01-1211_ORANGE, COUNTY OF_Right of Entry Agreement10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 0 -.r PM 126-28 Refuse Disposal Station No. 26 (Prima Deshecha Landfill) RIGHT OF ENTRY AGREEMENT THIS IS AN AGREEMENT, made and entered into this 0 day of CCeMb-e r , 2001 by and between the COUNTY OF ORANGE, hereinafter referred to as "COUNTY," and CAPISTRANO VALLEY WATER DISTRICT, hereinafter referred to as "DISTRICT." RECITALS A. DISTRICT finds it necessary to construct a water connector pipeline (the "Project") along the northerly boundary of COUNTY's Prima Deshecha Landfill on COUNTY owned land (the "Property"), which land is described on Exhibit "A" and shown on Exhibit "B" attached hereto. B. DISTRICT desires to acquire from COUNTY and COUNTY desires to convey to DISTRICT easement rights (the "Easement") to the Property. C. DISTRICT and COUNTY have not reached agreement on the value of the Easement. D. DISTRICT has an urgent need to commence the Project. E. COUNTY, having reviewed DISTRICT's plans, is willing to facilitate the Project by granting DISTRICT permission to enter upon the Property prior to DISTRICT acquiring the Easement, as long as such permission does not jeopardize COUNTY's right to compensation under the laws of the State of California. NOW, THEREFORE, the parties hereto mutually agree as follows: 1. COUNTY hereby grants DISTRICT revocable permission to enter upon the Property for the purpose of the Project. 2. Upon COUNTY and DISTRICT reaching agreement as to the value of the Easement or such value being determined by a court of competent jurisdiction and upon payment of said value to COUNTY, COUNTY agrees to convey to DISTRICT and DISTRICT agrees to accept from COUNTY the Easement substantially in the form attached hereto as Exhibit "C." 3. DISTRICT shall, without unnecessary delay, make an offer to acquire the Easement from COUNTY. In the event that by February 1, 2002 COUNTY and DISTRICT have not reached agreement on the value of the Easement, DISTRICT will promptly commence and pursue to completion eminent domain proceedings to acquire the Easement and to have such compensation determined. 4. The term of this Right -of -Entry Agreement shall commence upon the date first written above and shall continue until: a. COUNTY and DISTRICT reach agreement as to the value of the Easement, or such value is determined by a court of competent jurisdiction; and b. Conveyance of Easement by COUNTY is made to DISTRICT and Easement is accepted by DISTRICT. 5. As consideration for this Right -of -Entry, DISTRICT shall pay to COUNTY the legal rate of interest on the agreed upon value or court award computed as prescribed by Code of Civil Procedure Sections 1268.350 and 1268.360 from the date of this agreement to the date payment is received by COUNTY. 6. DISTRICT shall maintain insurance acceptable to COUNTY's Director of Integrated Waste Management Department ("Director IWMD") in full force and effect throughout the term of this Right of Entry Agreement. The policy or policies of insurance maintained by DISTRICT shall provide the following limits and coverages: LIABILITY INSURANCE Coverage Comprehensive General Liability, to include broad form property damage Comprehensive Automobile Liability including non -owned and hired vehicle(s) Workers' Compensation and Employer's Liability Minimum Limits $1,000,000 combined single limit $1,000,000 Combined Single Limit Statutory $1,000,000 Combined Single Limit Insurance shall be in force the first day of the term of this Right of Entry Agreement. Each insurance policy required by this Right of Entry Agreement shall contain the following three clauses: A. "This insurance shall not be cancelled, limited in scope of coverage or non -renewed until after 30 days written notice has been given to the County of Orange, Integrated Waste Management Department (attention: Southern Region), 320 North Flower Street, Santa Ana, California 92703." B. "County of Orange is added as an additional insured as respects operations of the named insured at or from the Property occupied and used by the named insured pursuant to that certain Right of Entry Agreement issued by the County of Orange." C. "It is agreed that any insurance maintained by the County of Orange will apply in excess of, and not contribute with, insurance provided by this policy." DISTRICT agrees to deposit with Director IWMD, before the effective date of this Right of Entry Agreement, certificates of insurance necessary to satisfy Director IWMD that the insurance provisions of this Right of Entry Agreement have been complied with and to keep such insurance in effect and the certificates therefore on deposit with Director IWMD during the entire term of this Right of Entry Agreement. THIS RIGHT OF ENTRY AGREEMENT SHALL AUTOMATICALLY TERMINATE AT THE SAME TIME DISTRICT'S INSURANCE COVERAGE IS TERMINATED. IF WITHIN 10 DAYS AFTER TERMINATION UNDER THIS CLAUSE, DISTRICT OBTAINS AND PROVIDES EVIDENCE OF THE