paseo Adelanto). Negotiating party: 31791 Los
Rios Street, LLC.
g. Pursuant to Government Code Section 54956.9(d) (4), the
City Council conferred with Legal Counsel to discuss initiation of litigation
(1 item).
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Council Member Taylor
announced recusing from items D, E and F due to an economic interest.
ADJOURNMENT:
There being no further business, Mayor Reeve adjourned the meeting to Tuesday,
September 20, 2022, to the 5:00 p.m. Public Business Session, in the
City Council Chamber.
