SPECIAL AND TELEPHONIC MEETING
Mayor Pro Tem Hart called the August 16, 2022, Special and Telephonic Meeting of the
City Council to order at 3:08 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor Derek Reeve Qoined the meeting shortly
after commencement, virtually), Mayor Pro Tem Howard Hart, and Council Members
John Taylor Qoined the meeting virtually), Troy Bourne and Sergio Farias (joined the meeting
shortly after commencement).
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON EXECUTIVE
SESSION ITEMS: None.
EXECUTIVE SESSION (610.85)
An Executive Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the
City Council conferred with legal counsel pertaining to existing litigation in the
matter of Preserve Our Farm SIC v. City of San Juan Capistrano et al., OC
' Superior Court Case No. 30-2022-01257292-CU-WM-CJC.
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at 32681 Alipaz Street (APN 121-190-57). Negotiating party:
The Ecology Center.
c. Pursuant to Government .Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at La Novia Ave. and
San Juan Creek Road (APN: 666-011-27, 666-011-28, 666-013-06, 666-042-10
and 666-042-11). Negotiating party: San Juan Hills Golf Club, L.P.
d. Pursuant to Government Code Section 54956.8, the City Council met with
its real property negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment for
license of real property described as the Rancho Mission Viejo Riding Park at San
Juan Capistrano generally located at the southwest corner of Ortega Highway and
Avenida La Pata and addressed as 30753 Avenida La Pata. The property owner
is the City of San Juan Capistrano. Negotiating party: Action Sports Management
' Group, LLC dba The Ridland Group.

e. Pursuant to Government Code Section 54956.8, the City Council met with its ,
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) pertaining to the price and terms of payment for
license of a portion of property located at 31421 La Matanza Street, also known
as TJ Meadow Building. Negotiating party: George Peppas, Chamber of
Commerce.
Pursuant to Government Code Section 54956.8, the City Council met
with its Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey
Ballinger, City Attorney) concerning the price and terms of payment concerning
certain real property located at 29943 Camino Capistrano (Northwest Open
Space) Negotiating party: Frontier Real Estate Investments.
Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with legal counsel pertaining to existing litigation in the matter of City of
San Juan Capistrano v. Tokio Marine Specialty Insurance Company, et al.,
Orange County Superior Ct. Case No. 30-2019-01061811-CU-IC-CJC.
h. Pursuant to Government Code Section 54956.9 (a), (d)(2), the
City Council conferred with Legal Counsel to discuss anticipated litigation —
significant exposure to litigation (1 item).
ANNOUNCEMENT OF EXECUTIVE SESSION ACTIONS: None.
ADJOURNMENT: I
There being no further business, Mayor Pro Tem Hart adjourned the meeting to
Tuesday, August 16, 2022, at 5:00 p.m. for a Public Business Session, in the City
Council Chamber.