REQUIRED INSURANCE COVERAGE ACCEPTABLE TO DIRECTOR IWMD, THIS RIGHT OF ENTRY AGREEMENT MAY BE REINSTATED, AT THE SOLE DISCRETION OF DIRECTOR IWMD. IF REINSTATED, DISTRICT SHALL PAY $200 TO COVER THE PROCESSING COSTS INCURRED BY COUNTY. DISTRICT agrees that DISTRICT shall not operate on the Property at any time the required insurance is not in full force and effect as evidenced by a certificate or official binder being in the possession of Director IWMD. In no cases shall assurances by DISTRICT, its employees, agents, including any insurance agent, be construed as adequate evidence of insurance. DISTRICT also agrees that upon cancellation, termination, or expiration of CV W D-PrimaD-5.DOC-6/11/01 2- t YI 1 DISTRICT's insurance, that COUNTY may take whatever steps are necessary to interrupt any operation from or on the Property until such time as the Right of Entry Agreement is reinstated by Director IWMD. 2 DISTRICT further agrees to hold COUNTY harmless for any damages resulting from such interruption of business 3 including but not limited to damages resulting from any loss of income or business resulting from COUNTY's action. 4 Director IWMD shall have the right at any time to review the coverage, form, and amount of the insurance required 5 hereby. If, in the opinion of Director IWMD, insurance provisions in this Right of Entry Agreement do not provide adequate protection for COUNTY and for members of the public using the Property, Director IWMD may require 6 DISTRICT to obtain insurance sufficient in coverage, form, and amount to provide adequate protection. Director TWMD's requirements shall be reasonable but shall be designed to assure protection from and against the kind and 7 extent of the risks which exist at the time a change in insurance is required. 8 The procuring of such required policy or policies of insurance shall not be construed to limit DISTRICT's liability hereunder nor to fulfill the indemnification and hold harmless provisions and requirements. 9 DISTRICT may, at DISTRICT's option, self -insure the coverages contained in this section. 10 7. DISTRICT agrees to protect in place COUNTY's existing and future improvements within the Property. 11 DISTRICT shall be solely responsible for the cost of repair or replacement of COUNTY's improvements if such improvements are damaged due to DISTRICT's use of the Property. 12 8. DISTRICT shall be required to obtain any and all permits and/or licenses which may be required in 13 connection with the operation on the Property as set out herein. No permit, approval, or consent given hereunder by COUNTY, in its governmental capacity, shall affect or limit DISTRICT's obligations hereunder, nor shall any 14 approvals or consents given by COUNTY, as a party to this Right -of -Entry Agreement, be deemed approval as to compliance or conformance with applicable governmental codes, laws, rules, or regulations. 15 9. The various headings and numbers herein, the grouping of provisions of this Right of Entry Agreement 16 into separate clauses and paragraphs, and the organization hereof, are for the purpose of convenience only and shall not be considered otherwise. 17 10. This Right of Entry Agreement is the sole and only agreement between the parties regarding the subject 18 matter hereof, other agreements, either oral or written, are void. Any changes to this Right of Entry Agreement shall be in writing and shall be properly executed by both parties. 19 11. DISTRICT agrees no improvements shall be erected, placed upon, operated, nor maintained on the 20 Property, nor any business conducted or carried on therein or therefrom, in violation of the terns of this Right of Entry Agreement, or of any regulation, order of law, statute, bylaw, or ordinance of a governmental agency having 21 jurisdiction. 22 12. COUNTY or its authorized representative shall have the right at all reasonable times to inspect the operation to determine if the provisions of this Right of Entry Agreement are being complied with. 23 13. If any term, covenant, condition, or provision of this Right of Entry Agreement is held by a court of 24 competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions hereof shall remain in full force and effect and shall in no way be affected, impaired, or invalidated thereby. 25 14. The failure of COUNTY to insist upon strict performance of any of the terms, covenants, or conditions of 26 this Right of Entry Agreement shall not be deemed a waiver of any right or remedy that COUNTY may have, and shall not be deemed a waiver of the right to require strict performance of all the terns, covenants, and conditions of 27 the Right of Entry Agreement thereafter, nor a waiver of any remedy for the subsequent breach or default of any term, covenant, or condition of the Right of Entry Agreement. Any waiver, in order to be effective, must be signed 28 by the party whose right or remedy is being waived. Except as otherwise agreed to herein, upon termination of this Right of Entry Agreement, DISTRICT shall redeliver possession of said Property to COUNTY in substantially the same condition that existed immediately prior to DISTRICT's entry thereon, reasonable wear and tear, flood, earthquakes, war, and any act of war excepted. 