22-0906_CC_Minutes_Regular Meeting_Executive SessionMINUTES September 6, 2022 SAN JUAN CAPISTRANO CITY COUNCIL ' REGULAR EXECUTIVE SESSION MEETING Mayor Reeve called the September 6, 2022, Regular Executive Session Meeting of the City Council to order at 3:00 p.m., in the City Council Chamber. ROLL CALL COUNCIL MEMBERS IN ATTENDANCE: Mayor Derek Reeve, Mayor Pro Tem Howard Hart, and Council Members John Taylor, Troy Bourne and Sergio Farias. COUNCIL MEMBERS ABSENT: None. ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE SESSION ITEMS: • Michelle Leeg, Irvine resident (provided handout). EXECUTIVE SESSION (610.85) An Executive Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.8, the City Council met with Real Property Negotiators (Benjamin Siegel, City Manager; and t Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at 32681 Alipaz Street (APN 121-190- 57). Negotiating party: The Ecology Center. b. Pursuant to Government Code Section 54956.8, the City Council met with real property negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment for license of real property described as the Rancho Mission Viejo Riding Park at San Juan Capistrano generally located at the southwest corner of Ortega Highway and Avenida La Pata and addressed as 30753 Avenida La Pata. The property owner is themCity of San Juan Capistrano. Negotiating party: Action Sports Management Group, LLC dba The Ridland Group. c. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of City of San Juan Capistrano v. Tokio Marine Specialty Insurance Company, et al., Orange County Superior Ct. Case No. 30-2019-01061811-CU- IC-CJC. d. Pursuant to Government Code Section 54956.8, the City Council met with Real Property Negotiators (Benjamin Siegel City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at La Novia Ave. and San Juan Creek Road (APN: 666-011-27, 666-011-28, 666-013-06, 666-042-10 and 666-042- 11). Negotiating party: San Juan Hills Golf Club, L.P. 9/6/2022 e. Pursuant to Government Code Section 54956.8, the City Council met with Real Property Negotiators (Benjamin Siegel, City Manager; and , Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at 26874 Ortega Highway, 31776 EI Camino Real, and 31782 EI Camino Real. Negotiating party: 26874 Ortega Highway LLC. f. Pursuant to Government Code Section 54956.8, the City Council met with Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning approximately 10,500 square foot portion of City owned vacant property located at the terminus of Calle Jardin and Alipaz Street (APN: 668- 211-19. Negotiating party: Eric V. Holt. g. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council conferred with Legal Counsel to discuss anticipated litigation — significant exposure to litigation (1 item). h. Pursuant to Government Code Section 54956.8, the City Council met with Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at approximately 1,300 feet southeast of the terminus of Avenida La Mancha (APN 664-251-08) and property located at the terminus of Camino Lacouague (APN 664-171-01) and (APN 664-172-01). Negotiating party: Southwest Resource Management Association, a California nonprofit public benefit corporation. ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: Jeffrey Ballinger, City Attorney, announced that Council Member Taylor will be recusing from two items on closed session. The first item due to a source of income interest and the second due to a real property interest.
