SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL AND TELEPHONIC MEETING
Mayor Pro Tem Reeve called the August 17, 2021, Special and Telephonic Meeting of
the City Council to order at 3:04 p.m., in the City Council Chamber, with Mayor Taylor
attending by teleconference, pursuant to Executive Order N-29-20.
ROLL CALL
COUNCIL MEMBERS IN ATTENDANCE: Mayor John Taylor, Mayor Pro Tem Derek
Reeve, and Council Members Howard Hart, Troy Bourne and Sergio Farias.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON CLOSED
SESSION ITEMS: None.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council conferred with
real property negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for license of real
property described as the Rancho Mission Viejo Riding Park at San Juan
Capistrano generally located at the southwest corner of Ortega Highway and
Avenida La Pata and addressed as 30753 Avenida La Pata. The property owner
is the City of San Juan Capistrano. Negotiating parties: Frontier Real Estate
Investments; Capistrano Experience; and The Ridland Group.
b. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation — significant
exposure to litigation (5 items).
c. Pursuant to Government Code Section 54956.9(d) (4), the City Council conferred
with Legal Counsel to discuss initiation of litigation (1 item).
ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Mayor Taylor recused himself
from Closed Session Item C. Jeff Ballinger, City Attorney, announced that the
City Council voted 4-0 with Mayor Taylor recused to approve a Settlement Agreement
between the City of San Juan Capistrano and the True Tea Parking LLC; The Allan and
Claudia Niccola Trust.
ADJOURNMENT:
There being no further business, Mayor Pro Tem Reeve adjourned the meeting to
Tuesday, August 17, 2021, at 5:00 p.m. for a Public Business Session, in the City
Council Chamber.