16. Time is of the essence of this Right of Entry Agreement. Failure to comply with any time requirements of this Right of Entry Agreement shall constitute a material breach of this Right of Entry Agreement. 17. DISTRICT hereby waives all claims and recourse against COUNTY including the right of contribution for loss or damage of persons or property arising from, growing out of, or in any way connected with or related to this Right -of -Entry Agreement except claims arising from the concurrent active or sole negligence of COUNTY, its officers, agents, and employees. DISTRICT hereby agrees to indemnify, hold harmless, and defend COUNTY, its officers, agents, and employees against any and all claims, loss, demands, damages, cost, expenses, or liability costs arising out of the operation, use, or maintenance of the property described herein, and/or DISTRICT's exercise of the rights under this Right -of -Entry Agreement, except for liability arising out of the concurrent active or sole negligence of COUNTY, its officers, agents, or employees, including the cost of defense of any lawsuit arising therefrom. In the event COUNTY is named as co-defendant, DISTRICT shall notify COUNTY of such fact and shall represent COUNTY in such legal action unless COUNTY undertakes to represent itself as co-defendant in such legal action, in which event DISTRICT shall pay to COUNTY its litigation costs, expenses, and attorney's fees. hi the event judgment is entered against COUNTY and DISTRICT because of the concurrent active negligence of COUNTY and DISTRICT, their officers, agents, or employees, an apportionment of liability to pay such judgment shall be made by a court of competent jurisdiction. Neither party shall request a jury apportionment. 18. All notices pursuant to this Right -of -Entry Agreement shall be addressed as set forth below or as either party may hereafter designate by written notice and shall be sent through the United States mail in the State of California duly registered or certified with postage prepaid. If any notice is sent by registered or certified mail, as aforesaid, the same shall be deemed served or delivered 24 hours after mailing thereof as above provided. Notwithstanding the above, COUNTY may also provide notices to DISTRICT by personal delivery or by regular mail and any such notice so given shall be deemed to have been given upon receipt. It is understood and agreed by the parties hereto and their successors and assigns, that said easement and right of way herein granted shall be subject to the following terms and conditions: DEFINITIONS (PM02.1N) "Agreement" means this Easement Deed and Agreement. "GRANTOR" means the County of Orange. Actions to be taken by GRANTOR under this Agreement shall be taken by the Board of Supervisors of the County of Orange which executed this Agreement or its representatives specifically authorized to take such actions under this Agreement. "Director" means the Director, Integrated Waste Management Department of the County of Orange, or upon written notice to GRANTEE, Director's designee or successor. 2. ACTIVE LANDFILL (N) GRANTEE is aware that the Easement Area is located in GRANTOR's Prima Deshecha Landfill, which is an active landfill. 3. CONSTRUCTION AND MAINTENANCE (PMES2.1 N) GRANTEE shall have its initial construction plans approved in writing by GRANTOR's Director prior to commencement of any work; and upon completion of any work, GRANTEE shall immediately notify Director of such completion. Director's approval of GRANTEE's initial construction plans shall not be deemed approval from the standpoint of structural safety, suitability for purpose or conformance with building or other codes or other governmental requirements. RA W:\DOCSOEEDSICVWDe sede d-2A.1.DOC-8/16/01 _1- EXHIBIT C 1 Should it be necessary for GRANTEE to disturb the surface of the Easement Area GRANTEE agrees to notify Director in advance and to obtain Director's written approval of all plans for construction, 2 reconstruction and major repair and/or maintenance prior to commencement thereof. Said approval shall not be withheld capriciously or unreasonably, nor shall said approval be necessary in any emergency 3 situation. 4 Under the rights granted herein: a) any excavation made shall be made in such a manner as will cause the least injury to the surface of the ground around such excavation, b) the earth so removed by such 5 excavation shall be replaced, c) the surface of the ground shall be promptly restored as nearly as possible to the same condition as existed prior to excavation, d) GRANTOR's improvements shall be 6 protected in place and e) GRANTEE shall be solely responsible for the cost of repair or replacement of GRANTOR's improvements if such improvements are damaged due to GRANTEE's actions. 