SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL MEETING
Mayor Bourne called the March 2, 2020, Special Meeting of the City Council to order at
3:07 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Mayor Troy Bourne, Mayor Pro Tem John Taylor, and
Council Members Derek Reeve and Brian L. Maryott.
COUNCIL MEMBERS ABSENT: Council Member Sergio Farias.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON CLOSED
SESSION ITEMS: None.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council conferred with
real property negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for license of real
property described as (A) the Rancho Mission Viejo Riding Park at San Juan
Capistrano generally located at the southwest corner of Ortega Highway and La
Pata Avenue and addressed as 30753 La Pata Avenue. The property owner is the
City of San Juan Capistrano. Negotiating party: Blenheim Facility Management,
LLC.
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at La Novia Ave. and
San Juan Creek Road (APN: 666-011-27, 666-011-28, 666-011-18, and
easements affecting parcels: 666-013-06, 666-042-10 and 666-042-11).
Negotiating party: San Juan Hills Golf Club, L.P. -
c. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at APN 668-241-32, APN 668-241-35, APN 668-241-37, and
APN 124-160-62 located at the southwest corner of Ortega Hwy and Del Obispo.
Negotiating party: Doug Schwartz.
d. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at: APN 121-141-11, 121-141-12, 121-141-07, 121-141-08, and
121-141-27 (i.e., "Downtown Multi -Modal Lot"). Negotiating parties: SJC Mission
Ventures LLC; Capistrano Plaza LLC; and, 26755 Verdugo LLC.

e. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with legal counsel pertaining to existing litigation in the matter of City of
Santa Ana v. County of Orange; City of Dana Point; City of San Clemente; City of
San Juan Capistrano; and DOES 1-10. U.S. Dist. Ct. Central Dist. of Cal.— So.
Div. Case No. 8:20-cv-00069.
f. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with legal counsel pertaining to existing litigation in the matter of
Marcus Hedgpeth v. City of San Juan Capistrano et al., U.S. Dist. Ct. Case No.
8:19-cv-02275.
g. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation — significant
exposure to litigation (3 items).
ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Mayor Pro Tem Taylor recused
himself from Closed Session Items D and G due to proximity to his residence.
ADJOURNMENT:
Thee ei g no further business, Mayor Bourne adjourned the meeting to