7 At all times when exercising the rights granted herein, GRANTEE shall do so as to not block but to 8 maintain GRANTOR's access to and from GRANTOR's facilities within the Prima Deshecha Landfill. All facilities installed by GRANTEE pursuant to this Agreement shall be maintained by GRANTEE in good 9 repair and in safe condition. 10 4. ACCESS RIGHTS (N) 11 GRANTEE and its respective contractors, agents, and employees, at all times, for the purpose of exercising the rights herein granted, shall have the right of access to and from the Easement Area by 12 routes over existing roads and trails as such routes are specified in writing from time to time by the Director. 13 5. HOLD HARMLESS (PMES5.1S) 14 GRANTEE hereby waives all claims and recourse against GRANTOR, including the right of contribution 15 for loss or damage of persons or property, including GRANTOR, its officers, agents, and employees, arising from, growing out of or in any way connected with or related to this easement, except claims 16 arising from the concurrent active or sole negligence of GRANTOR, its officers, agents, and employees. GRANTEE hereby agrees to indemnify, hold harmless, and defend GRANTOR, its officers, agents and 17 employees, against any and all claims, loss, demands, damages, cost, expenses or liability for injury to any persons or property, including GRANTOR, its officers, agents and employees, arising out of the 18 operation or maintenance of the property described herein, and/or GRANTEE's exercise of the rights under this easement, except for liability arising out of the concurrent active or sole negligence of 19 GRANTOR, its officers, agents, and employees, including the cost of defense of any lawsuit arising therefrom. If GRANTOR is named as co-defendant in a lawsuit, GRANTEE shall notify GRANTOR of 20 such fact and shall represent GRANTOR in such legal action unless GRANTOR undertakes to represent itself as co-defendant in such legal action, in which event GRANTEE shall pay to GRANTOR its litigation 21 costs, expenses and attorneys' fees. If judgment is entered against GRANTOR and GRANTEE by a court of competent jurisdiction because of the concurrent active negligence of GRANTOR and 22 GRANTEE, GRANTOR and GRANTEE agree that liability will be apportioned as determined by the court. Neither party shall request a jury apportionment. 23 24 6. TOXIC MATERIALS (N) 25 GRANTEE shall be responsible for and shall defend, indemnify, and hold GRANTOR, its officers, directors, employees, agents, and representatives harmless from and against all claims, costs, and 26 liabilities, including attomeys' fees and costs, arising out of or in connection with the use and disposal of Toxic Materials on the Easement Area by GRANTEE. If the use and disposal of Toxic Materials on the 27 Easement Area by GRANTEE results in contamination or deterioration of water or soil resulting in a level 28 of contamination greater than maximum allowable levels established by any governmental agency having EA w:\DDcs%DEEDskcvwoeaa dead-2n.i.Doc-8116/01 -2- EXHIBIT C 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 jurisdiction over such contamination, GRANTEE shall promptly take any and all action necessary to clean up such contamination. 7. REMOVAL AND/OR ABANDONMENT (PMES3.1 S) GRANTEE agrees that in the event the service for which said facilities were constructed is ordered discontinued and GRANTEE is not required by law, rule, or regulation of any governmental authority to furnish said service, or in the event the use of the facilities ceases for a period of more than one (1) year without written notice from GRANTEE to GRANTOR of the circumstances affecting such suspension and of GRANTEE's intention to resume usage of the facilities, GRANTEE, at the Director's request and at no cost to GRANTOR, shall remove and/or abandon any portion of said facilities owned, operated, and maintained by GRANTEE, within sixty (60) days after receipt of written notice from the Director to remove and/or abandon. In the event of such removal and/or abandonment, GRANTEE shall execute and record in the Official Records of Orange County, California, a Quitclaim Deed sufficient to remove the encumbrance of this easement from title to the Easement Area. 8. RELOCATION (PMES4.1 N) GRANTEE agrees that in the event said facilities shall at any time interfere with the use, repair, or improvement of GRANTOR's property, GRANTEE shall, within 180 days of receipt of written notice from Director, relocate said facilities to a site designated by Director. GRANTOR shall first furnish GRANTEE with a document containing terms and conditions similar to those contained herein. The cost of the first such relocation shall be the responsibility of GRANTEE and the cost of any subsequent relocation required by GRANTOR shall be the responsibility of GRANTOR. 9. REVISON OF LEGAL DESCRIPTION (PMES4.3 S) In the event that attached Exhibit 1" is subsequently found to inaccurately describe the location of said facilities, the parties agree that an amended Exhibit "1" will be prepared and recorded which will replace and supersede said Exhibit "1." Said amendment of Exhibit "1" will not affect, alter or change this Agreement. Furthermore, this Agreement will be deemed to be amended and will relate back and be in place as of the initial date of this Easement Deed and Agreement prior to said amendment of Exhibit "1." 10. EXCEPTIONS AND RESERVATIONS (PMES7.1 S) GRANTOR hereby reserves for itself and its successors and assigns, such surface and subsurface rights as will not interfere with or prohibit the complete use by GRANTEE, its successors and assigns, of the rights and easement herein granted. GRANTOR will not place or permit any building on the Easement Area or otherwise interfere with the full enjoyment by GRANTEE of the easement hereby granted. This grant is subject all to existing matters of record including contracts, leases, licenses, easements, encumbrances, and claims which may affect the Easement Area, and certain easements recorded in Book 7368, Page 374 and in Book 7485, Page 714 of the Official Records of Orange County, and the use of the word "grant" herein shall not be construed as a covenant against the existence of any thereof. 11. Adequate access to all structures must be provided and at no.time is there to be any interference with the free movement of SCE's equipment and materials. 2. At no time shall SCE's access to any tower location be cut off during any temporary grading operation. 3. All equipment working on the right of way must maintain a minimum clearance of 25 - feet from all SCE structures and 25 -feet from all overhead conductors. 4. Capistrano Valley Water District / County of Orange, Real Estate Operations Division and Metropolitan Transmission shall meet prior to occupancy for inspection of all involved structures to determine existing conditions. This inspection will include photographs of all damage and will be documented and signed by the above representatives. 5. Construction area must be watered down periodically to prevent dust contamination of SCE insulators. Any maintenance required by SCE on its facilities over and above normal, and resulting from this operation, shall be paid for by Capistrano Valley Water District / County of Orange. 7. All areas must be left in essentially the same condition as prior to commencement of the proposed work. 8. The SCE right of way shall be left in a condition satisfactory to SCE. The cost to repair any damage caused by Capistrano Valley Water District / County of Orange to the access roads, slopes, turnaround area, or overhead facilities shall be paid for by Capistrano Valley Water District / County of Orange. 9. Cribbing shall be installed if the ditch is to be left open or endangers SCE facilities. 10. Capistrano Valley Water District / County of Orange agree that all construction equipment, when not in use, shall be parked clear of SCE's right of way and rendered immobile. 11. Any earth disturbed within the right of way and/or backfilling shall be compacted to 90 percent. 12. Staging of equipment or materials shall not be permitted within the SCE right of way. 17. Underground facilities installed on the right of way shall have a minimum cover of six - feet and shall be capable of withstanding a gross load of 40 tons on a three -axle truck. 18. Suitable identification markers shall be installed indicating the location and depth of any underground lines and/or pipelines. 19. The subject 24 -inch water pipeline shall be constructed to withstand a pressure equal to at least One Hundred and Fifty Percent (150%) of its maximum operating pressure, and shall be so tested upon completion of its construction. Capistrano Valley Water District / County of Orange shall give the Superintendent of Metropolitan Transmission Area twenty-four (24) hours prior notice in writing of the time and place of testing said pipeline for such pressure in order that a representative of SCE may be present. 20. Additional structures or development will not be permitted on the right of way 21. At all times during construction of the subject 24 -inch water pipeline, the California Code of Regulations, Title 8, Article 37, Provisions for Preventing Accidents Due to Proximity to Overhead Lines, must be adhered to. 22. SCE shall be held harmless from any damage on or off the right of way resulting from the work being performed as described herein, and approval of these drawings by SCE does not relieve Capistrano Valley Water District / County of Orange or its engineers from any liability arising out of their design or construction of the project. Please contact Larry Benjamin at (310) 608-5148 a minimum of 48 -hours prior to start of construction. This letter should not be construed as a subordination of SCE's right, title and interest in and to its easements, nor should this letter be construed as a waiver of any of the provisions contained in said easements or a waiver of any costs of relocation of affected SCE facilities. As previously indicated, it is necessary that the use of land within an operating high voltage transmission line right of way be closely coordinated. For this reason, it will be necessary for SCE to assume your project has been either delayed or canceled in the event the copy of this letter has not been signed and returned within sixty days from the date of this letter. Should this occur, any consent granted or implied is voided without further notice in order to protect our rights and facilities. If the project is subsequently reactivated, please contact SCE again prior to the start of any construction, referencing our subject CRE file number. We will then work together with you to ensure the project is coordinated so as to avoid interference with SCE installations and operations. CVWD Minutes 2 10-02-01 AGENDA ITEM October 2, 2001 TO: George Scarborough, General Manager FROM: Amy Amirani, Public Works Director SUBJECT: Consideration of Plans and Specifications and Call for Bids - SC04 Terminal Pipeline Project (CIP No. 794) RECOMMENDATION By motion, 1) approve the SC04 Terminal Pipeline Project plans and specifications; 2) release the project for bidding; 3) authorize the General Manager to enter into a right - of -entry agreement with the County of Orange for the Prima Desecha Landfill; and 4) adopt a resolution accepting easements from the Estates of San Juan Homeowners Association and the San Juan Hills Estates Homeowners Association. SITUATION On February 15, 2000, the Board approved entering into a Personal Services agreement with Malcolm Pirnie, for civil engineering design services for the SC04 Terminal Pipeline Project. The Environmental Administrator reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and issued a Mitigated Negative Declaration, on July 26, 2000. No objections were noted to the selected route. On September 5, 2000, the Board selected the La Pata alignment for this project; and, directed staff to develop the final construction plans for this project. On April 3, 2001, the Board adopted the Certified Mitigated Negative Declaration by Resolution No. CVWD 01-4-3-4. Also on April 3, 2001, the Board approved the plans and specifications, and called for Bids. Since that time, bidding has been delayed pending funding of this project. Concurrent with the October 2, 2001 Board meeting, the Board will be considering an increase in the water operating rate. This action is the final step in the FY 2001-02 budget process and will allow the District to move forward with issuance of debt to fund this project. Also, the original bid package offered two bid alternatives for pipeline material in the upper reaches of the pipeline: steel or polyvinyl chloride (PVC). Since that time, a more refined economic analysis of the costs did not show PVC to be substantially less expensive, and PVC has been removed as an alternative construction material to facilitate the bid process. Malcolm Pirnie has completed the design work, and has obtained all necessary permits, and environmental clearances. The alignment described below is depicted on the attached Exhibit 1. The water system improvements known as the SC -04 South Connectors I and II (the SC04 Terminal Pipeline Project) are identified in the Capistrano FOR CITY COUNCIL AGENDA� J Agenda Item October 2, 2001 SC04 Terminal Pipeline Project Valley Water District (CVWD) Domestic Water Master Plan dated May 1999. This project will enhance overall water service reliability and increase capacity on the southeast side of the District. The project includes approximately 22,000 lineal feet of 24 -inch diameter pipeline, 5,400 lineal feet of 12 inch diameter pipeline, 3 pressure regulating stations, and modifications to existing system interconnections. Connections to two existing tracts require easements from the homeowners associations. Easement documents are being executed by The Estates of San Juan HOA and the San Juan Hills Estates HOA. The County of Orange has prepared a right -of -entry agreement for the Prima Deshecha Landfill. This agreement allows construction to begin, and provides for conveyance of the permanent easement to the District upon completion of the SC04 pipeline construction. Pending CVWD Board's acceptance, this agreement will go to the Orange County Board of Supervisors for their approval, at which point the agreement will be executed. PROJECT DESCRIPTION The SC04 Terminal Pipeline Project starts at the intersection of Ortega Highway and Antonio Parkway, and crosses Ortega Highway, continues south, adjacent to, and in the right-of-way (RNV) of La Pata up to the Prima Desecha Landfill boundary. This alignment then heads west along the northerly boundary of the landfill. The alignment then continues south along the westerly edge of the Landfill and meanders southwesterly to the proposed location of the SC04 Terminal Reservoir.
